Why Was the 20th Hijacker Not Charged?

When the Bush Administration rolled out charges against five Gitmo detainees last week for their alleged roles in the 9/11 attacks, there were a lot of questions about why the suspected 20th hijacker was not charged.

The Wall Street Journal today suggests one answer:

An alleged 20th hijacker in the Sept. 11 conspiracy attempted suicide rather than face a Guantanamo Bay military commission and now suffers from such mental impairment that he can't adequately help in his own defense, his civilian lawyer says.

The contention suggests one possible reason the Defense Department last week dismissed charges against Mohammed al-Qahtani, who faced a potential death penalty if convicted in the Sept. 11, 2001, terrorist attacks. At the time, the administrator of the military commissions, Susan Crawford, gave no explanation. Mr. Qahtani remains under indefinite detention, and prosecutors may seek to file amended charges.

In 2002 Mr. Qahtani suffered a severe and prolonged interrogation that a Pentagon review later labeled "abusive and degrading." Some military investigators and prosecutors feared that the coercive treatment had ruined a potential case against Mr. Qahtani, under legal and ethical rules.

Intriguingly, we may yet learn more about al-Qahtani's interrogation, the Journal reports:

Friday, a military judge ordered such an inquiry for Guantanamo defendant Salim Hamdan, Osama bin Laden's former driver, after a psychiatrist hired by the defense reported that Mr. Hamdan was suffering from "major depression" and expressed suicidal thoughts.

If a military judge were to order a similar examination for Mr. Qahtani, it could force the first independent inquiry into his interrogation, which to date has been reviewed by only the Pentagon.

The prospect of two key Guantanamo defendants being incapable of standing trial is another problem for a military commissions system already beset by legal challenges and staff unrest.

Late Update: Speaking today about al-Qahtani's suicide attempt, his lawyer told AP that she didn't learn of his suicide attempts until weeks after it occurred:

Gutierrez said the military did not inform her or al-Qahtani's family of the alleged suicide attempt. She said she learned of it when she went to visit him and noticed three scars on his hand, inside wrist and inner forearm near the elbow.

The prisoner seemed desolate during the meeting, said the attorney, who has met with him more than 20 times.

"This was the worst I have ever seen him in terms of his psychological state," she told The Associated Press. "He just can't take it anymore and just kept threatening to kill himself."

Wonderful, we face two possible reasons why we can not try the "worst of the worse." The interrogation methods were so repulsive that the confessions would never be admissible and testimony concerning the interrogations would be a major embarrassment to the United States so as to justify dismissal of charges. The second possibility (and these are not mutually exclusive possibilities) is that the defendants did suffer extremely serious psychological damage. Just think of what probably happened to all those other detainees who were innocent, could not give up information and were then subjected to more aggressive forms of interrogation.

Your points are valid, but by stating 'the other detainees who were innocent' you imply that this man is not innocent. Yet what untainted evidence is there that this man is guilty? And whatever evidence there is, would it be enough to convict him in a fair trial? We just don't know, because of the lawlessness that permeates this 'administration'. How fondly I recall the seemingly archaic principle of 'innocent until proven guilty'.

given the givens you've given, how can you imagine that the torture interrogation methods produced true confessions, if such were alleged to be the results?

torture through the ages has never been useful except as an istrument for extracting confessions--witchcraft, apostasy, terrorism: what's the difference?

When can not try the man who was portrayed as the Worst of the Worse because he was tortured during interogation enough to turn his brain to jello.

Putting him on trial would require doctors access to him to assess his true mental condition that would allow any doctor not of the Megele persuasion to deduce that the man was tortured. Bush/Cheney can NOT let that enter the legal record. Hence, no trial for Mr. Baddest of the Bad. (or so claimed by Little Georgie & Co.)

The good news, if anything resulting from our government's torturing a person can be termed good, is that but not putting him on trial the bombinb of Iran can be delayed for a few more weeks.

Can anybody explain to me why a President who has sworn to uphold and defend the Constitution (not once, but twice) and who continues to show no respect for the rule of law is allowed to ride out his term doing inestimable damage to our nation and our world while the Speaker of the House says "impeachment is off the table"? Maybe Pelosi should go too...

That indeed--along with the eternal mystery of the reason for air--remains one of life's great unsolved riddles...

The country may actually live to regret not prosecuting this band of brigands and bandits; though it--or should i say, the principles upon which it was founded--may not live long...

By the way, you're all being watched...

It has been revealed today that this prisoner slashed his wrists sometime in April and that neither his family or lawyer were told of this attempt. It was only found out when his atty. noticed the scars on his wrists.
This could be the reason to stop his prosecution for the time being.

Does anyone every wonder just who in hell is running our government and our country?

The Pentagon, CIA, FBI, DOJ, NSA, Homeland Security all are major screwups accountable to no one, least of all Congress.

Not that Congress is all that good either.

As to KSM, the so called Architect, there is an interesting solution. Send him to New York, to the Southern District of New York Federal Court, where he was indicted in 1999 for Bojinka and the African Embassy bombings, and let him stand trial on only those two matters, with absolutely no evidence of anything that happened since, including 9/11. Since all others similarly charged have been convicted, and sent to Colorado for life plus, in all probability KSM would be convicted too.

It would be the perfect blowback, an indictment that Mary Jo White and Patrick Fitzgerald got from a Grand Jury during the Reno/Clinton era, would likely take him off the street for the remainder of his life. Cheap solution.

If you haven't yet read this, please do. Bush Administration officials have been charged with war crimes.

There are days that knowing that this criminal cabal that stole our government, our way of life, and all the goodwill the world once bestowed upon the US will eventually pay for their crimes...well, that's the only thing that keeps me going.

The goopers have a tremendous amount to lose if they lose the 2008 election because anyone in office other than another gooper will put so many of these criminals very lives at stake.

Here's little tip on how to read between the tea leaves (aka The MSM reporting as they parrot the official Gov lie):


1) The CIA refuses to turn over tapes of the torture?

2) The tapes lead to comments made by the FALSE FLAG PROVOCATEURS aided and abetted by FBI HQ, especially SAN DIEGO FBI and MIAMI FBI.

3) Thus...CIA had to destroy some of the tapes, while also keeping the most incriminating tapes. This was a violation of the law, and don't worry MUKASY the MOSSAD neocon is on top of that while dragging his feet to RUN OUT THE IMPEACHMENT CLOCK.


4) How do I know?

Because, I CONTACTED SEN GRASSLEY WITH A TEN PAGE MEMO detailing FBI's overt acts as part of conspiracies to violate too many fed laws while working with the NSA TSP (a 16 year harassment campaign).

I ALSO SIGNED AND PROFFERED A 47 PAGE US DOJ OIG/FBI OPR COMPLAINT that was obstructed.

Then...I GOT INVOLUNTARILY CHIPPED WITH AN RFID VERICHIP as part of FBI HQ'S OPERATION SLAMMER that also involved Sioux Falls, SD, counterintel special agent STEVEN PLUTA'S ILLEGAL UNCONSTITUTIONAL counterinteligence subliminal debriefing.

The chip was seen by me, and DRS CHAD CARDA AND JENNIGER BURGER after I got two sets of xrays taken.

SF FBI manipulated and coerced my father into violating the AMA Canons of Ethics when my father was forced to "attempt to get me to sign a power of attorney" that gave my father the perogative to order a MIND CONTROL TORTURE USING THE RFID VERICHIP THAT IS STILL IN MY SKULL and shows up using any RFID tag scanner found at any quik stop or store?
