Who Is Esther Slater McDonald?

Only two people were tagged in the DOJ Inspector General's report (pdf) released yesterday for having violated federal law and department policy by screening applicants for career positions based on "political or ideological" factors.

One, Michael Elston, the former chief of staff for the deputy attorney general, we've already heard plenty about and has been in the mix since almost the moment the story of the politicization of DOJ broke. But the other, Esther Slater McDonald, is new to the DOJ name-game.

So who is she?

The IG report covers the time in which McDonald served as counsel to Associate Attorney General Bill Mercer, a short time frame of just thirteen months. But though she was there just a little over a year, McDonald's name peppers the OIG report (pdf) over 100 times. She was deeply involved in trying to ferret out the political leanings of applicants. The report describes her frequent Internet searches of applicants to determine if they were "anarchists" or "leftists."

When [Daniel] Fridman, [an assistant U.S. Attorney and fellow Screening Committee member] asked McDonald how she obtained the additional information, she told him she conducted searches on Google and MySpace, and read law review articles written by the applicants. For example, Fridman recalled that one candidate had written a law review article about the detention of individuals at Guantánamo, and McDonald noted on the application that she perceived the applicant's viewpoint to be contrary to the position of the administration. On another application, McDonald noted that she found information on the Internet indicating that a candidate was an "anarchist."

So where did this human resources wunderkind come from in the first place?

McDonald, who arrived at DOJ in September 2006, was part of the crowd of young DOJ hires who came in during the second Bush term after Alberto Gonzales moved from White House counsel to attorney general. They had limited experience, fierce loyalty to President Bush and sterling conservative credentials.

According to McDonald's LinkedIn profile, she's an alum of Pensacola Christian College and Notre Dame Law School. After graduating in 2003, she worked for Jones Day before being ushered into the hallowed halls of Gonzales' DOJ by none other than the Monica Goodling herself:

On June 13, 2006, a partner at the law firm e-mailed Monica Goodling to recommend McDonald for a position at the Department. Goodling interviewed McDonald later that week. McDonald was hired as a political appointee as Counsel to Acting Associate Attorney General Mercer and began work on September 5, 2006.

Goodling, who would later be forced to resign as part of the U.S. attorneys scandal, was another young inexperienced DOJ official. She had done her undergraduate work at Messiah College in Pennsylvania and graduated from law school at Pat Robertson's Regent University. At age 33, she served as a liaison between DOJ and the White House.

McDonald's new job included assisting with oversight of DOJ grant programs, the Antitrust Division, and the Executive Office for U.S. Trustees. Within weeks, Mercer assigned her to the Honors Program/SLIP Screening Committee, which would ultimately be her downfall. Goodling was happy with the choice, according to Elston:

Elston said that when he informed Goodling that McDonald was to be on the Committee, Goodling "seemed pleased that Esther had been picked and said something to the effect 'well, she's had experience in this sort of thing.'"

It's not clear what experience Goodling was referring to, but McDonald got to work screening applicants for their fealty to conservative ideology. On one occasion, McDonald marked three candidates as unacceptable, because of their "leftist" views. As she wrote in an email at the time to Fridman and Elston:

Poverty & Race Research Council actively works to extend racial discrimination through increased affirmative action and, while there, [the candidate] helped draft document arguing that federal law requires recipients of federal funding to seek actively to discriminate in favor of minorities (racial, language, and health) rather than merely to treat all applicants equally; Greenaction is an extreme organization founded by Greenpeace members and promoting civil disobedience and engaging in violence in protests, and the organization adheres to the Principles of Environmental Justice, which are positively ridiculous (e.g., recognizing 'our spiritual interdependence to the sacredness of our Mother Earth' and 'oppos[ing] military occupation, repression and exploitation of lands, peoples and cultures, and other life forms'); [the candidate] also is/was a member of Greenpeace; [the candidate's] essay is filled with leftist commentary and buzz words like 'environmental justice' and 'social justice.' [emphasis ours]

Within months her work on the Screening Committee would come under scrutiny. When first contacted for an interview by the OIG in September 2007, McDonald agreed. But then she postponed the interview so she could secure counsel. A new interview date was set for October 25, 2007, but department investigators would never get to interview McDonald.

