Reuters: Padilla Insists He's Sane
Jose Padilla insists that he's sane , despite three and a half years of abuse, interrogation and isolation at the hands of his government, and at least one doctor seems to side with him:
He is a bit paranoid and believes the government is persecuting him, "but this does not appear to be delusional," wrote one of doctors who examined the alleged al Qaeda operative in a Miami prison cell at his lawyers' request.
In other words, just because he's paranoid doesn't mean they're not out to get him.

They're not "out to got him". They've *got* him.
He was initially held without charge for *years* by order of the *President of the United States*, and was only charged because of a challenge before the *Supreme Court*. Even if one dismisses the claims of abuse and drugs, of *course* he's going to feel persecuted. Suffering Jesus, so would I. A person in his situation would have to be deluded to *not* feel persecuted.

bingo. This is kind of a catch-22, right? He *is* being persecuted by the government... so his belief that he's being persecuted isn't delusion, it's an accurate perception of his situation.

In other words; Padilla would be deemed delusional and mentally impaired if he WASN'T paranoid of being perniciously persecuted, terrorized, or tortured by the US government.
