Rove Is a No Show at House Judiciary

Karl Rove stood by his claim last week that he wouldn't be showing up to testify about anything to the House Judiciary Subcommittee on Commercial and Administrative Law, despite its subpoena, on the grounds of executive privilege.

The Subcommittee quickly passed a motion to reject Rove's claim of privilege, with Rep. Chris Cannon (R-UT), the ranking minority member, the lone voice of dissent. Since Committee Chairman John Conyers (D-MI) threatened contempt last week, we're expecting a vote on that in the near future, but it won't be happening today.

Let's see, the AG resigned in disgrace, many US Attorneys were fired improperly, the current AG won't enforce the law, and all of the President's staff won't talk under oath, or even show up.

Bush and Cheney et al can be called to account for a multitude of sins, but they are not responsible for a spineless Congress. Conyers and Biden and the rest have talked a mean fight, but the time for talking is now done. It's time to stand up to the bully for once and for all.

One question: Can the president interfere with a contempt of Congress citation?

They can and they have. In the past Attorney General Mukasey has flatly refused to enforce the Contempt of Congress citations issued on Harriet Miers and Josh Bolten. Those times the House Judiciary committee chose not to exercise their power of "inherent contempt" under which they could send Sergeant at Arms to pick up the person for immediate testimony or, as in the case of Bolten, to hold in the Capitol jail in the basement (yes, really) until he produced the documents subpoenaed. This provision has not been exercised since the 1930's, but it has been used around 80 times over the years, and if this is not a situation that demands it gets dusted off and exercised, I don't know what would be.

If nothing is done about this flagrant disregard of our laws, then the democratic leadership in the house should be replaced. No, they must be replaced. Pelosi is the worst speaker of the house in the history of congress. No impeachment, no oversight, no respect for the law and she is continuing to support Bush! I'm completely disgusted with her and Hoyer. Everyone should be buring up her office's fax machine and letting her know of the utter disgust we hold for her in her neglect of her office's responsibilities. I find it so interesting that she denies any instructions to the committee not to proceed with contempt charges but they do not take action to enforce their own orders for Rove's appearance!

Well, KZ, he didn't just not show, he cited a privilege-- albeit contentious as to its validity-- for failing to show up. Who exec. privilege applies to is a much more windy road.

Unless Bush was involved in the scheme to go after Sigelman for political purposes - I can't see how it could be considered under executive privilege.

Worse than that, it's not his privilege to assert. It's the Presidents. That's what makes his (and Bolton and Meiers before him) failing to show so serious. If they wish to refuse to testify due to executive privilege they must show up and explain why the President asserts this privilege. It then must be ruled on; it isn't automatic just because he says it.

So, despite what you hear in the MSM, Rove did not assert executive privilege. That's a legal position. No, Rove simple refused to show up for a subpoena, something he cannot legally do. Let's see what happens. If they simply let all these people walk away it will set a dangerous precedent. I can't wait until the next Democratic administration does this to a Republican Congress. Can you imagine the consternation and hand wringing about the death of the Constitution and the rule of law?

I've always suspected that the Bush regime took its rules of the game from the Mafia playbook. Well, here's the proof: Omerta is the law of silence which forbids cooperating at all with the police or the government.

I read somewhere (?) that Congress can legally lock recalitrants who refuse to cooperate with or answer to Congress in the basement of the House. (I wonder if the American people can lock the whole bloody Congress in its basement.)

There is no reason he CANNOT be arrested, but there are many reasons he WON'T be arrested... at least not now.

To make a long story short, ALL of these clowns are protecting their OWN turf and security. Rove may well be arrested at some point, but it will be just prior to Bush's departure, whereinn he can pardon him and the others, so it may well be that Rove spends one or two days in detention. that way, the democrats will be able to tell its audience (that's us) what a great job they did bringing this guy to justice. Meanwhile, they won't offend the other mobsters (that's the republicans in power.

The result: both parties continue to rule and the only losers are the fools who keep putting their heads in the sand so they won't be able to see what's actually going on... (that's the common folk out here who keep believing we are playing some kind of game and it's OUR team against THEIR team...) IMHO

All this is, is more proof of what a bunch of pathetic pussies the Democrats in Congress are. They have the power to go and have him arrested on their own. They don't need a court to do jack shit. But they're too cowardly to use the power they have. They are nothing but contemptible cowards.

Lets see now,


1- Conyers issues "Contempt Citation in mid August;

2- 6 weeks later, October 2, Rove's message to Conyers; "Sticks and stones may break my bones, lalalala" arrives at Judiciary Committee.

3- October, 12th, Conyers issues Double Secret Contmept Citation.

4- October 12th, Rove goes to Caribbean for vacation.

5- November 1st, Rove returns from vacation,
hires Scooter Libby to represent him.

6- November 8. Obama elected President, Democrats maintain control of both Houses.

Democratic Leaders and Committee Chairs jump up and down screaming in unison; "We're home free!"

7- November 9th, a putrid stench surrounds Washington, DC.

There is no reason he CANNOT be arrested, but there are many reasons he WON'T be arrested... at least not now.

One of them being that he's currently in Sweden.

But when he returns it would be nice if someone is there to pick him up at the airport. ;)

I think the Democrats are victims of the Stockholm Syndrome and haven't recovered from all the years of left is right up is down Bush presidency.

