Gonzales Apologizes to USAs
The apology, of course, was to the 93 sitting U.S. attorneys, not the eight who deserve it. From McClatchy:
Gonzales apologized to the prosecutors not for the firings but for their execution, including for inaccurate public statements about poor job performance, according to people familiar with the afternoon conference call.
I wonder if those "inaccurate public statements" he's referring to include statements to Congress?

Is it true that only the President can fire US Attorneys..? If it is true then Bush is the real culprit and Gonzales just the axe-man. Can Bush put the blame on Gonzales...(I am no fan of either of them) but I would like to know who actually ordered the firings

If there were "inaccurate public statements about poor job performance" does that mean the fired US Attorneys were not fire for job peformance issues? If not, what were the fired for? Probably because like a bad B movie, they just realized they were working for cannibals.
Like the woman that finds out the guy they put thru law school is leaving them for a 24 year old blonde. It has to hurt. Deep down, scornful hurt. We should all feel bad for the ones loyal to JUSTICE and not BUSH that remained. They know they are working under hostile conditions.
Take our Alaska's Nelson Cohen (Patriot Act USA Extraordinaire). He was appointed August 22, 2006 yet on Sept 13, 2006 Kyle Sampson listed his job in an email too Monica Goodling (and eventually to Harriet Meirs) as Vacancies w/o candidates. How could he?
Unless of course Mr. Cohen was promised something else...and if he did a good "Bushie job" (wink, wink) he would get other, nicer gigs.

If I was an honest, truly independant US Attorney after learning about this Bushwhacking scam I'd feel betrayed. Obviously from the emails, if your not with'em, your against them. Justice to a reckless cowboy wannabe like Bush would be dangerous to your career.

ANOTHER INACCURATE GONZALEZ STATEMENT: It appears Mr. Gonzales may have misled the Texas State Bar about his current employment status.
He says he's a judge even though he hasn't been since 2000. The benefit? He doesn't have to take continuing legal education courses, which would run us normal mortals about $200 per year

Can we go back to that 2/24/05 United States Attorney - Appointment Summary that Kyle Sampson sent to Harriet Miers?
Bud Cummins was told by the DOJ that he was being replaced for political reasons and not performance-related ones. The DOJ has admitted it as much.
Why then is there a strike through his name on a February 2005 evaluation of USAs? A strikethrough, according to Kyle Sampson, indicates "weak US Attorneys who have been ineffectual managers and prosecutors, chafed against Administrative initiatives, etc."
No one in the Bush administration, as far as I know, has even hinted that Bud Cummins was weak or an ineffectual manager and prosecutor or chafed against Administrative initiatives.
In fact, Cummins seems to have been in the know on this issue or at least thought he was in the know. He was told that his "case was completely different from the others, that there were significant performance issues involved in the other decisions, and if I saw, I'd agree that they'd have to go."
The email with the USA Summary was released in the beginning of the week when AG Gonzales apparently still thought the whole thing would blow over as evidenced by his moving Sampson to the DOJ Environment Division.
Did someone at the DOJ think they could head off questions about Carol Lam if the DOJ demonstrated that it had evaluated Lam poorly long before the Cunningham case came up?
What I am getting at is whether someone at the DOJ altered the United States Attorneys - Summary Appointments chart. Did someone put a strike through Bud Cummins' name to make the document appear credible without thinking about the questions that could arise?
I'd like to hear Kyle Sampson's explanation about why Bud Cummins was rated poorly in February 2005.
I'd also like to know why Bud Cummins isn't outraged about either 1)being lied to about his performance evaluation or 2)DOJ documents being altered.

The problem now is as shown on talking points memo from Pittsburg, every state level democratic chair from every local where the DOJ is persuing action against corrupt officials goes on TV and screams political bias. The DOJ is soon to find its self beholden to a process that will require equal numbers of prosecutions/investigations for both Rebulicans and Democrats. So in trying to politicize the DOJ the Bush cabal has distroyed it.

On second thought, if I were Bud Cummins, I would not be outraged about the DOJ lying about my performance evaluation if that is, indeed, the case. I'd much rather let everyone think I was stepping down for political reasons than being given the boot for doing a really lousy job.
Strange that Bud Cummins would leap to the defense of all seven USAs who got fired when there is a record submitted to Congress that indicates the DOJ thought Cummins, Carol Lam and Margaret Chiara were all terrible USAs in February 2005.
I would think Bud Cummins would be chagrined to have his cover blown. Now everyone in the world knows that Cummins was considered by the DOJ to be a weak US Attorney who was an ineffectual manager and prosecutor and someone who chafed against Administrative initiatives.
That is, of course, if the 2/24/05 US Attorneys - Summary Appointments chart submitted to Congress this week is genuine.

I'm reading through all of the USA documents at the NPR website and on 12/4/06, Kyle Sampson sent an email to Jane Cherry in which he listed the USA - Eastern District of NY as being nominated for another position. The USA - E.D. NY is Roslynn Mauskopf, a Pataki hack.
Anyone know anything about that waste of space, Mauskopf, being nominated for another position?

