Conyers On FBI ACORN Probe
Below is a letter sent by Rep. John Conyers (D-MI), chair of the House judiciary committee, to Attorney General Michael Mukasey and FBI director Robert Mueller, in reaction to the news that the FBI has launched an investigation into ACORN in connection with its voter-registration activities.
In raising questions about DOJ's motives, Conyers makes the obvious link to the U.S. attorneys scandal, in which several U.S. attorneys were fired for not pursuing voter fraud cases with sufficient aggressiveness. And he makes the point that John McCain had raised the ACORN issue in last night's debate.
Here's the letter:
Dear Mr. Attorney General and Director Mueller:
It is with shock and disappointment that I read today's Associated Press report that the Federal Bureau of Investigation has opened and leaked an investigation into whether ACORN, a longstanding and well regarded organization that fights for the poor and working class, is involved in nationwide voter fraud.

As an initial matter, it is simply unacceptable that such information would be leaked during the very peak of the election season. Such leaks of information about ongoing criminal investigation matters are always inappropriate, and likely violate the provisions of the U.S. Attorney manual governing release of information about ongoing investigations (and which, in any event, would require approval from the responsible U.S. Attorney or Department division before release1). More significant in this case, however, they also run afoul of valuable Department traditions regarding the need for cautious and sensitive handling of election-related matters during the run up to voting (or, as here, while early voting is underway). Indeed, I note with dismay that this sort of release likely would have violated the traditional principles stated in the Department's Election Crimes Manual, such as the requirement that prosecutors "must refrain from any conduct which has the possibility of affecting the election itself," and that "most, if not all, investigation of an alleged election crime must await the end of the election to which the allegation relates," but those provisions were removed by the Department in May 2007 as the U.S. Attorney controversy was unfolding and it was learned that former U.S. Attorney Brad Schlozman had apparently improperly brought enforcement action against ACORN volunteers during the run up to the 2006 national elections.
Moreover, this news is all the more troubling in light of the proven wrongdoing at the Justice Department in the United States Attorneys scandal. As you are aware, there is extensive evidence that political operatives improperly pressured United States Attorneys to investigate and prosecute spurious claims of vote fraud in close proximity to an election. When some did not, they were terminated. Thus, one must view the timing of this extraordinary leak with added suspicion, given that it comes less than 24 hours after the Republican Presidential candidate raised these allegations in a nationally televised debate.
I know that it has become a right-wing cottage industry to cry wolf over alleged "voter fraud" during an election season (only to have such claims evaporate after the election has concluded). Indeed, using superlatives that would make P.T. Barnum blush, Senator John McCain, the Republican Presidential candidate, said in the debate last night, that ACORN "is now on the verge of maybe perpetuating one of the greatest frauds in voter history in this country, maybe destroying the fabric of democracy." One would hope the Justice Department and FBI would more skeptically examine such sensational accusations than some cable news outlets. And this is particularly true where the allegations, even given their fullest reading, simply do not support such alarmist and unreasonable claims.
The facts as I understand them are these. A longstanding and well regarded organization that fights for the poor and working class has come under partisan fire for its voter registration acitvities. This organization has registered more than one million voters. There are allegations that some paid workers essentially cheated ACORN by filling out registration forms with bogus names and incorrect information. This of course would have harmed ACORN since ACORN pays to register potential voters, not phantoms, but - critically - does not deprive any person of their own right to vote or result in any unauthorized or fraudulent votes being cast. As one expert in this field has explained, "Mickey Mouse may show up on a registration list, but he's not likely to vote."
Furthermore, despite a long partisan campaign to stir up fears regarding so-called "voter fraud," they have been unable to produce any credible examples of meaningful fraudulent voting that could have a tangible impact on any election. Just this week, in fact, the Republican Governor of Florida, Charlie Crist, said - with respect to his state - that such allegations are "less than is being discussed" and ascribed these types of allegations to "some who enjoy chaos." Similarly, the Republican Secretary of State has indicated that he does not believe that ACORN is engaged in systematic voting fraud. Indeed, such allegations repeatedly dissolve under fair scrutiny.2
At the same time, numerous allegations have emerged that political operatives are engaged in supression of eligible voters and this activity has apparently failed to receive the intense attention that the federal government is now reportedly devoting to ACORN. For example, there are reports that the chairman of the Republican Party in Macomb County, Michigan, a key swing county in a key swing state, has planned to use a list of foreclosed homes to block people from voting in the upcoming election as part of the state GOP's effort to challenge some voters on Election Day. Additionally, the Columbus Dispatch reports that the Ohio GOP in Franklin County, "has not ruled out challenging voters before the election due to foreclosure-related address issues."3
Accordingly, I condemn the leak of this sensitive information and remind you both of your and your agencies' obligations to handle election-related matters in an appropriate and non-political matter as the election season proceeds. In addition, please let me know no later than Thursday, October 23, 2008, if the release of information and all other actions taken regarding this investigation are consistent with the US Attorneys Manual and the Election Crimes Manual and, if not, what action has been taken in response. I am glad that the FBI and the DOJ are investigating. You all seem to forget "the sore losserman election" Please, I think it is important to warn people that if they commited fraud not to come and cast the vote! I want the will of legelly registered voters to prevail and I think people knowing about the investigation will only go to prevent people who are convicted felons or fraudualantly voting from turning out and that is a good thing. To allow someone to steal an election is the most dispicable thing.

