Schumer: "We Will Get to The Bottom of This"
Sen. Chuck Schumer (D-NY), speaking on the Senate floor this afternoon, vowed to "get to the bottom" of the administration's December purge of federal prosecutors, and said that if they found that the prosecutors had indeed received positive job evaluations from the Justice Department before being booted, "there will be real trouble."
Democrats had sought to push through a bill today that would restore the law on U.S. Attorneys back to its earlier form, before a change was slipped into the USA PATRIOT Improvement and Reauthorization Act last year. That change effectively allowed the administration to permanently appoint U.S. Attorneys without Senate confirmation. The bill would set a 120 day deadline to those appointments, when a federal judge would appoint a permanent replacement if the president hadn't nominated one for the Senate to confirm -- which is the way the law was for twenty years before last year's change.
But the bill was blocked by Sen. Jon Kyl (R-AZ), who, along with the administration, argues that having judges appoint federal proscutors raises separation of powers issues.
In response, Sens. Patrick Leahy (D-VT), Schumer and Dianne Feinstein (D-CA) all gave speeches, Feinstein offering a prolonged tribute to U.S. Attorney Carol Lam, the prosecutor who sent Duke Cunningham to prison, and indicted the former #3 at the CIA on Tuesday. Lam is one of the seven ousted prosecutors; her last day is today. Portions of Leahy's remarks are below, and we'll try to get you a transcript of Feinstein's remarks soon.

