CNN: Goodling to Resign from Justice Department

Monica Goodling's reign as the first ever sitting Justice Department official to plead the Fifth is over, CNN just reported. She'll resign tomorrow.

The top aide to Attorney General Alberto Gonzales abruptly quit on Friday, almost two weeks after telling Congress she would not testify about her role in the firings of federal prosecutors.

"I am hereby submitting my resignation to the office of attorney general," Monica M. Goodling said in a three-sentence letter. There was no immediate reason given, but her refusal to face Congress had intensified a controversy that threatens Gonzales' job...

Calling her five-year stint at Justice an honor, Goodling told Gonzales in her letter, "May God bless your richly as you continue your service to America."

Someone needs to keep track of where she goes after she "Resigns". Remember what happened to Sampson after he resigned - he stuck around in the DOJ. Also remember that Rummy continued to work, and quite possibly continues to work even today, for the Admin after handing in his letter.

Who didn't see this coming? Goodling HAD to resign, she was out of options.

As I posted earlier this week, she's been on paid leave the past 2 weeks. This means she's been burning vacation time at a prodigious rate. I don't think it's any coincidence that her official resignation date is Saturday. I suspect that marks the last day of paid-leave she had remaining.

She simply could not go back to work at the DOJ. Mainly because she lost her national security clearance when she plead the 5th. Sure, the DOJ may have allowed her to use unpaid leave, but she isn't wealthy. She has a mortgage and mounting legal bills. Now that Goodling is no longer a government employee, her friends and associates can legally give her funds.

Her recent behavior suggests to me that Monica is doing what's best for Monica. Pleading the 5th wasn't good for the administration, it was good for Monica. Quitting so that she can accept legal-fund donations isn't necessarily good for the administration, but it is good for Monica.

I think we should at least be open to the possibility that she's put the kool-aid aside (for the moment) and has put her own well-being above all else. If this means she's willing to be a friendly witness in exchange for immunity, this could be a very good thing.

The carrot for cooperation the administration can create for her is to have a Libby-like trust fund created to pay the cost of Ken Mehlman's Akin Gump defending her. That's got to be colossal. Might buy continued loyalty and a lot of silence, or minimal cooperation if she's given immunity.

Obsessed with what? She hasn't invoked executive privilege. She's invoked the Fifth Amendment, which is not conditioned on her continued employment by the government. And Justice isn't keeping her from testifying. They want her to testify, just like Sampson. Your combined theory of (1) a Justice-led effort to keep her from testifying on grounds of executive privilege and (2) a retaliatory firing for her refusal to testify makes no sense.

I believe the true reason for her resignation is that there is now an internal DoJ investigation into the attroney purge, and she is compelled by terms of her employment to provide information in that investigation, if she wants to stay in her job -- hence, she resigns.

What is it with this Children's Crusade over at the DOJ, anyway? Sampson, Goodling, Paulose - they're all in positions of incredible responsibility and power, and they're all like 30-something in terms of physical age, and maybe closer to 20-something in terms of competence, judgment, and maturity. Nope, as of today she's still on the hook for her legal fees.

Anyone starting or donating to such a legal fund *before* Goodling resigned would be breaking the law.

Which is probably one of the main reasons she resigned. As of Easter Sunday, her friends can donate away.

The White House only wants her to testify if she is willing to lie. Since she is not willing to lie, and perhaps go to jail like Libby, the WH would rather she do the next best thing and take the fifth.

Also, I imagine that the lies are so much bigger for her since she is the WH liaison in the DOJ. She talked to everyone involved about everything. She was the go-between. Rove and Gonzales can say they never talked to each other about this. I bet that Goodling talked to both.

These are jobs for true believers, children of contributors, people who know people -- all of whom seem to be uniformly incompetent -- or they can assume the appearance of incompetence when the TV cameras turn on.

