Republican Voter Suppression: A Guide

There are so many Republican gambits designed to make voting more difficult -- specifically for Democrats, of course -- that it can be hard to keep track of them all. So here's a handy -- and by no means comprehensive -- guide to what's happening in some of the key swing states.

Ohio
The U.S. Supreme Court earlier this month denied a bid by the state GOP to force Democratic secretary of state Jennifer Brunner to provide local election officials with lists of new voters whose registration information did not match that on other government documents. Voting-rights advocates had feared that making Brunner hand over the lists could lead to a slew of GOP challenges, forcing hundreds of thousands of voters to cast provisional ballots. Republican leader (and Ohioan) John Boehner -- with help from the White House -- has asked the Department of Justice to step in, but few observers expect DOJ to take any action so close to the election.

New Mexico
The state GOP earlier this month held a press conference at which it released the names of 10 voters it said had voted fraudulently in a Democratic primary in June. After ACORN helped established that the voters, almost all Hispanic, were in fact legitimate, TPMmuckraker and others reported that GOP lawyer Pat Rogers apparently hired a private investigator, who intimidated some of the voters by going to their homes to question them about their voting status. Rogers, the P.I. and the state party are now being sued for voter intimidation by several voting-rights groups.

Indiana
The Lake County GOP sued to shut down early voting centers set up by the county election board in Democratic-leaning cities in the northern part of the county. A judge declined to shut down the sites, though an appeal is scheduled to be heard later this week. But in the meantime, early voting at the centers has been proceeding. In addition, the Republican secretary of state, Todd Rokita, has called on law enforcement to prosecute ACORN for submitting 1400 suspicious-looking voter-registration forms in the county.

Nevada
The chair of the state GOP wrote to Democratic Secretary of State Ross Miller, asking him to require newly registered voters to cast provisional ballots if they correct mismatches in their voter information at the polls. Miller responded with an interpretation of state law that rejected the GOP's request.


Pennsylvania
The state GOP has filed a lawsuit designed to cast doubt on 140,000 voter-registration applications submitted by ACORN in four counties. Among other things, it would require the state to provide additional provisional ballots in the counties at issue. Democratic Secretary of State pedro Cortes has called the "frivolous", saying it's designed to undermine confidence in the system. The court has not yet ruled on the suit.

Montana
The state GOP announced earlier this month that it was formally challenging the eligibility of 6,000 people in Democratic-leaning counties, based in discrepancies in their addresses. After it emerged that among the challenged voters were a World War II veteran who had moved across town that year, and a member of the Army Reserve about to ship out to Kuwait, the move was condemned even by some prominent Republicans in the state. The challenge was withdrawn, and the man behind, it, Jacob Eaton, the party's executive director, quit.

Florida
In early September, Secretary of State Kurt Browning, a Republican, instructed election officials to reject voter registration applications that do not pass a computer match test. Voter rights groups say the system can disqualify voters based on nothing more than a missing middle initial on their voter form, and that the late date of the order could cause additional confusion. They fear the move could disenfranchise tens of thousands of legitimate voters. And in a rare case of a Republican making voting easier, Governor Charlie Crist yesterday ordered extended hours for early voting centers, after long lines were reported in many parts of the state.

Wisconsin
Republican Attorney General J.B. Van Hollen filed suit against the state's election board, demanding that it confirm the eligibility of tens of thousands of new voters. In a recent interview with CNN, Van Hollen admitted that the GOP "may have asked lawyers in my office to file the lawsuit." A county court threw the suit out, but Van Hollen soon announced the formation of a "voter fraud task force", which would involve stationing 50 state prosecutors and other law-enforcement agents at the polls on election day, a move state Democrats have denounced as an effort to intimidate voters.

Colorado
A voting-rights group, filed a lawsuit against Republican Secretary of State Mike Coffman, alleging that over 35,000 voters were purged from the rolls illegally. The suit, which was heard in court today, claims that voters have been removed from the rolls based on a faulty system for identifying illegitimate voters, and within 90 days of the election -- both of which violate the federal Voting Rights Act. Coffman, who is running for the U.S. Congress in this election, denies that any rules were broken.

