DoJ Officials Point to Sampson, Sampson Points Back

...a pair of senior Justice officials gave accounts to lawmakers that were, at best, incomplete. At a hearing before the House Judiciary Committee, William Moschella, a top aide to Deputy Attorney General Paul McNulty, vigorously defended the firings of the U.S. attorneys as a purely managerial move that had originated within the Justice Department. He said nothing about any nudging from the White House. McNulty had earlier given similar testimony, saying the attorneys had been let go for "job performance" reasons, an assertion that infuriated the fired prosecutors. But the two Justice officials have told colleagues that when they saw the e-mail accounts showing the attorney-purge idea had originated in the White House, they were surprised and appalled. "I felt sick," Moschella told NEWSWEEK. "I basically saw my professional life flash before my eyes." Moschella and McNulty blamed [Gonzales' chief of staff Kyle] Sampson. The attorney general's chief of staff had sat in as they prepped for their testimony and "never said a word," according to a Justice Department official who wished to remain anonymous discussing a private meeting.

Sampson's lawyer, of course, released a statement late Friday that significantly dispersed the blame. According to him, "a number of other senior officials at the Department, including others who were involved in preparing the Department's testimony to Congress" knew about the White House involvement. They didn't bring it up, says Sampson, because "no one focused on it or deemed it important at the time."

But that certainly doesn't sound like McNulty and Moschella's view of things. Fortunately, all three men are scheduled to make appearances before the House and Senate judicial committees, so they'll have plenty of chances to lay blame.

A White House that will out an undercover CIA agent for purely "political" purposes wouldn't have any qualms about inventing reasons to fire USAs who refused to serve their purely "political" agendas. What's hard to believe is that anyone would believe that the Bush administration wouldn't make every effort to twist the arms of their appointees. That's been their SOP in congress since the beginning of their majority. It's the only way incompetent bullies know how to control those more capable and principled than they are. Crypto-fascism is the partisan politics of today's White House.

There has to more correspondence about the USAs than has been provided to the Senate Judiciary Committee to date.

Miers and Sampson corresponded about firing USAs in March 2005 with Samspon going as far as providing a chart to Miers, US Attorneys - Summary Appointments which rated the USAs.

Yet there is no further correspondence or memorandum until January 2006 when Sampson prepares a memorandum for the Counsel to the President re: US Attorney Appointments and sends Miers and email about replacing the USAs.

The revision to the Patriot Act about the appointment of USAs was made in December 2005.

Where is the correspondence and memoranda about how the Patriot Act revision would affect the replacement of USAs?

I suspect we can pretty much assume that any USAtty who was NOT fired HAS successfully been arm-twisted by the BushCo bullies at one point or another. Otherwise, they would have been replaced, too. It's those who resisted who are gone. And, sadly, one could claim that every case any BushCo USAtty has touched is now suspect, whether it's democrats prosecuted or republicans not prosecuted.

In his commentary this morning on "Face the Nation," veteran CBS correspondent and host Bob Schieffer, speaking of the scandal involving the dismissal of U.S. Attorneys, said, "This one stinks to high heaven."

It is clear that these people were fired for purely political reasons and politicization of the U. S. Department of Justice is a very, very serious matter.

Kyle Sampson's greatest flaw was that he created a surprisingly naive paper trail, revealing that Moschella and McNulty and Gonzales spake with forked tongues.

Sampson, in attempting to demonstrate that he had earned a place in the "In Group", dropped too many names. Wanting to show that he knew how the game was played and for whom, he revealed the falseness of the DOJ and the administration's public lies. All in good faith, of course.

How banal, that finely detailed records and a lack of complete dishonesty should trip up an ambitious bureaucrat's evil.

It will be interesting to see how much money and time was wasted on these investigations to appease the public when thie final result will be that all these clowns will be on speaking engagements the day after Bush leaves office.
I'll bet none of them will be at veterans cemeteries.

There is a simple question which the reporters can ask Tony Snow at the next gathering. "Since the US attorneys serve 'at the pleasure of the President' the legal corollary is that the US-A can be dismissed only with the explicit approval of the President, or by someone to whom the President has delegated that authority to act without notifying the President. Did the President explicitly, or implicitly by delegation, authorize the firings of the 8 US attorneys? If implicitly, who was delegated this authority?"

