Justice Department Investigators Probe Hiring Practices

Do you believe in God? Are you gay? Have you cheated on your spouse? What's your position on abortion? Should gays be allowed to marry? Have you contributed to Republican candidates? What kind of conservative are you?

Welcome to Bush's Department of Justice. Those are just some of the questions that investigators think may have been asked during interviews for both career and political positions at the Department over the past three years.

They come from a questionnaire (pdf) sent out from the Department's inspector general and Office of Professional Responsibility, the two offices conducting the joint investigation of politicization at the DoJ. The questionnaire (as reported yesterday by Bloomberg and The Washington Post) recently went out to an untold number of people who'd applied for spots at the DoJ. Investigators are trying to get a hold on how widely politicized the hiring process was at the Department.

Former Department White House liaison Monica Goodling admitted to "crossing the line" with regard to career employee hiring decisions when she testified before Congress. But she was pretty hazy about the details. (Did she ask about political contributions? She couldn't "rule that out.")

According to the questionnaire, investigators are interested in whether applicants were interviewed by Goodling. But she's not the only one. They also seem particularly interested in U.S. attorney purgemeister Kyle Sampson. Also named are Jan Williams, Goodling's predecessor and Angela Williamson, who worked with Goodling. As both the Post and Bloomberg note, investigators are looking back as far as January 1, 2004 -- long before Alberto Gonzales' tenure at the Department started.

The investigators announced back in May that they would be digging into the politicization of hiring practices not only by Goodling, but all over the Department -- including the DoJ Honors Program (which hires lawyers out of law school), the summer intern program, and the Civil Rights Division, where loyal Bushie Bradley Schlozman was on the lookout for "good Americans." They have their hands full and clearly have a ways to go before wrapping up.

DOJ is still hopelessly corrupt and a worthless laughing stock of an institution. A shell of what it once was. Unless and until DOJ purges itself of all the Regent U Law jesus freaks that were brought on board at during the last 7 years, nothing will change. These folks would have never made it into DOJ if competence mattered and, without the corruption's helping hand, they would be splitting time being the assistant youth director at the local baptist church somewhere in Kentucky/West Virginia and serving as the local librarian, all while being crushed by the debt associated with loans to pay for the low level law school education they received at good 'ol Regents U.

I would list the reasons why the Democrats should impeach and prosecute this administration, but I am not sure there is enough bandwith on the entire internet.

According to the WP: "Recipients(of the questionaire) are also asked to say whether White House aides participated in the interviews and to confirm if they were asked "what kind of conservative you were (law and order; social; fiscal)."

Hence the departure of Rove and his staff. And hence the departure of just about everyone in the DOJ who might have anything to do with hiring, including Gonzo. They all had to step down to spend more time with their lawyers.

Let's all hope that principled career DoJ staff are gaining the upper hand and acting to restore the tarnished credibility of the DoJ. My guess is that there are a large number of pretty disgusted staff members that would eagerly pursue righting this listing ship....

I couldn't agree more. I have a very hard time taking anyone seriously who uses those phrases. Just make your point using actual words and it will carry so much more weight.

Of course it's not just here, or just in politics. Anywhere there's an argument on the internet people are doing it. And everywhere people are doing it it makes me cringe.

Okay, so the IG gets answers to these questions, with details, etc. - So what? A Democratically controlled congress got answers and nothing happened; why would anything happen if a Bush appointee gets answers?

Seems to me, the only reason anyone wants the information is to establish precedents for future administrations. There have been investigations and admission of wrongdoing by people in and out of government, associated with everything from the attacks on 9/11, to the Iraq war (overcharging for services, misplacing billions of dollars, bribes, and so on), to misappropriated money intended for Katrina victims
to rigged voting machines, and the list is interminable. But nothing ever happens to correct the situation, no one is punished, and NOTHING CHANGES. THERE'S NO OUTRAGE. Whatever crimes georgejr and his henchmen and cronies commit continue to be tolerated, even aided and abetted at times, by a congress willing to pass laws making their their crimes legal. It boggles the mind.