On 3/10/06, TPM highlighted remarks made by Pat Rogers in a New York Times story about David Inglesias.
From the NYT:
“I fall into the category of those who were ultimately very disappointed in David,” said Pat Rogers, a Republican lawyer in Albuquerque who has represented Mr. Iglesias, Ms. Wilson and the State Republican Party.“I fall into the category of those who were ultimately very disappointed in David,” said Pat Rogers, a Republican lawyer in Albuquerque who has represented Mr. Iglesias, Ms. Wilson and the State Republican Party."
Another person interviewed for the story was Mickey D. Barnett. Barnett, "another top Republican lawyer in the state, who once served as an aide to Mr. Domenici in Congress and represented the Bush campaign in New Mexico in the 2000 and 2004 elections, said he had also complained."
What the NYT did not say was that Rogers and Barnett met with Monica Goodling, DOJ spokesperson on June 21, 2006 in Washington DC to pressure the DOJ about Iglesias.
Nor did the NYT mention that Senator Domenici named Pat Rogers as one of his four nominees to replace Iglesias.
Pat Rogers is also a director of the American Center For Voting Rights Legislative Fund, a GOP operation set up to suppress voter registration.
Let's see - Pat Rogers, Republican operative, gets David Iglesias fired so he can have his job. Rogers is eminently suited to be a US Attorney in the Bush administration because he is an expert in voter suppression.
And that's the way it works in BushWorld.

To underscore my point that the aforementioned Pat Rogers is a scumbag, read this excerpt from the NYT story about David Iglesias:
"Mr. Rogers said he spoke with Mr. Iglesias at a private lunch last October in Albuquerque to discuss the perception that he was not pursuing indictments in the courthouse corruption inquiry expeditiously.
“I asked him, ‘Do you understand that everyone in this community is talking about why there hasn’t been any follow-up?’ and he said: ‘Boy, you’re right about that. Someone even told my wife about sealed indictments,’ ” Mr. Rogers said. “I came away from that meeting feeling stunned.”
Pat Rogers does not say one word about his meeting in Washington DC on June 21, 2006 with Monica Goodling at the Department of Justice.
Did Pat Rogers tell David Iglesias over lunch in October that he and Mickey Barnett had already put the screws to Iglesias five months earlier?
J. Scott Jennings to Monica Goodling in an email on 6/20/06:
"I have a person from New Mexico coming to town this week - he is the President's nominee for the US Postal Board of Governors. He was heavily involved in the president's campaign legal team.
His name is Mickey Barnett and he has requested a meeting with someone at DOJ to discuss the USATTY situation there.
Would someone in EOUSA or you or Kyle be available?"
Goodling replies that she is happy to do it if it is sensitive and Jennings replies that it is sensitive.
Goodling's schedule shows a meeting with Barnett and Pat Rogers on 6/21/06 at 5 p.m.
Pat Rogers wants to be US Attorney for New Mexico so he had David Iglesias shitcanned.

The potential re-opening of thousands cases is a nightmare. US Attorney staffs are barely adequate now. This could deluge their offices with work they can't handle. It will piss off judges, juries, and investigators. Every scrupulous and unscrupulous defense attorney gets another bite at the apple. Every case is subject to being tainted as political.
This could disrupt these offices for well over a year, and make the transition to new USA's in 2009 more difficult, further disrupting the administration of justice.
Not incidentally, that will open the traditional changing of the USA guard between administrations of different parties to political attack for being disruptive. Even though the current administration caused that added disruption.
That, by the way, is Roviana 101: accuse your opponent of your own worst traits, and of having caused the mess you've just left them.
If I were a president's chief political adviser, worried about leaving behind eight years of potential graft and corruption, what would I do? Allow a Democratic President and Congress to inherit well functioning USA offices, which could quickly investigate Republicans while the dung trails were warm and aromatic? Or would I throw sand in the gear works while trying to achieve a few other "nice to haves"?

Keep in mind. Mr. Rove is not an advocate for big government or small. He is an advocate of making government function for his exclusive partisan purposes, or not at all.
He and Mr. Cheney have disrupted the functioning of Defense, State, DHS, EPA, FCC, SEC, ad nauseum. Lobbyists have been nominated to run these agencies or key departments, oftening "running" the place from the number two or three position because they have direct backing from the OVP that the nominal head does not.
Non-political hires, below the level of political appointees, are strenuously checked for the same Faithful attitudes about loyalty, Roe v. Wade, etc., as political appointeees. That makes them as suspect as the lobbyists, but difficult to remove because they have civil service protection. The next administration won't be able to just clean house. They will have to rebuild whole sections of it, putting them off their game and letting Republicans avoid liability for some of their worst excesses.
For Mr. Rove, politics is not war by other means. It's just war.

Is there any momentum for forcing (shaming) the untalented administration-adulating eight to go through senate hearings.
At least some administration officials have stated that there was no intention in the Patriot Act provision to bypass the advice and consent of the senate.
