Feinstein Questions Sampson on Lam Firing
Two big things came out of Sen. Dianne Feinstein's (D-CA) questioning of Kyle Sampson.
The first was a glowing letter about Lam that Feinstein presented from the Director of Field Operations for the U.S. Customs and Border Protection Agency. Lam was supposedly fired, remember, because she performed poorly on immigration prosecutions. You can read the letter here.
The second was the revelation that after the FBI bureau chief in San Diego complained to the press about Lam's firing, Samspon called FBI headquarters to complain.

Can someone tell me why this letter was produced by the Border Patrol in Feb of 2007? After it was announced that she was leaving?
Someone needs to continue to follow this paper trail - it may lead somewhere interesting....

Feinstein starts out by asking if Sampson's aware that Lam sent a notice seeking a search warrant.
Sampson replies that he doesn't recall seeing such a notice, not that he was unaware the notice had been sent.
He didn't answer the question he was asked. My guess is he was quite aware.

Oooh! A NEW reason: so that others can serve! Heard that one before for firing Cummins, but isn't that a new one for Lam?
and the whole alibi about immigration enforcement doesn’t wash too well from the policy vs politics angle, does it? After all, the Bushies aren’t really that hot on immigration enforcement…gotta keep that cheap labor comin’ in, wages down.

It's so frustrating how the majority of senators - like Feinstein - seem incapable of asking tough cross-examination questions to pin these guys down, and use all their time to make statements or read letters.
Was he AWARE of the Lam's notice?
How was Lam's Foggo activity factored into the decision to fire her?
Why are there no emails discussing Lam's investigation?
etc
Sampson's left enough wiggle room in his testimony to drive a truck through...

I believe House Republicans would include Issa amd Wilson regarding the firings. What's pissing me off is the ignoring of who is responsible for the genesis of the Patriotic Act provision that gave them unfettered ability to appoint whomever they wished regardless of the Senate. Without it they couldn't have completed their purge without complications. It is beyond belief that Moschella wrote it and Specter's Chief of Staff inserted it surreptitiously after dark without either/or/and Specter, the AG, the WH knowing about it. Two asholes make law and they aren't elected? Somebody approved it.

Regarding the date, it's not clear to me when it was produced or sent. That Feb 15 is clearly a stamp not consistent with the font of the letter and could be a record of when it was received, either by Lam's office or Feinstein's or who knows who else? It does seem odd that the date is not printed in the same font as the rest of the letter to clearly indicate when it was written.
Maybe I'm just reading too much into it.

Redwood, I agree. The only indication of when it was probably sent is the signoff paragraph, where the author wishes Lam success in her future endeavors. To me, this indicates that it was written after her "resignation" was announced.

I thought Senator Kohl in particular was terrible. He gave an opening statement of no effect, then asked Sampson questions about what his opinion was on the subjects at hand.
To wait 6 years to get oversight of the Bush administration under oath, and then not ask direct questions of fact is a complete waste.
Did he just happen to jot some questions down in the car on the way to work this morning?

The last sentence is interesting. Sampson says, "Carol Lam was a political appointee and a decision had been made in the executive branch so that others could serve."
Fair enough. But the FBI agent was saying that it was a bad decision.
The continual problem with this administration is that they are constitutionally (pun quasi-intentional) of dealing with anyone disagreeing with their decisions or of listening to that criticism and changing their minds or their actions.
"I sit in Washington. I am a 30 year old on my first real job out of law school and this FBI agent with 20 years experience investigating cases in the real world better not cross me."

This isn't uncommon in smaller offices, and it's done because the letter might not be signed for several days after it has been prepared.
The letter is written by an underling and the physical piece of paper passed up the line for the big boss to sign whenever-he-happens-to-get- to-it.
Once the letter has been signed, it's date stamped and sent out. In theory, it's supposed to make less work for the secretaries (ha!)