She is not in jail, nor will she go to jail, because the Judiciary Committee was so desperate for actual information after all the obfuscating, hedging and outright lying they had heard from all the previous witnesses that they granted her immunity if she would just talk to them. She pled the 5th before she even entered the hearing room.

As to what law(s) may have been broken if these practices were, indeed, followed, § 2302(b) of title 5 of the United States Code (U.S.C.) specifically prohibits an employer to:
" (1) discriminate against an employee or applicant based on race, color, religion, sex, national origin, age, handicapping condition, marital status, or political affiliation;" inter alia, for starters.

As for our courageous, dedicated, underpaid and unappreciated librarians, not a single one of them would even consider Monica for a job emptying trash cans.

As far as specific crimes go, this was civil service, not just any employer. So even by asking she has broken the law:

"No person employed in the executive branch of the Federal Government who has authority to take or recommend any personnel action with respect to any person who is an employee in the competitive service or any eligible or applicant for a position in the competitive service shall
make any inquiry concerning the race, political affiliation or religious beliefs of any such employee, eligible, or applicant. All disclosures concerning such matters shall be ignored, except as to such membership in political parties or organizations as constitutes by law a disqualification for Government employment."

I think we should be discussing how to get rid of Pelosi. Of all the Democrats enpowered by the '06 elections, she is the one given the power and mandate to stop the madness.

She has done nothing. She could stop appropriations from making it to the floor. She could start impeachment procedings.

It seems clear to me that she is cynically using the bad press on the Republican Crime Family merely to acquire more and permanent power, rather than to seek justice or do the people's bidding.

If we don't send these bastards to jail, they will have got away with it, and that only encourages them to do it again, just as the pardon of Nixon allowed our current nightmare to occur.

The blame for this lays at the feet of the Speaker and nobody else. She's as guilty as Delay.

Excuse me, el Camino, but if she didn't commit a crime, why did she have to plead the 5th. Refuse to incriminate herself. Indeed, she did commit a crime and she knew it, they knew it, and Gonzo knew it. It is illegal to subvert the Department of Justice (everyone's justice) for political purposes. And that is exactly, precisely what she did.

To Bill Arney. I agree about Pelosi. She thinks she has a plan. She wants the Republicans to hang themselves and they will, but at what cost in innocent blood and widespread misery? She obviously does not take that into the equation. Also, I think a lot of these people will be prosecuted, not impeached but prosecuted, after George Bush leaves office (assuming he does leave office, which is a big assumption) because he will just pardon them on his way out the door. For example: Scooter Libby. For now, he has just had his sentence commuted but you can bet he will be pardoned later. In about 16 months. He was promised that. That's why he never dumped on the capo. The big danger with waiting to prosecute until after the elections is that the Dems may weaken (not an impossible scenario) and decide "in the spirit of bipartisanship" to just let it go and let them walk; or Bush may decide NOT to leave office, dissolve Congress and establish an actual dictatorship instead of a de facto one; or, given the level of disgust most liberals have with the Dems in Congress right now, the Republicans just might take back Congress. I'm glad I left the US right after Bush's first election. It's scary even from over here.

I don't think Bush WANTS to stay in office. It's getting to the point where all these crises are cutting into his vacation time.

As for prosecutions later, that's going to be the responsibility of the next president. If it was me, I'd make Pat Fitz the AG, with Ronny Earle backing him up, and tell them to "go get 'em!" I don't think we can count on any of the Demo candidates to do that.

In five or ten years, we'll see more of the same. The standards in this country are so low that nobody will even want to remember this administration, much less go after it. Scum bags, all.

Bush cannot dissolve Congress; Bush does not call Congress into session the way kings call parliaments into session. The Congress meets at its own pleasure -- the Founders were careful to see to that.

Nothing short of a complete coup could take Congress out of the picture.

Rachel Maddow had a related story today on her Air America program.

