Palin Wants Independent Trooper-Gate Probe Called Off
In the latest sign that Sarah Palin's promised cooperation with the Trooper-Gate investigation is failing to materialize, her lawyer is now demanding that the entire case be taken out of the hands of the independent prosecutor hired by Alaska lawmakers, and given over to a state personnel board -- whose three members were appointed by the governor herself.
In an unusual "ethics disclosure" filed last night, along with related documents, to the state Attorney General, Palin's lawyer, Thomas Van Flein, asked the personnel board to look into the firing of Walt Monegan, the former public safety commissioner at the center of the case. Van Flein also asked the legislature to drop its own investigation, contending that only the personnel board has jurisdiction over ethics. And he suggested that if the legislature didn't agree to hand the matter over to the personnel board, Palin would not be made available for a deposition.
Sen. Hollis French, the Anchorage Democrat in charge of the legislature's investigation, immediately told the Anchorage Daily News that the probe would go ahead as planned. French has said before that he is willing to issue subpoenas if necessary.
"We're going to proceed. If they want to proceed, that's perfectly within their right but it doesn't diminish our right to do so," he said.
The case concerns allegations that Palin improperly pressured Monegan to fire a state trooper who was embroiled in a family dispute with the Palin family, then fired Monegan when he refused to axe Wooten.
Van Flein, whose fee is being paid for by the state of Alaska, also used last night's complaint -- released the night before Palin is to speak as John McCain's vice presidential nominee at the Republican National Convention -- to put out information intended to paint the trooper, Jim Wooten, in a negative light, as well as to undercut Monegan's claims that the governor pressured him to fire Wooten.
In the words of the ADN, the complaint contends that:
"Monegan never told the governor or Todd Palin that Wooten had been disciplined over complaints brought by the family that included tasering his stepson, illegally shooting a moose and telling others that Heath would 'eat a f***ing lead bullet' if he helped his daughter get an attorney for the divorce."
And:
"Recently, Wooten's supervisor intervened when he wouldn't return the children after a visit, the complaint says. Wooten warned his ex-wife he was going to get her and Palin, the complaint says. 'There is evidence suggesting that Wooten was following the governor,' it says."

Yeah, the SAG has no authority to conduct investigations of the Guvna. Wishful thinking on Sp's lawyers' part to say the least!!

Here is a long-time observer of Sarah Palin in Alaska (who also had significant interaction with her), writing an open letter about who she knows Palin to be.
This letter actually should be reprinted on TPM someplace, in its entirety; it speaks to her true biography from a non-partisan observer's view.
And I think you all should read it now:

Dear concerned citizens of America and mass media of the U.S.A.
As a concerned disabled American Veteran and American citizen, I consider it my duty and responsibility to address the following critical issues facing the voters of our Greatgrand nation, the United States of America [USA].
The citizens of the United States of America [USA] have the ultimate power and responsibility to elect the Right Ticket with the right joint "temperament, judgment, and statesmanship" to lead our nation as well as change our nation's present and future moral, political, economic, educational, health care, energy, military, and foundational soul.
In my firm professional, personal, and political opinion, the media should help the common voter to explore and discuss the following attributes of the present Republican and Democratic presidential slates:
1. Does the joint ticket have a calm, cool, and collected " temper and impulse" [Presidential Temperament]?
2. Does each ticket have sound and sustained "Judgment and Caliber"?
3. Does each ticket have a "presidential depth and degree" in regard to their purpose, policies, and positions?
4. Does each ticket have adequate, "understanding and knowledge" of workings around Washington"?
5. Does each ticket have enough "vigor, wisdom and Vision" for the future of our beloved Great-grand Nation?
6. Does each ticket possess enough joint foreign policy experience and ex-poser based on "American Values, Virtues, Vastness, and strong soul"?
7. Are their campaign talk, slogans, ads, plans, and programs based on facts and are they free of fear, fiction, frivolous labels, unfair attacks, negativity, and impulsivity?
If your answer to a majority of the above questions is yes, I suggest you vote for that ticket. As a Independent registered voter I have decided to vote for Obama-Biden ticket. I am sure they will protect our national security, Strong's, stamina and strong soul. Rebuild our nation from bottom up in all areas of need, OBAMA-BIDEN ticket will once again restore and rebuild our global standing with the use of maximum international humane diplomacy and minimal force if and when indicated.
Yours sincerely,
COL. A.M. Khajawall [Ret] MD., Forensic psychiatrist, Colonel, US-AR / MC Combat Stress Control[Ret], Disabled American Veteran and Iraq Freedom team.
PS: This attests to the Senator McCain's impulsiveness, temperament, and judgement. USA can not afford him to be next president.