At end of business day on October 24, McDonald's attorney sent an email to investigators, informing them that his client was canceling the interview and was no longer an employee of the Justice Department:

We learned that McDonald had resigned from the Department, effective October 24. On the evening of October 23, she had told her supervisor, Acting Associate Attorney General Katsas, that the next day would be her last day at the Department. Katsas said that her resignation came as a surprise to him.

Since leaving DOJ, she has been working as an associate at the D.C. law firm, Seyfarth Shaw.

This says it all:

When even Acting Associate Attorneys General need to be provided with their own personal counsel, there is something dreadfully wrong with the system.

And Mercer was "acting" because he was double dipping and doing two full time jobs... Absentee US Attorney for Montana -- and the Acting position in DC.

The bench was so thin they had to double up the people with real credentials.

#2 - Pensacola Christian College is a super-scary place. Not accredited. Men and women have seperate stairwells. No inter-sex hand shaking. Demerits and chaperones for those who offend policy. Classical or "acceptable" Christian music only. If you leave campus, you're leaving God. For real. Must read this article. People like this have been running ths US for the past 7 years.

There are three levels of official punishment at Pensacola (four, if you count expulsion). Students can be "socialed," "campused," or "shadowed." Students who are socialed are not allowed to talk to members of the opposite sex for two weeks. Those who are campused may not leave the college grounds for two weeks or speak to other campused students. Being shadowed is the worst of the three. Shadowed students are assigned to a "floor leader" for several days. A floor leader is a student who is paid by the college and has the power to issue demerits. Shadowed students must attend the floor leader's classes and sleep in the floor leader's room. During this time, the shadowed student is not allowed to talk to anyone but the floor leader. Shadowing is usually a prelude to expulsion.

Ms. Poirier was later told she would be shadowed after being spotted riding in a car in mixed company. She tried to explain that it was an innocent outing, but to no avail. When told she would be shadowed, Ms. Poirier decided to withdraw. "I said 'screw it' and I left," she says.


In the library, books and magazines are censored. One student says she saw a pair of black-marker boxer shorts on a photograph of Michelangelo's David. Any books that students wish to read that are not in the library must first be approved by administrators. Those containing references to "magic," for instance, are normally rejected. The rule book specifically prohibits "fleshly magazines and books."


Slater, by the way, clerked for Judge JL Edmonston, a Reagan appointment.

Edmonston is best known for rejecting the claim that the Federal Courts had any jurisdiction over Terri Schiavo's feeding tube whatsoever.

Slater "deselected" candidates for having clerked for Clinton judges. By her own criteria, she would have had to deselect herself as well having worked for Edmonston.

A hypocrite and a crazy loon. Bushworld to a tee.

Ah, the true lunatic fringe. These so-called Christian colleges are churning out Bush administration lifers -- hardly anything to do with Christianity, but because they are the most subservient and compliant employees because they are scared to even cough or look the wrong way. Hilarious that something as ridiculously benign as "eye-fucking the shit out of you" could possibly get me expelled. They don't even know how to properly look other people in the eyes because they're so afraid. How can one hire lawyers that don't understand the human condition enough to be properly moral and ethical?

At this rate, the next administration has to purge all of these lifers from the ranks of the DOJ (dare I say the rest of the government too), they are so brainwashed with fear of god they don't know how to do their jobs properly.

Because exposure, over time, to an ideologically-controlled environment predictably results in an inability to make reasoned decisions, why is anyone planning to vote for McCain?
I have never understood how his POW experience could be touted as a plus rather than being down-played as a huge minus. McCain is a man who, even before his confinement, was nearly last in his class at Annapolis. As he was a man who, even before his confinement, managed to lose three planes in his first sorties in Vietnam. Therefore, he was not the brightest bulb in the bunch, or the one with noticably reliable judgment, to begin with. After the fact of five years of harsh confinement? Add rage to lack of judgment and stir. The result? A Molotov cocktail.