Great thought, though no charges have been brought. Is it then ok to disenfranchise voters who are largely Democratic?
In a related case in Ohio, the league of women voters showed 4 fraudulent voted in over 8,000,000 votes or 5/10000% BFD!

Do you not follow this at all? The people who committed fraud were the ACORN employees who defrauded ACORN by turning in fake registrations. No voter committed any fraud. That's why despite an intense effort the DOJ can never find it.

One of the problems with the FBI is that they had to announce a full investigation was being conducted. The FBI usually does not announce its investigations that are underway, so it seems obvious that politics played a part.

I'm very glad Conyers mentioned the leak. They don't announce investigations unless they're primarily political. Reporters usually have to ferret out that information.

I am just thankful that the Democrats control Congress, and that John Conyers is Chair of the Judiciary Committee.
Because we all know just how much credibility Republicans and conservatives have when it comes to expanding the franchise for minorities.

BTW, Fraud requires intent, legally, which is why almost no one is ever indicted.
Last thing: Los Angeles County issues no recognition that you have successfully registered, nor does it provide a website where you can confirm it. Most people who register/re-register several times do it because no one ever tells them their registration arrived and was accepted.

The point is....John Conyers wrote a book about this GOP (vote scam) tactic..and did nothing else...we (the base) has been screaming about this for years and the Democratic Leadership has been covering Bush and his buddies asses, for eight years...we have begged, we have signed petitions, the Iraq and Afghanistan Vets (against the War) has met with Conyers..but Conyers, Pelosi, Reid, Hoyer (and all the GOD damned blue dog traitors) have seen no evil, heard no evil and would not "speak" evil...they sat on their damned complacent asses and watched their stock portfolios grow fat, instead of performing their duties (crying and wringing their hands in pity for themselves and their country)...these Democratic Congressional deadbeats should all be run out of Congress along with their buddies, the GOP crooks and liars...(just goes to show..it doesn't matter to them as long as they can collect a paycheck, give themselves a raise, get free medical and travel at our expense) they are the "untouchables"

Another major failure of yours, Conyers, in failing to conduct oversight and hearings on the DOJ and FBI for voter fraud and suppression activities...just like it did happen in 2004 to Kerry..What have you fucking accomplished to protect this election?...Shame on you again, Conyers...Frankly, pathetic job and I hope Obama's election and leadership will shove your ass out of this critically important chair of the HJC.

I think it's safe to say that when it comes to Conyers, Leahy, Pelosi & Reid, their bark is much worse than their bite. They have proven themselves totally ineffective leaders and hopefully will be replaced in the next Congress.

I commend Conyers for sending that letter. It had to be done. Unfortunately, such letters are supposed to be preludes to actual action that will discourage criminals from committing further crimes. That part is something Conyers hasn't learned to do yet.
The good news is that Mukasy and his gang will be jobless in less than 3 months. Let's hope the Mafia will allow them to run the numbers in some city big enough for them to feed the kids.

Shall we be realistic here? Who is going to become engaged in a job requiring manning a folding table armed with a clipboard and forms, or trundling through neghborhoods, perhaps attempting to persuade total strangers at their front doors. I imagine two sorts, though I'm sure there are many others.
One would be an enthused activist who believes in a mission...not likely to be pulling fraudulent names out of their rectums for counterfiet registration. They want genuine achievment of a goal. The other, part time shlubs who don't give much of a rodents behind. Will they fudge seriously to get a few bucks. I have no doubt.
I doubt there are serious criminals plotting to dismantle the fabric of democracy through bogus registrations in impoverished, minority communities.
Those who are determined to rend the fabric of Democracy in this populous nation would have to go much more big time than that. Voting machine fraud, for example. Massive voter suppression. Blanket elimination of legitimate ballots in unfavorable districts and so on. And indeed, "cottage industry" would fall lightyears short of the syndicated effort that would be applied.
However, we've yet another sternly worded letter shot out like a rocket. No doubt the recipients are reeling from such a rapier blow.

Right on,Walrus,but I think even their bark isn`t much either,and they have no bite at all.
Pelosi is waiting to put impeachment on the table because she wants to see evidence of a crime. In Kucinich`s Thirty Five Articles for Impeachment of George W.Bush,Pelosi might find what she is looking for.As for Reid,Leahy, and Conyers; they remind me of the characters in W.C.Field`s movies who always roar:"This is an outrage,"yet they never seem to do anything about the outrage.
