Now this is encased in irony: if he loses does he then get to sue for a recount for voter fraud or election fraud? And which hat (USA or potential congress critter) would he be wearing during the proceedings? ?

Marino has something in common with another USA who escaped firing, Miller from the Northern District of Florida...
Both are from states where there were substantial allegations of fraud in the collection of signatures to get Ralph Nader on the ballot in 2004 -- and in both states (and a number of others) the company involved in the fraud was JSM, Inc, a company with very tight connections to the GOP.
JSM was also involved in 2004 in the filing of fraudulent voter registration forms in Florida -- including forms where voters had their county of registration switched without their knowing it.
Remember, we're talking about FEDERAL elections here -- and fraud in putting someone on the ballot for president is a federal crime. Yet the DoJ has never undertaken any prosecutions of JSM or its employees. (Contrast that to the harrassment of ACORN).

In addition, Marino has consistently made hiring and promotion decisions based on partisan political considerations, politicizing the office like his bosses in Washington have politicized DoJ.
