Foggo Threatens To Expose CIA Secrets As Part of Own Criminal Case

In court documents filed late last week, prosecutors in the trial of former executive director of the CIA Dusty Foggo allege that the defendant is attempting to "twist a straightforward case into a referendum on the global war on terror" by taking the spotlight off his charges of corruption and fraud.

In going down this irrelevant path, the government argues, Foggo will expose dozens of confidential programs and people still active in the CIA.

From the government's motion:

Foggo's desire portray himself to the public as a patriotic hero stands in stark contrast to his Section 5 Notice, in which he expresses (albeit in a sealed filing) a desire to expose the cover of virtually every CIA employee with whom he interacted and to divulge to the world some of our country's most sensitive programs - even though this information has absolutely nothing to do with the charges he faces.

Foggo's most recent move -- the process of holding the court ransom with threats to expose classified information -- is common in national security cases and is known as "graymail" and is something the prosecution has already been on the look out for. The prosecution has requested an in chambers examination of the material to be submitted by Foggo and determine its admissibility.

The case against Foggo, is tied closely with that of former Rep. Randy "Duke" Cunningham who took bribes from defense contractor Brent Wilkes, who is a long-time friend of Foggo. Foggo is alleged to have favored Wilkes for contracts and in turn, accepted tens of thousands of dollars in gifts.

It was reported that Wilkes & Nine Fingers Bassett took a trip to Germany. Two weeks later, Bassett goes to work for the House. He then talks Goss into appointing Foggo to the #3 Post at CIA.

I was going to suggest the same thing. The judge and prosecutors should advise "Mr." Foggo that if he reveals any classified information, his testimony will be terminated and he will be re-arrested and tried for treason. Separately from the current charges.

And why not close the court during the trial due to the threats, so that any graymail can be contained?

I don't know why this stuff has constantly to be corrected.

When Mukasey said similar, the contrary FACTS were reported:

As Mukasey, a former Federal judge, knows, the courts have LONG had special procedures for handling sensitive information, as in this case.

And, in fact, that is REPORTED in the story to which the above quote is a comment. Such "graymail" OFTEN happens, the prosecution EXPECTED it would happen, and the prosecution suggested the normal way to porceed under such circumstnaces: in camera. In the judge's chambers, with only those present -- usually only the lawyers -- who need to be.

All of this is, in short, normal, and there's nothing unusual or controversial about it.

As #3 at the CIA there's no doubt that Foggo knows all about the rendition flights and European and Asian torture prisons that the CIA was using.

They're not going to touch him.

The CIA was supposed to be shattered into a million pieces in early 1964 as the consequence of the Bay of Pigs fiasco.
They've only gotten worse and more deserving of disbandment since. "Let justice be done though the heavens fall" is in my mind for some reason.

So, any prediction on how many times he'll shoot himself in the back of the head?

dusty foggo case..which leads us to..justice dept scandal..firing of the judge handling the randall cunningham case..remember the case of "Carol Lam"?
she was let go, because she got wind of this very case also, which she was going to investigate..then suddenly..BOOM!...she got herself fired for doing her job.

Dusty? Foggo? Executive leadership of a spying agency?

Geez, the next thing you know they'll be hiring a General named "Betray Us".

I wonder what Bush's nickname for Dusty is...