It seems that some political operative(s) at NASA are asking NASA employees (many who've been at NASA for decades) about their sexual orientation, as part of some new "security clearance" requirement.

If they're gay, they'll be fired presumably. Many career NASA employees, both gay and straight, are refusing to answer the question, simply because "sexual orientation" has nothing at all to do with them doing their job.

However, how many vital, professional, career NASA employees will quit (or be fired) because of this obviously insane policy change by the right-wing religious freaks in the Bush administration?

How many of our astronauts' lives will be endangered by this purging of the career, professional ranks at NASA?

We already know what these religious Republican nuts have done to our Justice Department, but although investigations have suffered, no one's lives have been endangered or lost because of the antics of these religious fools at the DOJ.

NASA is another matter entirely. The partisan political hacks responsible for this outrage at NASA should be immediately identified and fired, to save the lives of our astronauts.

Certain Republicans have amply proven how stupid they are, but now they have shown how dangerous they, and their insane ideology, can be.

Judy, Judy, Judy,

Please don't lose sight of the Senate and House investigations. They are not simply exercises, and they most certainly are not evidence of a "do-nothing" Congress.

The frustrating problem is that to do the process correctly, it takes time for investigation, time for questioning at hearings, time for private sessions to coordinate all the activities of the various committees, and time to deliberate on the most effective and watertight actions to take. We see only a tiny piece of the process. Don't for a moment think that this isn't all coordinated by every chair and significant member of each and every committee.

And feel your outrage. I'm feeling my outrage. WE--all of us--are the appropriate people to feel, and then express, outrage.

Instead of complaining about a lack of progress, we need to encourage the committees (who have got to feel a level of frustration that makes ours look like Tinkertoys®, what with all the obstruction they encounter) by writing and calling with support AND impatience. Keep bugging them and say that you want results. This will keep them going without their feeling like giving up. Hey, these are, after all, politicians, and if their constituents seem not to care, that could be the excuse to give up.

Punishments will come. But, to learn from the case of Scooter Libby, it's best if the hammer falls after Bush is gone. Think you're pissed off now? Just think how you'll feel if all these miscreants get pardoned!

To: Roberta and Al in Austex: God, how I hope you are right! It would please me no end if the Democrats actually had a plan to muzzle Darth Cheney. When you cut off the head, the snake dies. It seems to me, though, that the endless investigations are just so much political theater. I write to my congresspeople (Nancy Pelosi and Dianne Feinstein and Barbara Lee) at least once a week. I just got back a letter from Feinstein, saying how any impeachment is just a waste of time, there is no reason for it, blah blah blah). Not very encouraging.

As to Bush not dissolving Congress, you say that is impossible as though we are living in normal times, which we are not. The irrelevance of Congress is what the unitary executive is all about. And we have had a coup. I hesitate to call it bloodless because so very much blood has been shed as a result of it. Bush clearly stole two elections and was never called on it. What the hell is that if not a coup? In any other country, UN election observers would have been called in to prevent such a travesty. Not here.

I'm so disgusted with the Democrats and sickened by the Republicans, I'm considering the Green party. sc: green

Yes an argument can be made that we have had a coup here , but the remedy -at this point in time - is to make sure our federal checks & balances really do work - Roberta is right as rain , there is much much more going on behind the scenes- lEAHEY , Schumer & Conyers are not the dummies that the Trolls would have us believe. We undue this particular coup by our political processes-
But Mr.White should the President actually physically try to keep Congress from convening -well thats when we open up that Texas sized can of 2nd Amendment protected whup ass- You can rest assured that We the People will not see our rights taken without a fierce fight - Remember too that there are many many US citizens on the right /conservative side of our politics who would also join in to stop the NeoCons from an actual putsche. It would be refreshing to say the least if an agency in this government did something meaningful such as this. I can't believe the questionaire. Asking about religion alone is a huge constitutional/civil issue. Incredible stuff. Where there's smoke there's fire keep up the good work DOJ investigators and thank you.