Another telling detail is the seeming fear of 'magic' by the lunatic fringes of Christianity and schools like Pensecola: Why is this? Well, if I had to use my imagination and guess, it's exactly that: they literally want to quash imagination, lest their minds start wandering and they start thinking for themselves, which would be counter to the Bush-mould of yes-men thinking.

Why this isn't emblazoned on the front pages of every MSM news site is beyond me, but it seems this attitude is just as pervasive in other parts of American society. I'm very grateful we have the internet and places like TPM to dredge up this BS.

Will the DOJ-IG now inquire whether McDonald and/or Goodling "deselected" candidates because they had Jewish-sounding or Muslim-sounding names?

The DOJ-IG report did a good job looking at "deselecting" candidates based on perceived "leftist" affiliations. But how about checking whether this fundamentalist Christian McDonald also was biased against those she perceived to be Jewish or Islamic?

Two comments:
1. If you go to Seyfarth Shaw's website and look at other associates, they provide the name of the undergraduate university attended and some descriptive background about their legal experience. Not so with Ms. McDonald. Perhaps that is because she is relatively new. Or perhaps they have difficulty beginning her biography with, "Ms. McDonald, who left her most recent legal position at the U.S. Dept. of Justice after refusing to speak to the Inspector General who was investigating whether ...."

2. Idle speculation: What was the interview meeting between Goodling and McDonald like? Did they shake hands, praise Jesus, then get down on the office floor to jointly pray for the destruction of liberals, Jews, Muslims, and other "sinners"?

But what a crappy pic of Esther Kate used, that teeny-weeny Linkedin thing. Girl needs a new headshot. I mean, what's the post office supposed to put up?

If Pensacola Christian College is not accredited how did Ms. McDonald gain entrance to Notre Dame Law?

Notre Dame is not in the top 10 law schools, but it's not chopped liver either. It's a Tier 1 school, unlike Regent which is firmly in Tier 4, and would be fairly fussy about admissions I would think.

After graduating in 2003, she worked for Jones Day before being ushered into the hallowed halls of Gonzales' DOJ by none other than the Monica Goodling herself:

Which brings up the question, "who ushered Goodling into the hallowed halls?" And the answer is: Mary Beth Buchanan, current US Attorney for the Western Region of Pennsylvania.

Mark my words, Buchanan is going to emerge as a VERY prominent figure in the DoJ scandal. In fact, she already is, with her name having come up several times in testimony before the house, and her political investigations of Dr. Cyril Wecht and other prominent Pennsylvania Democrats.

She is one of those US Attorneys that Paul Krugman described last year,

"The bigger scandal, however, almost surely involves prosecutors still in office. The Gonzales Eight were fired because they wouldn’t go along with the Bush administration’s politicization of justice. But statistical evidence suggests that many other prosecutors decided to protect their jobs or further their careers by doing what the administration wanted them to do: harass Democrats while turning a blind eye to Republican malfeasance."

I'll try to put something up at TPM Cafe about this in the next couple of days.

Mary Beth Buchanan of Pennsylvania: Wasn't she put in place by Ashcroft to spearhead the entrapment and further persecution and imprisonment of Tommy Chong?

Inhumane and unforgivable brute, that Buchanan. American police-state commisar toeing the sadistic line. These people have little humanity remaining. They are all craven, warped ideology, no heart, and no mind of their own.

And that's being generous!

Buchanan is indeed the prosecutor/persecutor of both Tommy Chong and noted forensic pathologist Cyril Wecht. Even Republicans in Western Pennsylvania have intimated, publicly and privately, that the Wecht prosecution is political. A bi-partisan letter to the DOJ requesting that Wecht not be re-tried has elicited no public response.