Well said, Colonel.
I think what will happen is that those voters who supported booosh's expansion of "executive privilege" will support Gov. Palin in this matter. A few voters won't care - "It's an Alaska 'thing.'" The remainder, we American citizens who care about the rule of law, will be further alienated by the Republican ticket's actions.

All of the charges mentioned in the first paragraph were made by the Palins prior to her "election" as governor. All were investigated by the Alaska Highway Patrol. All were found to be untrue, except shooting the moose, which Wooten himself admitted to being true. Sarah and Todd Palin helped eat the moose.
In the written depositions to the divorce court, Sarah Palin swore under oath that she had never contacted the Highway Patrol, but then an email from her to the Highway Patrol regarding Wooten was revealed. She lied under oath.

People let not forget the real reason of this investigation...Palin used her political office for personal reasons. That is unethical in any work place let alone a governor's office. If there isn't any abuse of her office then she has nothing to worry about, right? If Palin has nothing to hide she would let the investigation go on as planned. Seems like this legal move indicates that she DID abuse her office and violated ethics. God, another Cheney!!!!

Where is the MSM on this one. It's utterly ridiculous.
I see they keep repeating what Wooten supposedly did, but don't seem to realize that this is about Monegan.
The most damning footage I've seen of this is a video where weeks before Monegan was fired Palin tried to "promote" him out of the position she wanted him removed from and that this new position would be a fit for him because of the great work he did cracking down on rural bootlegging and alcoholism. And then after he was fired, Palin gave the reason why he was fired as he didn't do enough to crack down on rural bootlegging and alcoholism.

Why should we give Palin any benefit of the doubt on this case? She has a credibility problem:
--She fired the Wasilla police chief, then lied about it, despite having fired him IN WRITING.
--She lied to the public about Troopergate by saying her staff and husband had not contacted Monegan about Wooten.
--She may have lied under oath, as SunnySteve says upthread, by saying she had not contacted the state police about Wooten when in fact there are emails from her.
--And there's the bridge to nowhere, which she still takes credit for stopping, even though she was for it until everyone else was against it. Her role was that of a doctor pulling the plug after a patient dies -- and she kept the federal money anyway!
Please feel free to add on. I'm sure this list is not comprehensive. We're still just getting to know her.

A subpoena will not be necessary. A strongly worded letter will do the trick I'm sure.
The interesting question is now that we know John McCain has saddled himself with the second coming of Thomas Eagleton, what will he do? McGovern dumped Eagleton and suffered the consequences, although it's hard to make the argument that he had a snowball's chance regardless of who he chose as his VP nominee.
McCain is actually having it prety good right now compared with what is likely to happen when the GOP convention is done. He's got another two nights of a convention where everyone is relentlessly on message extolling Palin's virtues. Once that is done, he will have a tougher time keeping the troops in line in defense of this disaster.
McCain will have to choose between the steady drip...drip...drip of ongoing revelations about Palin's quirky background, partisanship and extremism or he will have to dump her and accept the consequences of his first choice being a bad one. Either way, it reflects badly on him.

Unsurprised
"No Surprises From Palin, McCain Team Says"-Washington Post
Senior McCain officials described themselves as "unsurprised" today as huge storms of locusts flew from Wasilla, Alaska and descended upon McCain campaign headquarters. "Locusts were vetted. Locusts were vetted in the vet" said one campaign official, who spoke without attribution out of concern that he would be devoured by a verminous flying cloud. The campaign also said that they were nonplussed by reports that the rivers were running black with ashes, that family pets were begin to speak in human voices, declaiming "Release Sarah!", and that a huge spreading stain was beginning to blot out the Northern sun. "Vetted" said the campaign.
"There are exciting new studies that show that locusts can be used as a source of biodegradable fuel" said Newt Gingrich, as he hunkered down to avoid the black marble obelisks falling from the sky around him. "Palin, if she can be said to have played a role in bringing about these new biofuel resources, should be praised for her innovative role in the solution to our future energy demands".
"These events firmly demonstrate Palin's deep connection to traditional modes of traditional expression, in traditional forms, traditionally." said William Kristol, editor of the Weekly Standard. "Experience, in the face of these more traditional events, is overrated..." continued Kristol, before ending the interview to wrap himself head-to-toe in mosquito netting and swallowing a bitter tasting anti-malarial drug, the taste of which, as his lips contorted, he noted to be "surprisingly refreshing."
Palin's schedule in the upcoming days of the Republican National Convention has been cut short due to, as one McCain communications aide reported, a desire not to "let the magic out of the bottle too quickly." "Sarah is a precious resource, who each moment brings a new vitality and energy to every worker on the campaign" said the aide, while fighting to remove the nest of serpents which had suddenly materialized on the floor beneath him, and were now slowly ascending his legs. "Do these bite, or just slink?" asked the aide, who spoke on conditions of anonymity so as not to provoke or otherwise alienate the reptiles.
Meanwhile, as the heavens darkened, the seas began to boil, and a voice tore through the clouds shouting, in deep, stentorian tones to one and all: "It was a Mistake!", campaign offices described themselves as "unperturbed". "Serpents materializing, house pets suddenly called to vocal advocacy, Celestial callings to revise and repent...Vetted" said the spokesman, speaking on condition of anonymity as he was turning into a pillar of salt. "Everything that was vetted was vetted in the vet."

