WSJ: CIA Blocking Cunningham Investigation
The CIA is refusing to cooperate with federal prosecutors investigating the Duke Cunningham scandal, the Wall Street Journal's Scott Paltrow reports today.
Before getting caught in 2005, Cunningham was involved in a sprawling corruption ring between Congress and the national security community. The scandal allegedly enjoyed the participation of current and former CIA officials, including Kyle "Dusty" Foggo, the executive director of the agency. Foggo would be the highest-ranking CIA official to be prosecuted in the agency's history, according to Paltrow.
Prosecutors had expected to indict Foggo several months ago, but the Agency's refusal to declassify important documents has hampered their efforts, Paltrow reports.
Of course, prosecutors haven't received much help from Congress with their investigation, either. Last month they were forced to serve subpoenas to several powerful committees in an effort to force them to turn over documents.
Foggo's indictment -- and possible plea bargain -- would be a notable triumph for the Feds. For many months the case has stagnated, and observers have wondered if the investigation was hopelessly compromised. Nailing Foggo would also be important for prosecutors, as it would give them leverage to go after alleged Cunningham briber Brent Wilkes. Wilkes, who ran a government contracting business, was close with Foggo and is said to have worked closely with him. Despite being identified by Cunningham as a major briber, Wilkes has refused to plead guilty or cooperate with prosecutors.





Surely, the Justice Department, part of Mr. Cheney's executive branch, can cooperate with the CIA, another and much more beloved part of Mr. Cheney's executive branch. Or is "obstruction of justice" a better phrase than "national security"? A concept that now seems indistinguishable from Mr. Cheney's security.

Bush/Cheney crime families will do anything to keep the truth from coming out about their criminal behavior. Congress needs to take over the investigation if the CIA won't cooperate. Congress does hold the purse strings for the CIA as well so, just hold some money back and see if the canaries can be taught to sing. To hell with the criminals in the Republican party.

Maybe the investigators should take a closer look at the Wilkes Foundation. I posted a series of comments at the TPM Cafe about discrepancies between what the Wilkes Foundation reported on its website as revenue from the Tribute To Heroes galas and what it reported in its 990s.
Brent Wilkes bragged that the 2002 Tribute to Heroes gala honoring Duke Cunningham raised almost $600k but the Wilkes Foundation only reported $295k in total revenue. I found no indication of a separate entity set up for the Tribute To Heroes galas.
For example, AXA Advisors, LLC supposedly took a $100k table for the 2002 Tribute To Heroes gala but the $100k was not reported in the Wilkes Foundation 990. David Stecher, who was then an executive vice president of AXA Advisors, was listed as having taken a $50k table on the Wilkes Foundation website but a $50k contribution from Stecher was not reported in the 2002 990.
Stecher, as an individual, also made a $50k contribution to the Wilkes Foundation in 2001, a year in which the foundation only made a $500 donation to a DC foodbank. That's a lot of money for one person to contribute to a not-for-profit with no track record.
On the San Diego Children's Hospital website, the hospital claimed that the Wilkes Foundation raised more than a million dollars for the hospital. According to its 990s, the Wilkes Foundation only donated $504k in cash between 2001 and 2004. None of it went directly to the San Diego Children's Hospital.
The Air Warrior Courage Foundation reported making an $86k grant jointly with the Wilkes Foundation in 2003 but the Wilkes Foundation never recorded a grant to the Air Warrior Courage Foundation. $25k of the $52k in donations made by the Wilkes Foundation in 2003 went to Marshall Faulkes's scam foundation.
One of the odder contributions made to the Wilkes Foundation was a $50k grant from the DC-based Community Foundation For National Capital Region in 2004.
If I were investigating Wilkes, I'd make sure I knew about all of the foundation's bank accounts and I'd look at the foundation's bank statements.

The story doesn't say why the CIA are stonewalling. Obviously, their putative rationale might be 180 degrees opposite their actual rationale. But the public do at least deserve to know their putative rationale. Furthermore, it ought to be on record for future debate.

Just more proof the CIA classifies things more to avoid embarassment and prosecution than to protect any National Security.
In this case the trail leads back to more CIA drug running. Cunningham and Wilkes link to giant war contractor Titan. Titan for a while was (for as yet unexplained reasons) pumping up the prospects of SkyWay Corporation, a CIA front company whose sole assets were two DC-9 airplanes. These planes were both painted with official-looking Dept. Homeland Security seals. One of them was busted in Mexico last April with 5.5 tons of cocaine aboard. This was right before Porter Goss resigned for as-yet unexplained reasons.
I can certainly see why the CIA would be classifying their criminal behavior so they can avoid prosecution for drug running.
America will have a drug problem for as long as it has a CIA.

Wouldn't it be great theater if federal marshals decided to raid CIA HQ? They know how to serve up the Branch Davidian treatment except when their fugitive happens to be a federal agency. So, Feds, what about a little reverse COINTELPRO for a change? Well, I guess when pigs fly, and our fighting ranks begin to swell with all those "patriotic" Americans who have so far preferred to advance the cause of this war from a safe distance. Too bad, because these chickenhawks might otherwise have discovered, once in Iraq, the extent to which the substance and flavor of their bumper-sticker "support the troops" rhetoric resembles that of a cardboard turkey. I think as long as the Bush Administration is in power, "America will be corrupt to core." Everyday they are consolidating their power s little bit more under the banner of "national security."
