Supreme Court to Decide Whether Sept. 11 Detainee Can Sue Ashcroft, Mueller
Following the Justice Department Inspector General's report on the FBI role in Sept. 11 detainee interrogations, high-level administration officials have been implicated in the debates over torture tactics. Now, besides the DoJ's investigation, former Attorney General John Ashcroft and FBI Director Robert Mueller are facing private suits from the detainees.

The Supreme Court says it will decide whether former Attorney General John Ashcroft and FBI Director Robert Mueller must face a lawsuit that claims prisoners detained after Sept. 11 were subject to ethnic and religious discrimination.The lawsuit was filed by Javaid Iqbal, a Pakistani Muslim who spent nearly six months in solitary confinement in 2002. Iqbal, since deported from the United States, says Ashcroft, Mueller and others implemented a policy of confining detainees in highly restrictive conditions because of their religious beliefs and race.
A federal appeals said the lawsuit could proceed, but the Bush administration says the high-ranking officials should not have to answer for the allegedly discriminatory acts of subordinates.

Why's the Court even bother. We all know how they'll rule. Ashcroft and Mullen were only following orders; can't expect them to be responsible for anyone who reports to them, and anyway are protected from civil suites. So there!

Well, you've got that funny little thing called the oath of office that makes "only following orders" a little less of an excuse. And when you get to the oaths of the highest officers of the law in the land, "only following orders" becomes sinister.
Ashcroft wasn't there to follow the president's orders; he was there to uphold the laws of the land. Take a look at the job description.

Funny thing, that. In Yamashita v. Styer, 327 U.S. 1 (1946) SCOTUS held that a commander was responsible for the acts of his subordinates, even when he had no contact with them and when all order had broken down.
Interestingly enough, Justice Frank Murphy in his dissenting opinion warned:
What goes around comes around, I guess.
