Abramoff Crony Gets New Trial
From the AP:
A federal appeals court has ordered a new trial for a former Bush administration official convicted in the Jack Abramoff lobbying scandal.David Safavian, former chief of staff for the General Services Administration, was convicted of lying to investigators about his relationship with Abramoff. He was sentenced to 18 months in prison but the sentence was put on hold while the appeal played out.
He did cry at his sentencing.

What was the legal basis for the granting of the appeal? Don't tell us an appeal was granted without informing us on what legal basis a judge granted it.

As with all things RealUglyCon, the first thing to check is who the judge is, appointed by whom, and (always) whether the judge is/was a member of the Federalist Society. Once these are known, a better perspective on the ruling develops.

He got an appeal because he cried and said he knew his behavior looked bad and there was just a misunderstanding. It broke the judge's heart and he gets a do-over.
