Judge: Dems Must Wait until June to File Suit against McCain
Back in February, the Democratic National Committee filed a complaint against the McCain campaign for violating the spending limits for the primary public financing system (explanation of that mess here). Since the FEC is defunct, the DNC then had to go to court to get some action.
Today, the district court in D.C. came to its decision -- for now, at least. The court has ruled that the law is clear that the DNC must wait 120 days after filing their FEC complaint before going to court. So this suit was dismissed, and the DNC must wait until June before they can go back to court. The judge didn't even consider the merits of the case, which will have to wait until June. Meanwhile, McCain continues to spend far beyond the spending limits of the program.













In other words judge says, silly rabbit, rules are for democrats!

Where have we seen this before? Oh yes, a court ruled that when a judge gave parties a wrong filing deadline for an appeal in a criminal case (off by a day or two) that the defense was barred from any appeal. First time I have seen that in over a quarter century practicing law.
Note that there are very loose rules when it comes to illegal spying, torture and other such inconsequential legal matters involving Republicans.

In the old world, reasons and actions had some connection with one another like pearls strung on a necklace.
In the new world, actions and reasons are strung together like green apples on coaxial cable.
It ain't pretty, but if the USSC can get away with Bush v. Gore, then anything can be considered fashionable. Especially when sporting the Federalist Society's label.

We, as Democrats, are arguing for the rule of law. If the law says there is a 120 period after the filing before the DNC can sue, then the judge made the right call. I say, the closer to November this gets press, the better. It doesn't do us much good in May.

A felony a day keeps the FEC away...
McCain's breaking the law even as we speak, and no one seems to care.
But considering the climate incumbent Republicans face in this season of lies, as was proven once again in Mississippi, they need all the unfair advantages they can muster.