From Sen. Leahy's remarks:
In our hearing last week, Paul McNulty, the second in command at the Department of Justice, testified that Mr. Cummins’ dismissal was not related to how well he did his job. In fact, Mr. McNulty said he had no “performance problems,” but was removed merely to give an opportunity to Mr. Griffin, a person whom he admitted was not the “best person possible” for the job and who is reported to have been involved in an effort during the 2004 election to challenge voting by primarily African-American voters serving in the Armed Forces overseas. This was not a vacancy created by necessity or emergency. This was a vacancy created by choice to advance a political crony.
And on the administration's Constitutional separation of powers concerns:
I have heard not a word from the apologists who seek to use the Constitution as a shield for these activities about what the Constitution says. The Constitution provides congressional power to direct the appointment power. In Article II, the part of the Constitution that this Administration reads as if it says that all power resides with the President, the President’s appointment power is limited by the power of Congress. Indeed, between its provisions calling for appointments with the advice and consent of the Senate and for the President’s limited power to make recess appointments, the Constitution provides: “But the Congress may by law vest the appointment of such inferior officers, as they think proper, in the President alone, in the courts of law, or in the Heads of Departments.” Thus, the Constitution contemplates exactly what our statutes and practices have always provided. Congress is well within its authority when it vests in the courts a share of the appointment power for those who appear before them.
From Sen. Feinstein's statement:
Let me talk about a few of the U.S. attorneys involved. According to press reports, at least three were given glowing reviews from their performance audits in the recent past. According to the Las Vegas Review-Journal, Daniel Bogden, the U.S. Attorney for Nevada, said Wednesday that he was stunned to hear the Department of Justice requested that he step down from his post because of performance reasons. He went on to say: "To this date, no one from the department has previously identified any issues with my performance or the performance of my office."
A similar story has surfaced about Washington U.S. Attorney John McKay. The Seattle Times reported last week: "Seven months before he was forced to resign as U.S. attorney for the western district of Washington, John McKay received a glowing performance review from Justice Department evaluators."
The article went on to quote the report which stated: "McKay is an effective, well-regarded and capable leader of the [U.S. attorney's office]"...according to the team of 27 Justice Department officials.
Yet on December 7th, Michael Battle, director of the Justice Department's executive office for U.S. attorneys, called McKay and asked him to step down.
"I was told to resign by the end of January," McKay confirmed..."I asked what the reason was, and they told me there was none."
Then, of course, there is former-Arkansas U.S. Attorney Bud Cummins. In a story that ran last month, Mr. Cummins stated that the Director of the Executive Office of U.S. Attorneys, Michael Battle, made it clear that although he was being asked to leave, "it was not about me but about their desire to give someone else the opportunity to have the appointment."
Mr. Cummins said he specifically asked if his job performance was a problem when he got the call: "[Mr. Battle] assured me it was exactly to the contrary."
These are three cases that have been documented where U.S. attorneys did not have any performance-related concerns as alleged by the Department. In addition, I have heard similar reports about other U.S. attorneys. I want to speak in specific about one. That is the U.S. Attorney from San Diego, CA.
Today is U.S. Attorney Carol Lam's last day in office. I want to commend her. I thank her for the work she has done in that office. She was sworn in as U.S. attorney in September of 2002 and was appointed by the President in November 2002. Prior to serving as U.S. attorney, she was a judge of the Superior Court of San Diego, and she served as an assistant U.S. attorney in the southern district of California for 11 years. So she was no newcomer. She has been successful in bringing many of the country's most important corruption cases. I want to go through a few of them.
In March of 2004, Steven Mark Lash, the former chief financial officer of FPA Medical Management, was sentenced for his role in defrauding shareholders and lenders of FPA. The collapse of the company left more than 1,600 doctors being owed more than $60 million and patients reported being unable to obtain medical care because FPA had ceased paying providers. Thank you, Carol Lam.
In January 2005, Mark Anthony Kolowich, owner of World Express Rx, pled guilty to conspiracy to selling counterfeit pharmaceuticals, conspiracy to commit mail fraud and smuggle pharmaceuticals, and conspiracy to launder money. Mr. Kolowich had run an Internet pharmacy Web site where customers could order prescription drugs without a valid prescription. The judge called him the kingpin and architect of an elicit pharmaceutical ring that recruited many others to smuggle drugs across the United States-Mexico border at San Ysidro. Ms. Lam also announced that charges had been filed against five other individuals in a related case involving MyRxForLess.com. Thank you, Carol Lam.
In July 2005, Ms. Lam brought a case against San Diego councilman Ralph Inzunza and Las Vegas lobbyist Lance Malone. They were convicted on multiple counts of extortion, wire fraud conspiracy, and wire fraud. They were accused of trading money for efforts to repeal a law.
In November 2005, Ms. Lam secured a guilty plea from former Representative Randy "Duke" Cunningham for taking more than $2 million in bribes in a criminal conspiracy case involving at least three defense contractors, after he accepted cash and gifts and then tried to influence the Defense Department on behalf of donors. He also pled guilty to a separate tax evasion violation for failing to disclose income in 2004. Thank you, Carol Lam.
In addition, earlier this week, Carol Lam announced two more indictments of Kyl "Dusty" Foggo, former top officer at the CIA, and Brent Wilkes, a defense contractor accused of bribing Duke Cunningham and the prime benefactor of the secret CIA contracts. Thank you, Carol Lam.
This woman was called and told to resign by a date specific, after she has done all of this good work. Ms. Lam and the San Diego U.S. Attorney's office have also pursued and successfully prosecuted other important cases, including:
In September 2005, the president of the San Diego chapter of Hell’s Angels pled guilty to conspiracy to commit racketeering. Guy Russell Castiglione admitted that he conspired to kill members of a rival motorcycle gang, the Mongols, and to sell methamphetamine. Thank you, Carol Lam.
Then in December 2005, Daymond Buchanan, member of Hells Angels, was sentenced to 92 months in Federal prison for participating in a pattern of racketeering. He admitted in his guilty plea that he and other Hell’s Angels also inflicted serious bodily injury upon one victim and that another Hell’s Angel brandished a firearm during the offense.
At that time, Ms. Lam announced, “With the president, sergeant at arms, secretary, treasurer, and six other members of the Hell's Angels convicted of racketeering charges and facing long prison sentences, the San Diego chapter of the Hell's Angels has been effectively shut down for the foreseeable future.” Thank you, Carol Lam.
And what does she get? Fired without cause.
In September, 2006, Jose Ernesto Beltran-Quinonez, a Mexican national, pleaded guilty to making false statements about weapons of mass destruction. Mr. Quinonez was sentenced to 3 years in Federal prison for making up a story about Chinese terrorists sneaking into the United States with a nuclear warhead. That hoax prompted a massive investigation, Federal warnings, discussions at one of President Bush's security briefings, and a nationwide hunt for the group of Chinese supposedly plotting the attack. Thank you, Carol Lam.
In December 2006, Mel Kay, of Golden State Fence Company, and Michael McLaughlin, pleaded guilty to felony charges of hiring illegal immigrants and agreed to pay fines of $200,000 and $100,000, respectively. The company, which built more than a mile of the 15-foot-high fence near the Otay Mesa border crossing in San Diego, agreed separately to pay $5 million on a misdemeanor count, one of the largest fines ever imposed on a company for an immigration violation. Thank you, Carol Lam.
These are just some of the important cases Carol Lam has pursued during her tenure. She does not deserve this kind of treatment.
In addition, during her previous time in the office, Ms. Lam prosecuted and convicted several high-ranking members of La Cosa Nostra, a Chicago-based organized crime family. She also secured a guilty plea and settlement of $110 million against National Health Laboratories, Inc., in a Medicare fraud case.
Ms. Lam has had a distinguished career and she served the Southern District of San Diego well, and everyone in that district knows that. I regret that main Justice does not. I am quite disappointed that main Justice chose to remove her, especially given the ongoing work in which the office is involved.
Now, like Senator Schumer, I was present yesterday when the Justice Department briefed us and several other Senators as to why they asked these U.S. attorneys to leave. With the record I just pointed out, nothing that was said yesterday justifies asking this U.S. attorney to leave without cause -- nothing. That is why this is an issue. I believe their intent was to bring in people from the outside to give some of their bright young people an opportunity. This might not be wrong, if they weren’t also attempting to avoid confirmation. Without confirmation, the Department of Justice could bring in political operatives or anybody else. That is wrong.