Hey, where's Wisconsin? Our A.G. has tried hard to scrub the voter lists, but was blocked in his efforts. Surely that deserves inclusion. The WI GOP's quest for voter ID has not stopped either, nor, I predict, will it after this election. If anything they may have a tiny shred more to go on.

Please, would someone explain how citizenship is established by a driver's license or social security data base? I use various SS data bases in my work and do not recall citizenship info; my driver's license has nothing on it about citizenship. pm

In VA (Hampton Roads) a flyer has gone out telling all registered dems to vote on Wednesday 11/5 in order to ease congestion at the polls. I've also had friends receive bogus letters in the mail telling them that their registration is invalid.

Hm. Don't these deviants that pass out fliers reminding people to vote on the wrong date qualify to be prosecuted individually as much as any political party should they be caught red handed as such would be clearly 'voter suppression tactics'?

There needs to be a strong, coordinated effort to push back against these efforts since I'm not sure how much legislation can actually prevent such things from happening. Maybe a war room website where those that have this happen to them can report it immediately. With surveillance capabilities by the common man so ubiquitous these days with everyone carrying around a camcorder phone, activists can be encouraged to post any pictures or video they catch of the people passing such fliers out.

I am asking people to write the new networks that cover the election and ask them to report the total of provisional ballots along with the regular voting results. We need to be informed as to how many voters have been pushed on to provisional ballots and we may need to wait for some of them to be counted in this election.

You should add Georgia to the list. Here is the latest information via Daily KOS:

As kos noted yesterday, Florida Governor Charlie Crist extended voting hours in that state, citing huge early voting lines and waits of up to five or six hours in some areas.

But in neighboring Georgia, Secretary of State Karen Handel is refusing to do the same. On Monday, some voters waited eight hours to vote because of machine glitches. There were other reports of voters waiting an average of three to four hours to vote in heavily Democratic and urban areas.

In response to a request from the state Democratic Party to extend voting hours in light of these long waiting times, Handel said no:

Handel said Georgia law includes no such mechanism that would allow her, or Gov. Sonny Perdue, to do it.

Handel also said she doesn’t think it’s necessary, and called Kidd’s letter emblematic of an "orchestrated effort of that political party across the country."

Handel is referring to the fact that Georgia law apparently "doesn't allow for voting on the weekend or the Monday before Election Day." But that second comment, blaming Democrats for politicizing the situation?

That's Handel still smarting after been slapped silly by the courts yesterday for her attempted purging of the voter rolls:

ATLANTA (AP) — Georgia should have sought U.S. Justice Department approval before implementing a new process of using Social Security numbers and driver's license data to check voters' immigration status, a three-judge federal panel ruled Monday.

The 27-page ruling ordered Georgia election officials to make "diligent and immediate" efforts to notify voters flagged as ineligible because of the checks that they can still cast paper ballots on Nov. 4. The paper ballots can later be challenged by state officials if a voter is believed to be ineligible.

The state also is not allowed to remove names from lists unless voters say in writing that they are ineligible.

Will the Georgia Democratic Party take its request for extended early voting hours to the courts? We'll see.

Great analysis of voter suppression efforts by state. How about a similar analysis of voting machines (which vendors have provided the machines in which counties/states), so we can be ready if results are significantly different from polls or registration numbers?

You can tell Oregon has the best voting style in the country because there are no suppression efforts in our state. Vote by mail should be the standard in all states in this country and not these long lines and corrupt local officials and voting places. It also enables people to vote on their own time, not during the week days which I'm sure republicans also feel helps their turn out since more democrats are hard working families and might be less likely to make it to the polls on a Tuesday.

Great Work! Keep after em'! Don't let up after Tuesday, either, a spotlight should shine on these shenanigans long after the election.

It's already a crime to suppress votes, just howmany of these schemes cross thaose lines only matters if someone enforces those laws.

It will no doubt be the 111th Congress that takes up that cause, Bush isn't likely to sic his DOJ on the Culprits(R), so keeping track of the guilty parties and their crimes, and tracking them long after the election is over, might one day help facilitate thier date with Ms. Justice.

GOP election lawsuit headed to federal court

An Illinois Republican Party lawsuit seeking to prevent thousands of Lake County ballots from being counted on Election Day is headed to federal court.