Isn't it nearly time for an updated scoreboard with links as only TPM Muckraker can do on all the corruption invesatigations underway or about to kick off? I'm finding it hard not to loose track of where we are on all of them, and more good ones seem to be on the way soon. Keep up the great work!

Yes, they are definitely coordinating their lies. This has probably been the busiest weekend at the White House in a long time. It'll be interesting to see what their "coordinated" line of defense will be - since Alberto has already apologized.

My hunch is that Karl Rove is giving all the soldiers their marching order this weekend - with Bush whispering to Rove from behind the curtain. They are a team.

But we will not hear the word "lie" from this bunch. There were some that "misspoke" or may have "hazy memories" of the events but no one "intentionally" misled Congress or the American people. That will be their songsheet.

If Iglesias thinks he and the others were fired because they didn't "play ball" then someone ought to look into waether any of the remaining U.S. Attorneys have played ball. Were there suspiciously convenient indictments filed in the lead up to last falls elections?

this, mind you, is before he had ANYTHING to say about domenici's fitness to be a senator (which i don't think he ever got around to) when he's clearly out performing political hit jobs in the plain sight of everyone with a singular brain cell.

Karl Rove and co-ordinating stories:

There is a thread at DailyKos and Firedoglake concerning evidence of Rove's assistant using email servers owned by the Republican National Committee. Fitzgerald apparently was aware of them in the Libby trial. It is not clear if he subpoened anything off them, but suffice it to say Rove has a habit of communicating via non-Federal lines when co-ordinating his activities with other Federal offices including the OVP. I suspect it is true of DOJ and other organs of government. You suppose Waxman would be able to subpoena this traffic for this time frame when he calls his witnesses?

Why doesn't someone investigate the political appointments thru Rove of the U.S. Attorney-hacks for the Southern and Northern districts in Ohio that were vetted thru the cesspool formerly known as the Ohio Governor's mansion in 05'. Clearly the grand objective was massive voter suppression for the 06' midterms. Hello. Is anyone out there looking at the obvious? No wonder the Democrats have finally felt some heat in their cajones. You are not sufficiently enraged enough by the suspensions of Habeas,the Genveva Convention and the frightening invasion of NSI but once the corruption gets personal then finally you speak out. Pathetic and a long time coming.

Let me press the issue of the SURVIVING US-A's, if Iowa is any indicator, there is an ongoing conspiracy against Democrats, by Republican planted US-A's, and it may have actually accelerated since this exposure of their colleagues questionable removal and replacements.

Matt McCoy, the Democratic state senator from Des Moines' south side, is being persecuted in a classic case of entrapment, by the US-A that was appointed to that district.

If it is proven that there's a provable passle of politics in this process, wouldn't these US-A's themselves be subjest to some serious scrutiny from Conggress?

One thing is for certain, it certainly opens the door for McCoy's defense attorney to demand charges be dropped.

This political hackery makes our US-A's impotent.

When they can't be trusted to keep politics out of the legal process, they surrender their legal credibility and provide a very good case for the defense to use against all of them, regardless of the guilt or innocence of the defendant.

I have a technical question. On 9/13/06, Kyle Samspon sent an email to Monica Goodling about the USAs. In it, Sampson strongly recommended that, as a matter of policy, they utilize the new statutory provisions that authorize the AG to make USA appointments.

Sampson then writes "We can continue to do selection in JSC but then have the DOJ take over entirely the vet and appointment. By not going the PAS [presidential appointment, senate confirmation] route, we can give far less deference to home-State Senators and thereby get 1)our preferred person appointed and 2)do it far faster and more efficiently, at less cost to the White House."

I looked up JSC and it appears to stand for the Justice Standards Clearinghouse for Information Sharing:

What does JSC have to do with selection of USAs? Samspon implies that by having the DOJ take over the vet and appointment of USAs, he is recommending a different process than what was normally done.

Can anyone explain what Sampson was referring to?

Am I using the term "conspiracy" too loosely here?
Or is it really quite accurate. If there is an agreement (8 to 1 prosecutions against Dems vs. Reps should be proof enough) between these Loyalists to "go after" Dems, and more thanone of them agreed to this plan, isn't that, essentially, a conspiracy?