There has been no oversight on this administration for over 6 years. What Sen. Shumer PROMISED was OVERSIGHT on the power grab by George Bush.
Democrats are going to look into the facts and if these people were indeed fired without cause, Democrats will change the law back to the way it worked when the Executive Branch had oversight from the Legislative Branch.
If I were one of these fired attorneys, I personally would consider that a gift from the Truth Gods.
I think this is why the Senate is going to be even more blue in 2008 -- GOP Admin apologists are still rubber-stamping whatever Bush does.
Not a good choice, imho.

Realizing that would take a lot of manuevering, but a good investigation and PR campaign exposing McNulty's comments would help with it a lot.

No, not even close. The article says the Dems identified yet another extra-Constitutional overreach by the Bush Administration, tried to file a bill to fix the problem, but that was stopped by an obstructionist Republican senator making a dubious legal claim.
I hope this isn't taken the wrong way, but sometimes things aren't meant to be broken down into a sound bite.
What would you have liked to see the Dems do? Start a fistfight on the Senator floor? I'm so sick and tire of this no win nonsense.
When Dems take deliberate, concerted, intelligent action, they're derided for "just talking." When they get angry and make threats, they're derided for being "unhinged".

What strikes me is that the executive branch sought to get a law passed granting them the power to do these appointments. This is the tacet admission that it is congress where this power is vested. The president DID NOT as he has in the past simply used "his" "authority" as "described in the constition". He asked congress [uh, he asked Arlen actually ] for the authority. They can decide to take it back.
So we are all in agreement, no?

This is only in part about capping investigations of republican malfeasance and criminality. The flip-side is that these political hacks will be able to create all sorts of problems for the dem majority when they start their own investigations, meritorious or not. They will be able to frame the democrats as the party of corruption and set the stage for resurgence of the republican party to power. The press will be only too happy to oblige. This purge of honest prosecutors needs to be stopped now.

Joe Conason has written a pretty good backgrounder on this situation over at Salon.com
According to Joe while Arlen Specter is the senator who is reported to have inserted the change in the USA Patriot Act it was really the work of a staffer.
According to Joe, The staffer who reportedly performed this bit of dirty work is Michael O'Neill, a law professor at George Mason University and former clerk for Supreme Court Justice Clarence Thomas. As the Washington Times explained when O'Neill was appointed as the Senate Judiciary Committee's chief counsel, many observers believed that Specter had hired him to reassure conservatives of his loyalty to the Bush White House. Right-wing distrust had almost ousted the Pennsylvania moderate from the Judiciary chairmanship, and appointing O'Neill was apparently the price for keeping that post.
Evidently O'Neill rewarded Specter by sneaking through legislation to deprive him and his fellow senators of one of their most important powers, at the behest of an attorney general intent on aggrandizing executive power. The results of this backstage betrayal -- now playing out in a wave of politicized dismissals and hirings -- were perfectly predictable and utterly poisonous.

