Senators to Gonzales: Really? Tell Us More

Yesterday I reported that the Justice Department had written Congress that, against the advice of Alberto Gonzales, the president had shut down an internal department investigation into the administration's wireless wiretapping program. Bush's was an unprecedented and arbitrary (and still unexplained) move.

Democrats in the Senate want to know more. So yesterday Sens. Russ Feinfold (D-WI), Ted Kennedy (D-MA), Chuck Schumer (D-NY), and Dick Durbin (D-IL) sent a letter following up.

In particular, the senators want to know the stated rationale behind Bush's decision. They also want to see documentation relevant to the stifled investigation. Why?

As they write in the letter: "Given the serious questions that have been raised about the Justice Department's credibility, we continue to believe it is important to review documents supporting the assertions in [the Justice Department's] letter."

In other words: we don't believe anything you say now, so just save your breath and hand over documentation.

Nice job on the Minnesota connection to this in TPM today. The work done by mncampaignreport.com (march 8 post especially) shows that the USA (Heffelfinger) in MN probably was given the call to quit. His resignation really came as a surprise. He has denied it, but the records released from Sampson show that Heffelfinger probably was one who left quietly. Paulose (the new 33 year old USA in MN) is someone nobody here in the MN legal community knew anything about--seeing that she was McNulty's right hand person now makes perfect sense. And, tying this in w/Rove's desire to get Minnesota in '08 even makes more sense. The ones we know were fired are obvious...what other damage the WH/AG did w/other USA's is the next story. Keep up the excellent work.

Everyone's all ranting and raving about this latest outrage, but no one seems to have noticed that they just waived executive privilege by sentences two, three and four of the quoted statement:

"The Attomey General was not told that he was a subject or target of the OPR investigation, nor did he believe himself to be. The Attorney General did not ask the President to shut down or otherwise impede the OPR investigation. The Attorney General recommended to the President that OPR be granted security clearances to the Terrorist Sur\~eillance Program. The President made the decision not to grant the requested security clearances. "

Sentence one is a bald-faced attempt by Gonzo to (try to) avoid obstruction of justice charges against Gonzo - "I didn't know the investigation was coming my way, so I couldn't be the guy obstructing it". Not likely to succeed - this was just too controversial and too close to Gonzo (it ran through his office, dammit) for him to get away with that crap.

Sentence two describes a communication between presidential advisor (or consigliere/attorney - take your pick) surely made in and with the expectation of confidence (what do we hear every time about the NSA program - that it's confidential)(and, what do we hear about the executive branch - that everything going on there is confidential) and about a matter of state. Now, a spokesmodel is coming out and, as an official pronouncement, saying what the communication was about, the general substance of it, and who said (and didn't say) what to whom. Textbook waiver of executive (or any other) privilege.

Sentence three is a combination of the two purposes - I told the President to give them the clearances and let the investigation go forward (i.e., I didn't impede it, regardless of who was the subject/target) and this is the "confidential" stuff we talked about (waiver of privilege).

Sentence four is Gonzo laying the blame squarely on the President. HE obstructed the investigation. And, it's a further revelation and waiver of the allegedly privileged information.

No. This is not the WH throwing Gonzo under the bus. This is Gonzo lashing himself to the President in the hope the so-called "Unitary Executive" theory will stand up in court. If it succeeds, it will be because The President Can Do No Wrong. If it fails, it will bring down Bush.

I think this letter is less about getting any documents -- although that would be a welcome bonus -- than about forcing Gonzales to resign. They want him out, and this letter basically says "we're going to make you (the Administration) miserable unless you fire him."

From the legal struggle on the Cheney 'Energy Conferenc' in 02/21, through the constant probing of constitutional limits by Bushco RE the charade used to acquire AUMF, through the 'use of torture' assault on Geneva Treaty restrictions, the destruction of individual privacy rights, the politicization of the entire Justice Dep't...it has been The warped minds of Bush legal beagles (including the Frito Bandito) who have aided and abetted the destruction of American democratic rights over the past six years.

