GOP County Chair v. Michigan Messenger: The Complaint
Last week, the chair of the Macomb County Republican Party in Michigan filed a defamation suit against the Michigan Messenger, over a story in which he is quoted as stating his party plans to challenge voters whose names and addresses appear on foreclosure lists.
We got our hands on a copy of the suit, and we invite you to take a look. We'll be continuing to bring you updates on this story as it develops.













Meh. Possibly a tactical move if the Obama suit is based on this, as it alleges: muddy up the premise of the main lawsuit by filing another one. Otherwise, nothing to see here.
Yes, this is how lawyers spend their days. Sigh.

I certainly do hope there's a tape, or even clearly contemporaneous notes. That could be fun.

The plaintiff would have a strong case if they included, in the complaint, a copy of the transcript proving the statements were false. The failure to include in the complaint a copy of the transcript substantially undermines plaintiff's legal position. When someone is a public figure, they cannot merely assert something is a fabrication, but have the burden to prove the statement is a reckless disregard for the truth. The complaint appears to be accusatory without adequate proof.