We need to change the law AFTER, we're able to replace the Bush lacky's.

The Republicans must have thought , they were going to hold on to power. Now that they see the Democrats are poised to take over, Republicans will try to change the law now, so as to remove this tool from the Democrats

Nixon's attempt to just fire everyone investigating him was a "high crime" provoking a watershed response. Given Abrahamoff's 480 visits to the White House, Republican corruption in Congress can't be far from Bush's ankles.
The problem isn't just that Bush's transgression is to remake EVERY rule, to leave a landscape littered with violated political values that makes this look like nothing--it's that there are plenty of people (in D.C. & out) that think it's possilbe or responsible to do nothing. That it's not a problem or isn't a deviation of status quo federal power. That's equally problematic.

It looks like it was just announced that Qualcomm just hired away Carol Lam now, so unfortunately it would appear that Rahm Emmanuel's earlier suggestion that they find a way to keep her on to follow up on the remaining related corruption cases isn't going to happen!

Does anyone know what happened to this so called "rogue staffer" of Arlens? Who is this person? I've read quite a bit of this issue but I don't see any given stance from Arlen other than "I didn't do it." Did he say it was a disgrace and this staffer will be fired? The quote from him implies that he wouldn't have authorized it but no mention? What gives?

Sen. Kyl must be intentionally misinterpreting the Constitution. Behavior not unusual for this administration, though it usually does so in less obviously disputable ways.
Congress expressly has the right to determine which - if any - inferior officers or the courts may make appointments of, eg, US Attorneys. But the important issue here is less who nominates USA's than whether any nomination can be made effectively permanent without the advice and consent of the Senate.
The administration slipped in the contested provision, which gives it the practical ability to make permanent interim appointments without Senate confirmation. A naked power grab, brilliantly executed by slipping the provision into legislation after it was considered by the conference committee. Sen. Kyl's defense of that naked power grab establishes how little he knows about the Constitution or how willing he is to ignore it. As Mr. Bush said today in another context, which is worse?
The Democrats should promptly reassert Congress's authority by deleting that new provision, thereby reinstating the old. That will force a debate on the issue and a vote in the Senate, and possibly a presidential veto.
At a minimum, the House and Senate should propmptly institute procedures that void any provisions that are inserted after the final bill is passed in conference.
Congress has enormous staff and computing power at its disposal. Surely, it can mandate such procedures. Backroom deals between senior staffers and the administration should not result in our living with legislative provisions not considered and approved by Congress.

Whether a lie, or Spectre's staffer slipped it in, quick correctives are called for. The first is to correct the "unauthorized" change, the second is to censure "Spectre", and the third is to fire the staffer (a theif personified) if he/she is still working for the senator.
I suggest that changes to any legislation be highlighted in some fashion within the new or revised legislative documents so that "busy" senators will concentrate on the changes, and not have to reread old hat boiler plate verbiage. Any changes out of committee should be highlighted to make operative to a legislator a heads up alert.
But you know, I don't believe "Spectre". Any lawyer who wants to change the FISA law retroactively so that the president can be said to NOT have broken the FISA law, has to have a twisted sense of justice. Hence my feeling of him being a liar on this issue.

I think it is strongly implied that Sen. Kyl used the procedural maneuver known as a "Senate Hold," which the glossary on the Rules Glossary page of the U.S. Senate official website (http://www.senate.gov/reference/glossary_term/hold.htm) defines as:
"hold - An informal practice by which a Senator informs his or her floor leader that he or she does not wish a particular bill or other measure to reach the floor for consideration. The Majority Leader need not follow the Senator's wishes, but is on notice that the opposing Senator may filibuster any motion to proceed to consider the measure."
This being a strongly partisan issue, and the Democrats holding so slim a majority (even counting the Dem Caucus's Lieberman-Party member), the Majority Leader doesn't need an abacus to determine there are not enough votes for cloture (to end a filibuster).
The prospect of continuing hearings, subpoenas, and sworn testimony bringing the details of this sad episode into the news cycle day after day may persuade Kyl to withdraw his hold, or (less likely) enough Republicans agreeing to vote for cloture to allow the bill to proceed to a vote.