Here's the ad I want to see: "Sarah Palin - a new kind of politics? In her home state of Alaska, she is accused of firing officials without cause, and replacing them with political cronies. Now, she is refusing to cooperate with an official state investigation into her abuse of power - unless it is turned over to a panel of her own, hand-picked political cronies. Sound familiar? To have so little respect for her daughter that she'd be willing to subject the girl to this just so she can get ahead is callous. Nobody is bringing Palin down but herself with every misstep she makes. Better she do it now than when she's behind the doors of the oval office. She's a very scary person.
I feel like I'm watching the PBS series "An American Family" from 1973. Dig a little deeper in this family and you're going to find some serious dysfunction. There is another problem here. The personnel board can review conduct of, er, personnel, not elected officials--which is why it is an appointed board. So they could look into Monegan's conduct and find reasons for his firing. What they would not be able to do is to look into the administration's ethical lapses, which is what this investigation is supposed to look into. So, it's not just that the board is completely partisan, but they also don't have the authority to do anything on the issue.

Yes, this must be pursued but here's what I fear (and I apologize for being off-topic): Tonight, the 3 also-rans will act as the HatchetMen for McCain, ploughing the ground by savaging Obama. Palin will follow all she is expected to do is make a good speech (sound familiar?). Not real likely she will forget how to read a teleprompter.
I am afraid that the expectations for Palin are being set so low that all she needs to do is make a nice presentation, appear intelligent and likable, and the MSM (buffeted, of course, by McCain) will declare her an Unqualified Success. From what I've seen (admittedly quite little), Palin does indeed make a good appearance in speeches and she will very probably come across as the Feisty And Sharp Alaskan Soccer Mom she claims to be. The bar must be set much higher than that. We needn't be churlish, we can give her her due as a FASASM without agreeing that she has past The Test for vice-president. Her qualifications (or lack thereof) will be unchanged after she walks off the stage tonight. We'll see how she handles direct substantive questions after the convention ends. Until she handles that kind of scrutiny, her speech tonight is just that. A speech. If she does well, give her her props but keep the jury out. After all, we are now considering her as Vice-President of the U.S.

She was reportedly warned by McC (or his people) that her family's privacy could not be protected which, of course, meant that her daughter's situation would be national (and international)common knowledge.
Nonetheless she decided to accept the McC offer (reportedly without discussing it with Bristol beforehand).

UNBELIEVABLE ! Does anyone read the links provided in this article????? "...her lawyer is now demanding" the matter be heard by the state personnel board. First - "her" lawyer - which lawyer would that be? Not one hired personally by Palin, but the one hired by "the state" to represent the Governor. Now --- the "demand". Read the link. Palin has filed an ethicx complaint AGAINST HERSELF so that the matter can be heard by the entity created by STATE LAW (read the Ethics Disclosure Form submitted by the Governor's lawyer). She is entitled by state law to have the matter reviewed confidentially. Instead she has requested that the matter be handled publicly (read the Disclosure Form). Next: the lawyer "demands" that the matter be heard by a personnel board "whose members were appointed by the governor herself" - so says the article above. Read the link !!!!! It says nothing of the kind. What it says is that the lawyer asked that the matter be heard by the board ----- whose members are appointed, under state law, "by the [Repeat -- "the") governor. The members of the personnel board were appointed by Palin's predecessor - she didn't appoint them. Although she did reappoint one. People !!!! Look at the man behind the curtain. Pay attention to the manner in which you are being mislead by innuendo and distortion. What a sad commentary.

It's all a delay tactic. As for the central contention that the legislature doesn't have the right to investigate the matter:
Rule #1:
The Alaska constitution provides for impeaching such as the governor. Impeachments are conducted by the legislature. In order to impeach, the legislature must first investigate. And it can deligate the investigation authority to a committee and or individual to do so.
What Palin wants is a conflict-of-interest-based whitewash. She also wants to distract away from legislative authority to "executive experience".
The move itself shows -- conflict-of-interest anyone? -- shows corruption. Moral turpitude, itself grounds for investigation and or impeachment.
