NYT: Justice Reports Lauded Ousted Prosecutors
The New York Times gets ahold of the internal Justice Department performance reports for the eight fired prosecutors and finds that six were rated “well regarded,” “capable” or “very competent.”
The Justice Department has insisted, of course, that the firings were "performance related." But wouldn't you know it? Those aspects of the prosecutors' performance that led to their dismissals apparently didn't make it into their comprehensive performance reviews... or so a Justice Department official gamely argues:
In response, a senior Justice Department official said the reviews, which focused on management practices within each United States attorney’s office, did not provide a broad or complete picture of the prosecutors’ performance.The official, speaking on condition of anonymity because of the confidential nature of personnel information, said, “The reviews don’t take into account whether the U.S. attorneys carried out departmental priorities.”
Referring to the 94 United States attorney’s districts, the official said, “You can’t have 94 different sets of priorities,” suggesting that the dismissed prosecutors had failed to follow priorities set by the Justice Department in Washington.
However, each case report included a statement that each of the ousted prosecutors had established strategic goals set by the Justice Department in high priority areas like counterterrorism, narcotics and gun violence.
Oh, well.
The prosecutors themselves seem to have a different idea of what happened:
In recent days, several of the prosecutors have described conflicts with the Justice Department over death penalty cases and pending political corruption investigations as a possible factor in their firings. Justice Department officials have denied such issues were a factor.
Oh look . . . The factual evidence evidence points towards what everyone already knows. Only in Republican-world is terming folk for political reasons considered performance-based reasons . . . AND look even they are embarassed about it becoming public knowledge.

Congress needs to investigate this specifically.
Call the dismissed prosecutors before them. Gonzales should be called as well. Let's get to the bottom of this.

There are a couple of article's at Amerin=can Progress which indicate that Lam's emphasis was apparently in accord with DOJ priorities as evidenced by the priorities set for FBI investigations, which DOJ uses for its investigative arm:
"Lam’s emphasis on public corruption is consistent with the law enforcement priorities officially set by the Justice Department. The department rates action against public corruption above all other areas of law enforcement except the prevention of terrorist attacks, counter intelligence, and the prevention of cyber attacks against American computer networks."

Obviously Civil Rights violations by the US Army on a 100% service connected disabled veteran, the assault of that veteran by a US Army goon as he shopped in a store in broad daylight in order to disrupt a federal lawsuit, and multiple prior threats are not priorities in the Bush Administration for US Attorney's. It's been over a week since USA Nelson Cohen was made aware of the attack on John Mitchell by the US Army in Alaska and he has of yet done nothing.
Joint Chief of Staff Chairman Peter Pace toured the post this Friday. The Chief of Staff, Col Hazen Baron, was notified Tuesday, Sen. Ted Stvens office Wednesday.
As is completely evident in the Army's Building 18 at Walter Reed that hit the press this week, Bush is counting on the public's ignorance and apathy. A year after it was first brought to the Army's attention by Don Imus, Robert Gates announced a panel to investigate. After the public has been lulled back to sleep the mold will again grow on disabled warriors hospital rooms walls.
Bush is putting in place his coverup team. If the Democrats don't investigate, supeona and impeach they will wait it out. When the headlines disappear about the US Attorney's Bush will purge some more.
Ask C-SPAN to cover these hearings. Make Them stay in the public eye with the US Attorney scandal.

Dear Senators,
My Fiancee, John R. Mitchell has a federal lawsuit against the US Army in Alaska (USARAK) for multiple Civil Rights violations. John is a 100% service connected disabled veteran that went back to help with this war in the US Army Alaska's Command Center at Ft Richardson. He agreed to go to Iraq to help with the war and was made disabled a second time by the outright abuse by the US Army Alaska. I will put all the related information at the end of this letter. Since filing this lawsuit he has received multiple threats, one of which, an email, we brought to the FBI.
This past Saturday John and I were shopping in a local store when one of the Command Center employees, Tony Erne, from Ft Richardson came up behind John, grabbed him on the shoulder and turned him around to confront him. John told him twice to stay away and then I got in the middle of them. I have bruises on my arm as a result of trying to keep Mr. Erne away. Mr. Erne is trying to have John arrested for threatening him. This incident is an obvious setup of John Mitchell by the US Army. What is next, Mr. Robert Gates reviving his old Death Squads?
John had gone to the US Attorney's office before filing a suit through a private attorney to try and get help in stopping these multiple abuses by the US Army. What does it take for the US Attorney to finally do his job and protect the Civil Rights of a 100% service connected disabled veteran? I would like Mr. Cohen to answer that question. Preferably at his confirmation hearing.

It needs to be noted that someone in the HR department at the DoJ does not share the boss's destain for the rule of law BUT was force to operate outside the law to do the ethical thing.