At a brief hearing today in Lake County circuit court, GOP representatives wanted Associate Judge Mitchell Hoffman to deliver a quick decision on the lawsuit, which the GOP brought Tuesday against the county clerk's office and Citizen Action/Illinois, an activist group in Chicago.

According to the suit, the GOP is concerned about voter registration fraud based on evidence uncovered by the clerk's office.

What I've never understood about Republican voter suppression is that you have to figure 20 to 30 percent of their efforts actual suppress Republican voters. Where's the outrage from their own party? Or are they just good soldiers and suck it up?

Thanks for this valuable tool. It seems to me this is a concerted and organized national effort at voter suppression. I suspect the perpetrators did their homework and thought they could cover their tracks by utilizing persons third-, fourth- or fifth-degrees removed to act as their agents of suppression. Obstruction of justice at least. Aren't there some federal laws that should be applied here? RICO?

In Kern County in California, Ann Barnett, the highly televised county clerk who claimed to lack funds to provide magistrate services for "gay" marriage, simply holds back on sending out the ballot to absentee voters until it is too late. I received my sample ballot last week here in Europe with instructions on how to GET an absentee ballot. Fortunately, I started the process of getting my ballot in August, and handled the matter by fax with a different person in her office a month earlier. I had already voted by the time my sample ballot arrived.

"The City of Milwaukee Election Commission dismissed a last-minute voter registration challenge by a Republican Party activist tonight that could have affected some 1,000 voters who have already cast absentee ballots in person.

"The complaint sought to disqualify the ballots of voters who registered and cast in-person absentee ballots during a time period in which voters did not have to show proof of residence to register.

"The complaint was brought by Marilyn Kruchell, chair of the West Milwaukee/West Allis branch of the Milwaukee County Republican Party."

This all stems from the "Help America Vote Act" of 2002 (42 USCA 15483 for you law nerds). It was passed with a resounding majority in the Senate and House...so both parties suck. yes, the Reps are enforcing it...but uh, it's a law and they can legally attempt to enforce it. (But not within 90 days). So yes, Reps are breaking all kinds of laws by attempting to enforce HAVA so close to an election, but the underlying claims are valid. We need to repeal this law ASAP after Obama wins and the Dems gain a majority.
Things that make you scream about HAVA:
1. Need your voter registration application to exactly match the info on the DMV records and your SS# to exactly match.
2. If you don't vote in two elections, and the state contacts you to ask if you still live at XYZ address and you don't respond...you are taken off the registered voter list. That's right...don't exercise your 'right' to vote, and you lose it.
3. If you've never voted before, you must bring to the voting booth either a current driver's license or matching last four digits of the SS#. Oh, a clerk entered it into the machine wrong? TOO BAD NO VOTE FOR YOU!
4. If you don't have a drivers license you can "prove" who you are by a copy of a current utility bill (sorry renters!); bank statement (sorry poor people!); government check (sorry non-government employed people and those NOT collecting entitlements!); a paycheck (sorry unemployed or employed and already cashed your check before voting day!)
So who does #4 disenfranchise? The poor. The homeless, the unemployed and renters.

you can cast a provisional ballot if your info does not match. However, studies have shown that only 65% of the provisional ballots were counted, and the other 35% were not. No one knows on what ground the 35% were rejected.

This is your law. We need to change it, or better yet, repeal it.

The effort some will go to prevent people from voting is unreal. These problems will continue as long as the US has partisans in charge of the voting process. Thanks for doing this.

Georgia should be toward the top of your list! After sending 2 million names to the Social Security Administration for accuracy checking (that is, excuse to purge), our Republican Secretary of State defended her actions on CNN a few days ago by saying, "We need to have checks and balances in the voting system". First time I ever heard checks and balances used in this way! Back to Civics 101! Of course, Republicans love to talk about spreading democracy around the world, but use every opportunity to suppress the vote here.

Remember this is not just a Presidential election...many of these states have Senate and House seats up for re-election as well as the state's Congress..the GOP MIGHT be conceding the Presidential election...but they are trying their damndest in an innocuous way to control future legislation and judicial outcomes......no matter who is President