While Buchanan has gone after noted Democrats, including Pittsburgh's former mayor, she declined to prosecute the fine conservative who ushered HER into power: Rick ("Man-On-Dog") Santorum, who had falsely claimed a home in the Pittsburgh suburbs as his residence so that the school district would pay to cyber-school his children.

I have no doubt at all that she is neck-deep in the DOJ scandal.

Start pulling the Siegelman/Rove thread and the whole sweater of Justice Department corruption will start to unravel. Underneath all of the threads will be the skeletal remains of what we once called "The United States Constitution." People will start singing like the chorus at the Metropolitan Opera in order to save their own asses. Start the overture!

There must be much of this kind of vermin left at DOJ and throughout the ranks of the federal government. The question is: How do we, for the public good, get rid of them, absent criminal conduct or some other punishable behavior? The answer is: We probably don't. They will remain burrowed into the woodwork of the executive branch for years, quietly pushing their ideology over their duties as competent civil servants and infecting the body of the government. Thank you, George W. Bush. Heckuva job.

Maybe not. Most of these people are political appointees, not civil servants, so they should not be continuing into a new administration. And quite a few have stunk up their offices enough that they have already had to resign. They are so bad that they call attention to themselves if they do any work at all. They're self-eliminating.

Interesting how these fundie/bizzaro "christian" schools are so good at turning out graduates with no morals or ethics much less any compulsion to follow the law.

They do seem to be adept at graduating people who will follow orders.

She's no Fawn Hall!

Maybe Esther should have done a little more background research on her own firm. In the "Diversity" section of its website, the firm appears proud of its affiliation with leftist groups such as the National Lesbian Gay Law Association. I wonder if she will volunteer to ferret out the heathens responsible for this transgression -- or maybe she'll just tithe from her $200,000 salary from the devil.

The DOJ has refused to enforce Congress' summons. Congress makes the law, but the Administration can ignore the law, even if the Supreme Court directs them to follow it (recent EPA email report is "unopened"). Rove and the rest completely politicized the DOJ. The White House has "lost" millions of emails, and spies illegally on US citizens, with no consequences. In fact, the Administration attacked a country that did not attack us (Nurmeburg's worst crime), supports torture and waterboarding, and even is running offshore prisons. Anyone on Earth can be picked up in the night, sent to a "black site" to be tortured, and has no recourse; all on the President's word.

It is truly bad.

Would be interesting to know her connections at the law firms -- who hired her and who were the partners she worked for at Jones Day and Seyfarth. Probably Bush-connected folks as well. Those are tough jobs to get for someone from Pensacola Christian & Notre Dame Law (even if Notre Dame Law is in the ballpark -- it's not a big school for top firms to recruit from).

Not only has the DoJ been corrupted with people like Esther Slater-McDonald & Monica Goodling, but the Patriot Act allows them to get away with it. Let me give you a hypothetical:

Lets say that I have a co-worker who happens to be 2nd generation Iranian-America. She has an uncle in Tehran that she calls every 2 weeks to keep track of the family. This uncle is a barber. Every 2 weeks a certain banker has his hair cut by this uncle. This certain banker happens to launder money for a terrorist group.

Does this mean that my co-worker and I, are associated with terrorists?

The Patriot Act gives the government the power to detain her and me without council on this flimsy type of evidence.

(To the DoJ) Thank goodness I don't have any Iranian-American co-workers and I'm terrible at gaining a woman's attention.

Doofus hits it on the head, alot of these people are going to stay in DOJ. It will be the job of their new bosses to put them in places where they can't have much impact.

And there are many such assignments.

Lest PCC send a lawyer to TPM, it must be noted they do have accreditation. They just lack regional accreditation at least as of last year. But regional accreditation (in their case SACS)is the one most colleges require for transfer purposes.

Just an update.

It looks like the first lawsuit on discriminatory hiring at DOJ has just been filed in DC.