I would certainly hope that the aim of the Democratic majority is not limited to the removal of one whose ideas of governance are more closely aligned with those of some Latin American 'banana republic' than with traditional American values devolved from the Constitution of 1789 and ensuing amendments.

The biggest danger right now is the very real possibility that the USSC, with the addition of Roberts and Alito, has become ideologically incapable of aiding attempts to undo the damage that the Bush cabal and cohorts have inflicted on us.

So Gonzales DIDN'T have Bush stop the investigation? If Bush stopped the investigation AGAINST the advice of Gonzales, then that means Gonzales wanted it to continue even though he knew it would lead back to him. If that's the case, why does TPM continue to write that Gonzales stopped the investigation?

The second method prescribed is for a Constitutional Convention to be called by two-thirds of the legislatures of the States, and for that Convention to propose one or more amendments. These amendments are then sent to the states to be approved by three-fourths of the legislatures or conventions. This route has never been taken, and there is discussion in political science circles about just how such a convention would be convened, and what kind of changes it would bring about.

So what stops 2/3rds of states from holding a convention & drafting an amendment explicitly removing the current regime from power, sending it back to the states for 3/4ths to ratify?

We have the power to stop this, if we dare.

Its interesting to see how this is turning out.
There's already blood in the water on Gonzalez - his credibility is shot in the public eye - even among Republicans- and he is rapidly becoming a thing of the past. That makes him an easy target for exhaustive congressional investigation. Sure they could investigate any of the Bush Administration and kick up dirt, but if they started grilling Rice on live TV there are still people out there that would be sympathetic to her.

And he just happens to be in the intersection of so many different scandals - the US Attorneys, Torture, Illegal Spying, etc.

I would be willing to bet that, if they shine a light on him long enough, things are going to come out that will make what we know now pale in comparison.

Perhaps those NSA wiretaps are the most egregious of all their crimes. We have seen over and over and over again that if this administration can, it very well will. Is it at all difficult to conceive that the DOJ, as part of their NSA gone-amuck scheme, has illegally listened in to conversations of the Bushie political opponents - John Conyers, Henry Waxman, Nancy Pelosi, Harry Reid, Josh Marshall, Paul Krieg, all TPM contributors, …. Based on everything we know, doesn’t this seem more than possible? Yet another reason for the FBI to never have filed the appropriate letters to the courts. Is there anyway to find out all the American citizens that the NSA has illegally listened in on?

Well, Dave, for two reasons: Even IF you could convince 2/3rds of the states to endorse this resolution (given all the Repub machinations in each statehouse), it would take until the year 2525 or so to be enacted. Remember, the Equal Rights Amendment circulated around the states for over 10 years before dying with its tounge stuck out.

I am very sorry to say, until Jan 2009, Bush is it. That's all. Whatever damage he wants to inflict on our country is his privilege. He can start a war with Iran, nail the Constitution to an outhouse door, jail US citizens w/o warrant. He's our national dingleberry, our Emperor Chimpoleon.

Remember, all the pre-Election hype of 'Speaker' Pelosi...I was led to expect an avenging angel type, complete with shield of Justice and sword Vengeance and clad in stately flowing robes descending on the White House portico and driving a chastised Bush and his coterie of demons into outer darkness...

And, then, to allay any concerns the cabal of crooks that is the GOP may have had, she announces that 'impeachment is off the table'.

IS ANYONE REALLY SURPRISED?

The authorization of warrantless wiretapping was illegal-- and grounds for Bush to be impeached.

Under the corrupt GOP-led Congress-- they didn't care how many laws the neo-con Bushies broke-- and, didn't care whether or Bush, Cheney, Rice, Rove & Gonzales ordered illegal & immoral warfare-- authorized illegal & immoral torture-- and, trampled & treaded upon the U.S. Constitution & Bill of Rights.

Now, under the current Democratic-led Congress-- Rove has advised Bush to be a little more careful about which laws he breaks. 'Against' Gonzales' advice.

The Senators are presenting Gonzo an opportunity to defend himself against the President's push out the door, or a chance to rat the President out. And the President gets to watch and see how loyal Gonzo really is when he's feeling surrounded. It is an interesting squeeze-play.

