Ellison Slams von Spakovsky Over Disenfranchised Nuns and U.S. Attorneys

It's been a slow burn at the hearing on the 2004 elections at the House Judiciary Subcommittee on the Constitution, Civil Rights and Civil Liberties. With two separate panels, Hans von Spakovsky didn't get around to testifying until 5:00 PM ET.

But Rep. Keith Ellison (D-MN) made it all worth it.

Ellison threw tact to the wind in questioning von Spakovsky, berating him for the disenfranchisement of a group of a dozen elderly nuns and battering him with inquiries on his communications with U.S. attorneys on voter fraud prosecutions. We have video coming, but to tide you over, here's the transcript:

ELLISON: Now here's something that happened on the May 7th Indiana election. A dozen nuns and another unknown number of students were turned away from the polls Tuesday in the first use of Indiana's stringent voter ID law since it was upheld last week by the United State Supreme Court. Mr. von Spakovsky, you wanna stop nuns from voting?

VON SPAKOVSKY: [silence]

ELLISON: Why don't you want nuns to vote, Mr. von Spakovsky?

VON SPAKOVSKY: Congressman Ellison, uh-

ELLISON: I'm just curious to know.

VON SPAKOVSKY: Those individuals, uh, were told, were- knew that they had to get an ID, they could have easily done so. They could have voted, uh, by absentee ballot- uh, nursing homes under the law are able to get-

ELLISON: . . . Mr. von Spakovsky, are you aware that a 98-year old nun was turned away from the polls by a-

VON SPAKOVSKY: They all had passports-

ELLISON: Excuse me.

VON SPAKOVSKY: They had expired passports which meant that they could have gotten-

ELLISON: Mr. von Spakovsky, do you know a 98-year old nun was turned away from the polls by a sister who's in her order and who knew her, but had to turn her away because she didn't have a government-issued ID? That's okay with you?

VON SPAKOVSKY: Yes. . .

And once he was done making von Spakovsky look like a guy who won't help an old lady across the street to get to her polling place, Ellison started in on his communications with the U.S. attorneys. All that and more, after the jump.


ELLISON: Were you part of the discussion that U.S. Attorney Heffelfinger of Minnesota should be fired because he expressed deep concern that a directive that could have discouraged Indians from voting in Minnesota?

VON SPAKOVSKY: I don't recall being part of any such conversation.

ELLISON: Did you ever discuss U.S. Attorney Heffelfinger in regards to any voter fraud cases?

VON SPAKOVSKY: No.

ELLISON: What involvement did you have in the voting prosecution brought by Brad Schlozman in Missouri?

VON SPAKOVSKY: I had none, I was at the Federal Elections Commission. Why would I have anything to do with what the Department of Justice was doing when I wasn't even working there?

ELLISON: Maybe because you have an obsessive fear that people might vote who you don't want to, so you try to contact the U.S. Attorney's office to try to stop people from voting.

VON SPAKOVSKY: That's a fantasy that you're making up. I had nothing to do with federal prosecutions going on at the Department of Justice when I was at the Federal Elections Commission. That's ridiculous.

ELLISON: Well, I'm asking you, you're on record now. And we'll see if it matches up with the facts.

VON SPAKOVSKY: Are you accusing me of lying Congressman?

ELLISON: I'm asking you questions sir, haven't you been here?

VON SPAKOVSKY: And I'm telling you that's a ridiculous question.

ELLISON: And you put yourself on record, and we'll check it out.

VON SPAKOVSKY: You go ahead and do that.

ELLISON: We will. You can plan on it.

Good on Congressman Ellison -- he seems to know the US Constitution and what rule of law means.

Readers may recall that Keith Ellison is Muslim, and took his oath of office on the Koran. It didn't matter then; it doesn't matter now, and I bring it up for its utter irrelevancy, just to emphasize its irrelevancy.

Correction - the oath of office is taken by holding up one's hand. The other hand is not placed on any book. The story that he took the "oath" on a Koran is yet another Republican myth and lie. It is true that on the day of his inauguration, he posed simulating his swearing in with his hand raised and one on the Koran, but it was merely a photo op, often used by Congressman.

I certainly hope Ellison can back up his intimations about Spakovsky being involved in discussions about US Attorney firings. I would be great if he could be nailed for lying under oath. Does anybody know? He is, of course, a weasel who deserves to be waterboarded, but can he be tagged for perjury?

It's highly unlikely that Ellison would have asked so pointed a question if he didn't already have evidence that answered it. Rule #1 of courtroom questioning: Never ask a question you don't already know the answer to.

... and that is an example of a real-life, non-internet pwnage.

I know I keep beating this dead Elephant, but Tim Griffin is alive and well busy a beaver in Missouri, Ohio and Florida. The RNC / McCain 08 hired him in May. He is the vote cager extraordinaire and Rovian protege. New Mexico and Missippi are in the news today regarding voter rights. The repuglicants are doing everything in their power to nullify the massive voter turnout that is expected in November.

We need civil rights attorneys in every swing state to fight for every voter.

I agree that the GOP is not going down easy this year, despite McCain's lack of popularity. But filing suits a month before the election or contesting the results afterwards won't get Dems in office.
We need to make sure every Dem is prepared and votes - that means getting ID if required by new laws, checking to make sure you are still registered, knowing your polling place and the ballot.
It won't help to have another Florida or Ohio situation and wonder why Obama didn't get elected.

Someone needs to personally challenge Tim Griffin's right to vote.

If he's planning on voting absentee in Arkansas, but living and working and drawing a paycheck in Missouri, someone needs to give him a taste of his own medicine - and make his vote provisional.

I agree... prepared voters who are properly registered and show up at the right polling place.

Registration and Voting standards need to be nationally set and relatively free of any burdens.

Just think how F'd up it is that those Nuns were denied their civil rights.

Denying voters makes us no better than the regimes we cahnge in the name of democracy.

So, great segment and all. And on the irrelevant Muslim string that people always need to bring up regarding Rep. Ellison, just wanted to remind everyone that the Koran he was sworn in with belonged to THOMAS JEFFERSON.

I don't think Ellison was actually sworn in on the Koran. Our lawmakers typically have a photo op after the swearing in and I think that is where he used TJ's Koran and others use the bible if they choose.

The most important part of being sworn is that the elected official is swearing to uphold and defend the constitution of the united states. The repuglicants have been using the constitution to wipe their asses for 7 years and that shitshow needs to end.