The Justice Department is in need of a legislative overhaul. The political firings, whistleblower retalliation, and legal opinions approving forms of torture and illegal wiretaps have ripped apart any integrity that our federal justice system had left before Bush took office.
We need to split the duties of the Attorney General. We should have an Attorney General appointed much like the Chairman of the Federal Reserve Board is appointed. This position should be a non-political appointment with a 10 year tenure and they should hire and fire the US Attorneys.
Separately, we should have the traditional partisan political appointee serving as Secretary of the Justice Department. The decisions on who to prosecute and how to prosecute should not be left up solely to the servant of partisan politicians. They should not be capable of firing a prosecutor for simply prosecuting the allies of the President. What a disaster this Administration has turned out to be. Shame on anyone who voted for these clowns.

The very reason these US Attorneys are being replaced by Busch appointees is to prevent or disrupt oversight of high ranking officials which could lead to prosecution. Think about it: what other motivation can be attributed to sneaking a provision into the Patriot Act through an aide in Senator Specter's office without even the knowledge of Specter himself at the insistence of the DOJ?? Why was it so secretly done by such an underhanded method unless the DOJ KNEW this would never be approved by congress? Is it the example of the Justice Dept to do things behind the back of congress because it's the only way they can "get away with it". Some Justice. The Bush administration has found another way to mock Justice in America to protect itself and the exposure of corruption among high ranking officials in the CIA and elsewhere. This provision can and should be amended if not appealed or deleted altogether. No one voted for it, nor was it even discussed or debated. Once again our trust that the people in the Justice dept should not abuse the power given to it has been betrayed in the dark of night by self-seeking cronies. Trust Betrayed Again. I applaud the efforts of Leahy, Schumer, and Feinstein, brave Senators motivated by fairness and decency to work so diligently to uproot the hidden agenda behind this illegal provision of the Patriot Act and I fully support them.

Schumer's my Senator. I'm mostly a Dem. But no, I don't trust Schuman to follow through. Sure, I can see--this narrow bit--of the Patriot Act being changed. And, yes, there will be a bit of wrist slapping. But, no, I don't trust Schumer to get anywhere near the bottom of this. Based on his track record, Schumer's not going to risk anything on something that might rock the boat too hard. Look at how he ends:

Yes, he's right but "confirmation" isn't so much the issue here. The issue is a DOJ conspiracy (I stopped at that word, yes, but there it is) to obstruct investigations and run political operatives inside the DOH. Schumer might talk about the criminal side of this mess but I'd be surprised if he addresses it legally. It's mostly likely that he will treat it--as he has--as over-the-top politics, not out and out crime.
It's a nice gesture and all but I'll start paying attention when Schumer starts putting people under oath and insisting on a special prosecutor.

if I remember correctly ... didnt the originator (Arlen Spector) of this sneaky inclusion into the Patriot Act disclaim knowledge of it, misattribute, and slough it off on people in his office? Why would this be difficult to amend as though it actually was excess and oversight? I'll tell you why (not as though anyone wouldnt already have been able to answer such an obvious question), this is an element of the attempt to subvert american justice and in the larger view the american government in total. People should go to prison for this, starting with it's authors and enablers.

That's because it never happened. I just Googled the phrases "clinton fired us attorneys 1993" and "reno fired us attorneys 1993" and got no factual hits (references to actual news articles) on the first two pages of each search -- just references back here and some other blogs.
There is also no mention of any incident like that in the Wikipedia article on Janet Reno.

The decisions on who to prosecute and how to prosecute should not be left up solely to the servant of partisan politicians. They should not be capable of firing a prosecutor for simply prosecuting the allies of the President. What a disaster this Administration has turned out to be.