From what I've read about "bushies" in these emails, it would appear there are about 85 co-conspirators we can be sure were involved (93-8), and at least two DOJ administrators, AND old TBlossom hissef', it all seems to be in those emails.

Here is another technical question. Between 12/1/06 and 12/2/06, Kyle Sampson and Michael Elston exchanged emails about EARS evaluations requested by a judge. The subject of the emails is "N.D. Cal".

The first email re: N.D. Cal was generated by David Margolis who was concerned about an unnamed judge who had requested a copy of an EARS evaluation and special followup review. The judge apparently threatened to go to Pelosi, Waxman and Conyers about the EARS evaluation.

Sampson and Elston agreed that the EARS evaluation issue was worth fighting about.

In the last exchange of email with N.D. Cal as the subject, Sampson tells Elson that the list was just expanded.

What is an EARS evaluation and why was the followup review special?

EARS stands for Evaluation and Review Staff (an office run out of the Executive Office for U.S. Attorneys). Each U.S. Atorney's Office is peer-reviewed every 3 years. The reviewers are all experienced line AUSAs (not political appointees) and the evaluations are not "political" in the sense that their purpose is to ensure that the offices are following DoJ procedures, doing a good job representing the U.S. government (as indicated by interviews with judges and local agency counsel, etc.), and looking at any personnel/management issues that exist in the office. Offices that have significant "issues" of any kind (for example low morale due to poor management) usually get a follow up visit from the evaluators to determine whether the evaluators' recommendations concerning those issues were implemented and whether the situation at the office has improved.

Thanks, F. AUSA. I realized after I posted that N.D. Cal probably stands for Northern District - California. Kevin Ryan was USA in that district in December 2006. He seems to have been added to the DOJ hit list in connection with an EARS evaluation.

Firing Ryan appears to be a somewhat spur of the moment decision made only five days before the purge.

Congress should subpoena ALL current U.S. Attorneys, especially those not fired, to testify under oath before Congress, as well as subpoenaing ALL previous U.S. Attorneys appointed by the political hatchetmen in the Bush administration, going as far back as January 2001.

Of course, the Republicans will cry foul, claiming the Democrats are "politicizing" the federal judiciary, even though the Democrats are only responding to the political hatchetmen in the Bush administration who've been "politicizing" the federal judiciary, right-wing hatchetmen who've been using the U.S. Attorneys on hatchet jobs against Democrats, while softpedaling investigations and indictments against Republicans.

In fact, the Democrats in Congress must scrutinize the entire federal judiciary, including all the federal judges appointed by the political hatchetmen in the Bush administration, those rubber-stamped by the previous Republican controlled Congress.

Every Bush appointee to the federal judiciary is now suspect. The federal judiciary, after what we've learned, is no longer an independent and fair adjudicator of our nation's laws.

The firings of US attorney Carol C. Lam and Daniel Bogden were connected through one case that just so happened to be the first time the Patriot Act was used in a non-terrorism related case. The investigation, and the subsequently comprehensive search for financial records ended up getting Sheldon Adelson, the 6th richest man in the world and fervent Bush supporter, involved by highlighting $190,000 of contributions he gave to the now convicted ex-County Commissioner and Lobbyist Lance Malone. It is a highly complicated case that demonstrates that Mark Corallo, who has worked as spokesman for both Karl Rove and Attorney General Gonzales, and also at the Republican National Committee was most likely the go-between to help spur these firings on behalf of Sheldon Adelson.

Clinton/Reno replaced ALL USAttys when they came into office in Jan 93, as did Reagan in Jan 81, as did Bush 41 in Jan 89, as did Bush 43 in Jan 2001. There is nothing unusual about this.

What IS unusual is replacing USAtty's DURING an administration -- especially, doing it surreptitiously using a carefully-crafted few lines inserted into the Patriot Act AFTER a discussion was held on what to do about a small groups of USAttys who were prosecuting prominent party members or who were not prosecuting opposing party members on very flimsy or manufactured evidence. In other words, these 8 were hurting BushCo friends and/or hindering getting BushCo members elected. So they got axed. And they were replaced by hand-picked Bushies WITHOUT the normal confirmation procedure in the Senate. That is politicizing the USAtty's Office and is a MAJOR faux pas.

No one ever took a poll to determine whether these American heroes were Democrats or Republicans, because it does not matter.