I am told senior managers at Lowe's Companies used to be faced with periodic employee cut-backs. They would eliminate the obvious candidates and narrow the list to two. Then, they would invite the two in separately with the offer: you will be given a nominal promotion (which really meant a change in title allowing you to handle the work of two for the pay of one), and can keep your job if your fire your colleague. It is a similar squeeze for Gonzo. Rat out the Pres? Rat out Sampson or some underling? Keep your job, inherit more heat, keep the boss free and clear. Does Gonzo have the stones?

To date, all canaries have been bought with lucrative positions in the private sector or powerful positions within key agencies.

Is it a matter of which is the operative's primary vice...greed or power as to which choice works?

Yang & Cummins & Battle were paid well with lucrative private sector positions.. McCallum who did the tobacco case dirty work is now US Ambassador to Australia, the former UTAH USA has a nice judgeship now, and Griffin is USA in Ark.

Sampson got the shaft, he has been ousted as the fall guy ..identified through emails as the architect and conductor of the purge..he pushed for using the PAT ACT thinking he would get a USA position and now he is out in the cold.

Can they buy him off before he testifies or will he be the first one silenced? Stay tuned.

Regarding impeachment, I don't think that the Democrats have enough support in the electorate. A poll I read in the last couple of days said that somewhere around 40% believe that there was wrongdoing at DoJ, around 30% don't and 30% are undecided. This case isn't just a matter of law, it's also a matter of politics. Since a large part of the 30% who don't believe now never will (being loyal Bushies), the politics is about persuading enough of the undecided. That will require further revelations, revelations that undermine the administration's story line, and PR.
Impeachment, and house cleaning, will become viable possibilities when the percentage of the electorate that believes that there was malfeasance at the DoJ coordinated from the White House passes 50% and keeps rising. At that point, it will become impossible to credibly call the investigation "a partisan witch hunt," and a widening part of the media and the Republican Congress (at least from a sense of self-preservation) will become the White House's adversaries.
Short of that, the House's action is likely to become nothing more than an apparent replay of the Clinton impeachment: a seemingly partisan show that, with the Senate acting as jury, will end with a slap on the wrist.

I got chipped with an NSA RFID chip, based on a bogus FBI FISA application implicating Sioux Falls FBI SSA Steven Pluta (a counterintel expert sent to Iraq in August to prevent me from subpoenaing him in a Motion Hearing in Fed Court).

This story includes:

--FBI lying to FISA court claiming I was an "agent of a foreign power" (a requirement of the FISA order to conduct a "subliminal counter intel debriefing using the chip in my head).

--Sioux Falls FBI tampered with my course of medical care when they flipped DR. CHAD CARDA and DR. JENNIFER BURGER into hiding my x ray results that showed the chip. See, SD Med Bd complaint naming Carda and Burger.

--Use of Directed Energy Weapons to murder Rich Gordon, fry Dr. Mark Gordon and me in our homes.

--FBI abuse of power when they destroyed Dr. Mark Gordon's medical carreer in Yankton, SD, Sioux Falls, SD, and Austin, TX. This was done to flip Gordon against me. Later, Gordon was monitored with a pin hole spy camera in his home. See, Thomas S. Bean's 47 page US DOJ OIG complaint naming the Gordon's.

--Today, Mueller is to be grilled by the US Senate Jud Comm.....so far...the dems have offered up nothing but softball questions to big, bad, Bob Mueller. I got Mueller called back to US SJC on Cspan 2....and watched Bob read and check off questions from the script he was reading from?

--Mueller's got problems with the Canadian warrant for Miami FBI agent Terry Nelson's "Big Sky Cali Cocaine Distribution" in Montana....where FBI Div 5 hitman Chuckie Peters whacked out alot of witnesses. The bank records show drug money laundering into Bush/Racicot/GOP campaigns.

I gave this to the dems along time ago when I contacted Grassley three weeks before FBI rolled over on the NSA TSP (remember the NY TIMES requires three sources to corroborate big stories...Risen had Ken Tice...my memo to Grassley and FBI who always tips Risen and NY Times like when they painted Rich Gordon bad with the bogus SD AG Indian Voter Fraud Investigation).
