Results Of DOJ Probe Into Siegelman Prosecution To Be Released In 'Near Future'

We may be getting some answers in the saga of former Alabama Gov. Don Siegelman sooner rather than later.

DOJ's Office Of Professional Responsibility expects "in the near future" to complete its probe into allegations of politicized prosecution in the Siegelman case, according to a letter from the DOJ sent to Rep. John Conyers (D-MI) yesterday. The letter also reveals that the OPR is looking into the allegations of improper communications between jurors and members of the prosecution team during Siegelman's trial.

At issue are charges made by a whistle-blower, who worked in the U.S. Attorney's office in Alabama, that were first publicly reported in November after Conyers sent a letter to the DOJ about the matter.

Emails provided by the whistle-blower suggested that U.S. Attorney Leura Canary -- whose husband was a top GOP operative and Karl Rove associate -- continued to be involved in the case after recusing herself. Other emails suggested inappropriate contact between jurors and the prosecution, including expressions of romantic interest by jurors in an FBI agent on the prosecution team.

In an interview with TPMmuckraker last month, an outraged Siegelman called it "astounding" that the alleged impropriety involving the jury had not been revealed to the judge and the defense. There has long been evidence that Siegelman's prosecution on corruption charges was politically motivated.

It was back in July that the DOJ publicly acknowledged the existence of an OPR investigation into whether the prosecution was "selective and politically motivated."

The letter sent to Conyers yesterday gives us a fuller picture of the OPR probe.

In the letter, Principal Deputy Assistant AG Keith Nelson confirms that the OPR is looking into the jury issue and into "whether United States Attorney Leura Canary complied with her recusal from the case." The letter continues:

We have confirmed that OPR is aware of the e-mails you forwarded, and we expect that they will evaluate the significance of those e-mails in the full context of the prosecution. We understand that OPR expects to complete its investigation in the near future.

The letter also notes that a separate DOJ investigation into the case -- which was begun at the behest of the Office Of Special Counsel and was recently reopened -- remains in progress. Arguments on Siegelman's appeal of his conviction were heard earlier this month.

I have no confidence than any part of the current DOJ will do anything but cover-up for Rove-Bush and company.

There is no double jeopardy issue here, so if this DOJ fails to indict, the matter can still be prosecuted by the next DOJ. This the type of rap for which we all want to see Rove tried and imprisoned. Only snag would be a pardon by fratboy.

More evidence that the Obama Administration should run a furlough extensive enough to get rid of all federal employes hired within the last 8 years.

In addition of getting rid of all the radical religious nutcake moles put in place by the Bush Administration, it would go a long way toward balancing the federal budget.

When will Congress, and politicians in general, learn that deficit financing leads directly to bankruptcy?

I expect soon-to-be AG Holder and the Obama DOJ - to re-investigate Everything about this case.

I expect the results then to be that many people end up in JAIL - ignoring the 'partisan thing' that the repugs will use to play victims.

People need to go to Jail over cases like this - because this crap was used to subvert the Election process. A Governor's seat was lost because of this kind of bs.

Obama DOJ - put people in jail so they stop corrupting elections.

Folks this is an attempt to provide a Bush Admin perspective:The Obama DOJ should do their own investigation.Mukasey was unresponsive,on whether the DOJ will look into Don Siegelman's case, now they are going to issue a report.This is to perhaps cover his own ass, Mukasey,& provide a soft landing for Rove & the WH.Shameless to the end.

The deceased is the man who routed all Ohio 2004 election returns through the same server in TN used by the RNC, prior to their certification in Ohio. He also set up the routing of sensitive White House internal email communications through RNC email accounts for storage on RNC servers, millions of which have been "lost".

Tyranny, treason, capital offenses. Do not sleep, my fellow citizens. Do not think the too preposterous could not have happened. Demand the truth, for it could happen again.

You may be pushing it a bit. Many of us assumed when Bush was selected in '00 that he'd move too far to the right and that the pendulum would swing in the Democratic direction in '08 . Still, if anyone had predicted then the structure that the GOP has created over the past eight years, I certainly would have considered the prediction preposterous.

But Congress has allowed the power of the presidency to grow over the past century. Bush/Cheney/Rove/Rumsfeld was just more grasping and obnoxious than most administrations in pushing the envelope. Our government has become a corporation with a board of directors and CEO. One branch can now effectively create money, control the flow of information and wage war. Obama is unlikely to surrender any of his inherited prerogatives, but it will be fascinating to see how he uses them.

My question is how far will an Obama administration be willing to walk back the increased powers claimed by the Bush malAdministration.