This is an important shift from a biblical point of view in that Monica Goodling is so tuned in with God. God must be dumping the administration and telling Monica to take the 5th. Does anyone know what God is telling GWB on this one? I'm catching a whiff of armageddon in the air. A good chance exists that the White House lawn soon resembles Jim Jones' Guyana as all the Kool-aide drinkers drop.

Not to stickle you right back, but "hereby" does add something to the sentence. It clarifies that this letter serves as her notice of resignation. If she said "I am submitting my resignation," the implication would be that she is submitting her resignation by some separate communication.

A better edit would be to change the tense from the verbose present progressive ("I am hereby submitting") to the simple present ("I hereby submit").

Assuming CNN is correct, she either intended to say, "I do hereby submit..." or "I am hereby submitting..." we'll never know. The observation that these people are to incompetent to resign properly is right on point.

I don't think her resignation will have any impact on any of the legal fundamentals. Not on her 5th amendment claim, her likelihood of receiving immunity, or even on any executive privilege claims. (Since she never advised the president, I don't think she ever had *any* chance of an executive privilege claim.)

I think the reasons for her resignations are abundantly clear. She'd use up all her vacation time, she couldn't go back to work, she couldn't afford to stay on unpaid leave, and now that she's leaving, others can assist with her legal defense.

Yours and other's comments suggest Goodlings actions are being well coordinated with those of the Administration.. I think that's a rather poor assumption. Think about it, this administration has been " the gang who couldn't shoot straight" throughout this entire mess.

I think we have to seriously consider that Goodling is now a lone operator who's sole motivation is staying out of jail. The White House and DOJ probably haven't talked to her in weeks. The minute she plead the 5th, she became politically radioactive.

Personally, I now think she's scared, on the run, and probably willing to make a deal. The Congressional lawyers need to have a private talk with Goodling's lawyers to find out what she has to trade.

NPR News tonight: Goodling has said through her lawyers that she will invoke her 5th Amendment right not to answer questions about the dismissal.

I cannot STAND that the media gets this one wrong so damn often. (Whether through idiocy or malice, I don't know.) How difficult is it to type "Fifth Amendment" into a search engine and read?

No person...shall be compelled in any criminal case to be a witness against himself....

The Fifth Amendment confers protection against self-incrimination, not a blanket right to avoid any questioning. What's next out of these extremists' mouths? Congress doesn't even have the right to have hearings?

Monica Goodling is resigning from the DOJ to pursue a lifelong dream of her's: missionary work. (Oh, wait, that's how she viewed her work at the DOJ).

Anyway, she's resigning to continue her missionary work, but this time she's shooting for a missionary position overseas, probably in a country far, far away and preferably without an extradition treaty with the U.S., effective immediately. She'll remain at this missionary post overseas until God gives her instructions on her next move, or until the heat is off.

Of course, two seemingly unrelated events this week, the recess appointment of Sam Fox to be the new lame duck ambassador to Belgium and the resignation of Monica "Goody Two Shoes" Goodling from the DOJ, could be connected.

In other words, Monica may be planning on assuming a missionary position under the new ambassador to Belgium, Sam Fox. (heehee)

The administration may be floundering, but it was coordinated enough to get Monica one of the top guns in white collar criminal defense work, who happens to be a partner at Ken Mehlman's firm, Akin Gump. It's not likely Monica sorted that out herself, or that she ever expected to pay for them herself. Kyle Sampson didn't get that much from them, and he was supposedly considered a Turd Blossom in training.

I imagine the admin. will continue to stay away and coordinate through proxies. My guess is they won't be surprised by her legal arguments or what she says. Ms. Goodling should not sleep well imagining they are protecting her; it's only what she knows.

Monica (and others) must be impeached. If not now then reasonably soon; when enough evidence is available.

I understand that if impeached an individual cannot be pardoned. If impeached they cannot serve in government again. I presume that if impeached they cannot "practice" law in any State or hold a security clearance.

Previous posts on other threads indicate that there is precedence for impeachment even after a resignation.