There is so much corruption going on now its truly overwhelming them apparently. It will be years and decades to clean it up -- if ever.

Democdrats need a reminder of the ideals that set us apart from the Republicans.

I say the Democrats are the Conservative Party, and the Republicans are the Very Conservative Party.

The Repubs almost always vote together to block anything happening in Congress, while a large block of the Dem majority party often votes with the minority...thus crippling their leadership in achieving anything of substance!

Bush is running out the clock on everything including this Rove thing:

-GTMO prosecutions - need more time to prepare?
-Any and all IG investigations at any and all agencies - you'll never see a report
-Troop withdrawals- even now that the Iraqi's are asking us to leave
-(everything I can't think of right now)

If Bush cites privilege over Rove, that seems to implicate him in a crime while in office. The legal wrangling that this no-show kicks off will not be resolved until next summer, if ever. Mukasey's BS testimony yesterday and Pelosi's opposition to impeachment prove nobody will take responsibility for anything. What a joke. Stonewalling works. How the heck were the repugs able to impeach Clinton so quickly?

does anyone know if this non-event was televised on CSPAN? I think it would be great TV to watch how our strong our democracy is at non-work today.

Rep. Dennis Kucinich (D-OH) may introduce a resolution to the House floor today, with one article of impeachment of Pres. Bush. In June, 35 articles of impeachment introduced by Rep. Kucinich were read on the House Floor. Last year, he offered a similar resolution on Vice Pres. Cheney.

It was available by webcast through the House Judiciary Committee's website.

C-SPAN is mandated to cover the House and Senate when they are in regular session (they are today - on CSPAN 1 and 2) and the "spare" third channel is used for anything else. Today's "anything else" is the House Banking Committee's hearing on the financial meltdown.

A lot of hearings today - Rove, financial, and the State Department passport scandals.

Karl Rove can't claim executive priviledge. It's not his to claim. Executive priviledge belongs to the President. The President should be challenged to claim this, publicly, on behalf of whomever he believes is entitled - each and every time. Otherwise, yhe committee must follow through and arrest the minion.

If Conyers and his committee don't act with the powers they have and arrest him when Rove returns from Europe you may as well kiss the opportunity goodbye. If not now, nothing will ever be done.

Let's see...Scooter Libby was convicted and pardoned without serving a day in jail.
Our Democratic Congress just gave telephone companies protection from any consequences for helping out with illegal surveillance services.
Harriet Myers thumbed her nose at a Congressional subpoena. And we expect Carl Rove to comply with a subpoena? He has Congress pegged.

Well, Pelosi will "allow" Kucinich to read his articles of impeachment just like she has before.
They will go about as far as the move to arrest Rove or any of the other criminals now pulling our strings and discarding the constitution.
I had thought the Democrats were just wimpy, timorous beasties in snappy clothes, but more and more I wonder if they aren't somehow actively complicit.

The Democrats are backing themselves into a very deep hole. The Admin and its lackeys are acting like common criminals and humiliating them, and the poor, terrified Dems, as if dumbstruck by their sweep into power in '06 (that they didn't quite seem to understand wasn't that people loved their mind-numbing policy, but that they wanted the war over, Bush impeached) do nothing but cry foul.
At this point, Dems, you'll be ripped apart whether you do something or not. So get it over with. Arrest Rove. It is not like the Repigs won't fight you to the death, anyway.

Didn't the DC Circuit just suggest that Congress has the right to enforce its own Contempt issues in the last couple of weeks? I say Mr. Rove might like a little time down in Washington's crypt while Congress and the White House fight about Executive Privilege....

Yes, the judge reminded us of what we already knew. (There is even a holding tank in the basement of the Capitol Building, I think.)
However, the judge is an apparatchik of the Cheney/Bush neocon crowd so he won't make a final pronouncement in the best interests of the administration without some time to make it look like he deliberated.

I believe that the Congress is so corrupt that they are afraid if they actually take steps against Rove and any other political evil-doer then the skeletons in their closet will be brought to light. I don't think there is a person either the House or the Senate that has a honest enough background to hold Rove to the law.

According to a story that is posted at www.rawstory.com, Rove wasn't even in the country the day he was supposed to be testifying. I wonder if Karl headed to a place like Ireland. It would be a smart move as they have no extradition treaty with the US and it seems a favortie spot for political thugs to hide their funds while being untouchable to the long arm of the law.

Perhaps Conyers wants to hold off until Judge Bates issues a decision in the Miers case....

Is it possible that the Dems are actually afraid not of political repercussions, but for their lives? I mean, when Sens. Daschle and Leahy held up the Patriot Act to try to amend it they got letters with anthrax of a strain from an American military lab, and after an Alabama Republican political operative decided to testify that a Rove aide was in charge of railroading Gov. Siegelman, her house was burned down and her car run off the road. Then there's the rumor that the neighborhood near the Sen. Wellstone plane crash experienced a momentary power interruption consistent with what would happen if a strong electronic pulse that could cause loss of control in a small plane were discharged. Alright that last one is pretty speculative given the weather, but the others are straight fact.

Not that that's an excuse for dereliction of duty because what logically follows is that all a lawless administration would have to do to triumph is to physically intimidate Congress. Wait a minute, hasn't that already happened?

That wreckage could be checked to see if the engine electrical was fried with EMP pulse cannon, and TRACE EVIDENCE OF C4 IN TAIL SECTION....no?
