WaPo: Feds Probing Lawmakers' Use of Staffers

Reps. Neil Abercrombie (D-HI) and Jane Harman (D-CA) had a nasty surprise late last week when The Washington Post reported that Laura Flores, a former staffer who'd been busted for stealing $200,000 from her bosses' official accounts, was cooperating with the feds in an investigation of "whether members of Congress used phones, supplies and staff time for campaign purposes." The Post called it "an early-stage inquiry by the Justice Department's public integrity section." It isn't clear if the investigation is limited to, or even concentrated on, Harman and Abercrombie. Flores is getting a reduced sentence for her efforts.

Both Abercrombie and Harman have denied that there would be any reason for scrutiny. And there hasn't been a specific allegation that a Congressional staffer was paid to perform campaign activity. But the Post reported yesterday that both lawmakers had together managed to spend $2 million on their 2006 campaigns while spending only $5,000 of that on campaign workers. Both explain that by saying they used volunteers.

I asked Stan Brand, a veteran D.C. criminal defense and ethics lawyer and the former House general counsel, what he thought of the probe. He couldn't remember a prior example of the Justice Department going after lawmakers for using staffers for campaign work, but said there had been a number of prosecutions for having staffers work on a lawmakers' private business.

The problem for prosecutors, he said, is the vagueness of what would be an inappropriate activity outside a staffer's official duties. "So the courts have deferred in large measure to give the Congress some discretion in defining official duties. That's where the Justice Department has had difficult drawing that line itself." As a result, he said, prosecutors would need to "have a really clear cut and egregious case in this area to make a compelling prosecution."

Of course, this sort of thing is traditionally in the domain of the House ethics committee, but with the committee all but moribund, Brand said, the Department may be looking to "fill the vacuum." With the committee paralyzed, the Department might feel the need "to make a determination of whether something illegal has occurred here.... There's no basis for them to defer" to the committee.

The watchdog Citizens for Responsibility and Ethics in Washington has seized the opportunity to demand that the committee investigate the use of staffers. Whether that will result in any action... don't bet on it.

Sorry, Ms. Harman, you suck! While I don't want ANY of our lawmakers to be corrupt - especially those who call themselves dems (can't we TRY to be above it all?), you could go away for good and I wouldn't complain at all.

Why does Jane Harman suck? Read it and weep.

I instantly thought of him too - but then I realized he is a Republican so it's okay and no charges will be filed, I'm sure.

I'm sure this is just the beginning of the election year attacks on all Dems. There will be plenty of those "leaks" about "investigations" and "possible indictments" of Dems.

The DOJ "Public Integrity Section" is cited by Scott Horton (Harpers) as pressing most of BushCo's politically motivated persecutions around the country, including Don Siegelman. As always, the BushCo name for the agency means the opposite.

Jane Harman is married to Sidney Harman, founder and main owner of Harman Kardon Electronics, and worth hundreds of millions of dollars. She can hire all the staff she wants out of her pocket change -- and, she did not have a very competitive race to begin with. Why would she cheat to get a few hours of a capitol hill staffer working on her campaign? This seems like it has to be another BushCo use of the DOJ to intimidate (or better yet, convict) democrats.

This doesn't pass the smell test in any number of ways.

Why isn't Pelosi under the gun for this? Why is the Democratic leadership in general not questioned with respect to their complete failure to get the House Ethics Committee operating as it should?

How is it that suddenly, in the wake of what this post indicates are murky legal waters at best, the DOJ is feeling compelled to investigate these particular matters? Could it have anything to do with the small detail that the allegations are only against Democrats? I am not saying Dems should be allowed to get away with unethical or illegal behavior, I'm simply noting that for many years now the Republican controlled GOP hasn't had any interest in genuine and sometimes known felons roaming the halls of Congress when members of their party were involved.

I see a complete failure of duty on the part of Democrats and potentially yet another opportunistic political prosecution for the Republicans to conduct prior to the November elections. The people leading both parties in Washington are hopelessly corrupted by their positions and power. I would like to see a clean sweep of nearly every member of Congress with a very few notable exceptions. The conduct of the Congress and its leadership is disgraceful. Sure, it's marginally better under Democrats but only a little. How little has become excruciatingly clear seen since 2006.

This will be like investigating the old saw of the butcher having his thumb on the scale.

In other words, every Member of Congress abuses their government-paid staff in some way. Or their government office. Some much worse than others.

IMHO, thsi is ust another tactic to draw attention away from the soon-to-be implosion of the Executive Branch under the weight of scandals coming to light now that ex-staffers are feeling free to talk and write books.

How about DOJ investigating itself first? Perhaps a special council? I am sure there is enough dirt there to keep them occupied for a while. I think this is way more important than investigating Congress. Just a waste or resources. I guess they are trying to keep peoples' minds off the real scoop.

Trust the Department of Justice to do an objective, impartial investigation? (Anybody heard a good joke lately)?

You don't have to be a blind conservative not to see it, just an ignorant one to deny it.

Why are the DEMOCRATS the first to be targeted with this new concern for the use of staff time?

If the DOJ were targeting Dems and Repubs equally, I'd find the quest more believable.

Curious that Neil Abercrombie's name is being floated in this. He has been a vocal and early supporter of Obama, and a friend of both Barack, Sr, and Ann Dunham Obama.

I'd be surprised if Abercrombie had to do a lot of campaigning in Hawai' where it is rare for an incumbent US Rep or Senator to be unseated - most give up their seats only by retiring or dying in office.