Future generations of Americans must not learn a grave lesson from this sorry, sorry tail that one can "get away with" subverting the constitution by simply walking away in resignation and eventual pardon.

For years I’ve been disgusted with seeing Oli North and the like enjoy the prestige of TV hosting or “service” in current government positions.

This cannot be a witch-hunt (And I do not believe it is), but America will be forever weakened if the Constitution, the Rule of Law and true consequences of freely elected representatives do not prevail.

Anyone here remember the circumstances of the sinking of the Titanic? You know, the ship so massive, so much a monument of man's indominability, that supposedly "God himself couldn't sink her"? And of how everyone initially breathed a sigh of relief when they thought they'd narrowly missed that iceburg, going much to fast for those ice-infested waters as they were? And then it was, "oh, it's a small leak, nothing we can't contain."

In the end, the sinking was such a fustercluck that the huge boat broke apart before actually going down.

This time, that passengers that go down with the ship "Democrats themselves couldn't sink" won't be such innocent souls. This time, they'll deserve it -- every last one of them.

Can anybody tell me what happens after the Senate concludes their "investigations" of this Purgegate mess? Is it the Senate that is investigating this one or is it Waxman and the House? There are so many investigations I can't keep them straight. I did enjoy the GSA Q and A on C-Span a couple of weeks ago and watching the "evil Radar" testifying, got a little tired of hearing "I don't remember.", though. Can they send anybody to prison? What exactly are they looking for? Liars? It seems like that is obvious (liars) to anybody who has been following this. How far up can Leahy/Schumer/Waxman go with this. Could this possibly lead to the OVP or even the Shrub? What happens if Rove loses his Teflon covering and something sticks to him? Can any of these players ever hope to see any real jail time, I mean seriously? Thanks to anybody who can give me some real hope in seeing justice served in all of this mess.

Clovis, I do not think we'll ever see real *judicial* justice in any of this: no or little jail time for the big fish, no fines, few impeachments, no property seizures, etc. Nothing like that. Maybe even lots of pardons in January 2009. Nothing is going to stick to Rove, I'm sorry to say. That's not how this game is played.

I think what we *can* expect, if the Democrats can stay united and keep the country united and governed, is *political* justice. The Repubs may come out of this wearing a type of hairshirt, a deep, well-earned perception among the electorate that Repubs CANNOT GOVERN FOR THE GOOD OF THE NATION, that we cannot afford Repub governance in the way they currently package it.

I once heard a Yellow Dog Democrat say once, "I can vote Republican, but I'd have to cut a joint off one of my fingers afterwards." Somehow, ordinary Joe 6-pack Americans are going to wake up and say, "I'm not a Republican, these guys don't represent me." God speed the day...

Everytime someone bitches to me about health care costs, I ask who they voted for last election; about half the time, they voted Republican. I just shrug and say, "If you are a Republican, you can afford your own health care plan, you have no right to complain."

Keep in mind, as you talk with friends: Repubs can afford their own clean water, they don't have to take it out of the common well... Everyone else can drink water laced with lead and PVCs. Repubs don't support Social Security because they've earned enough money washing dishes for a lifetime that they can afford to fund their own retirement. Repubs will send your son to die for oil, but won't support even moderate CAFE standards. On down the line: you vote Repub, you get to live the Repub dream. Justice is political, your vote is your warrant.

I don't think that was her motivation.

The posts above explain it fully. Basically, it appears she resigned today because it was her final day of paid leave, she couldn't go back to work, and as a government employee, couldn't afford to pay her very expensive lawyers.

NYT article today re: Paulose implies that older lawyers in the Mpls office had a hard time dealing with a young assertive, aggressive woman. Hmmm....Erica Monzangue (the head of the civil division and one of the 3 lawyers who resigned her position because of Paulose's behavior) is a young African American woman--guess the NYT just goes with the sound bite from gwb43 on that one. More research needs to be done...

The Judiciary Committee did not vote on her nomination. They did not send her nomination to the full Senate for a confirmation vote.
