Leahy and Specter At Odds Over Holder Confirmation

Trouble in paradise?

Pat Leahy and Arlen Specter, the ranking Democrat and Republican respectively on the Senate Judiciary committee, have had a relationship over the years that, on the whole, has been a model of bipartisan comity as they've passed the gavel back and forth.

But are they falling out over Eric Holder?

In a speech on the Senate floor today, reports The Hill, Specter expressed surprise that Leahy, the committee chair, had scheduled a January 8 kickoff for Holder's confirmation hearing for the Attorney General job. Barack Obama is scheduled to be sworn in January 20.

Specter cited concerns about Holder's role in the pardon of Marc Rich in the
waning days of the Clinton administration.

"We need to be sure the attorney general does not bend his views in any way that is partisan or political," Specter said. "There are many other matters that warrant inquiry."

Given the amount of material to go through, Specter said, the hearings should not begin until January 26 at the earliest.

The speech followed a letter sent last night by Specter to Leahy.

In response, Leahy just now fired off a letter back to his longtime colleague -- "Dear Arlen", it begins -- expressing surprise at Specter's surprise.

Leahy writes:

As I have said repeatedly from the time reports of his likely designation began appearing in the press in mid-November, I thought we should move promptly. It hardly came as a surprise when the President-elect announced that Eric would be a key part of his national security team at the designation announcement on December 1. My recollection is that your initial reaction on November 18 was that you were at that time already reviewing his record. Of course, Eric is someone you and I both know well and have known and worked with for years.

Leahy also cites historical precedent to argue that the timing of the hearings is not unusual:

After the contentious 2000 presidential election, I also proceeded promptly to hold the hearing on the designation by President-elect Bush of John Ashcroft to be Attorney General. John's designation was not formally announced until December 22, but I held his hearing 25 days later. I do not think President-elect Obama should be penalized for proceeding promptly with transition and designating his Attorney General selection three weeks before President Bush had.

I am sure you recall during your first year in the Senate how promptly Chairman Thurmond proceeded on the designation of William French Smith to be Attorney General at the beginning of the Reagan administration. The Committee completed its consideration of President Reagan's lawyer to be the Attorney General of the United States with a vote on January 16, even though he was not designated until December 11. We have known about Eric's designation officially for 10 days, and unofficially for more than three weeks. The Committee would have to vote on January 6, the first day of the new Congress, to approximate that timeline.

President Carter's first Attorney General, Griffin Bell, was not designated until December 18, yet his hearing and Committee consideration were completed by January 19. Approximating that timeline would have the Committee voting before the new Congress even comes into session.

Leahy even brings up past favors he has done for Specter:

I have sought to accommodate your interests on many occasions. I scheduled field hearings for you in Pennsylvania on foreclosure and health care mergers issues, and worked hard to ensure fair treatment and confirmation for nominations in which you had a personal interest.

Did anyone else see the second part of this statement: "We need to be sure the attorney general does not bend his views in any way that is partisan or political, there are many other matters that warrant inquiry." as signalling not that Holder warrants inquiry but that Specter is fearfully aware that Holder will be handed a pile of politically incendiary files that target Bush and the Repubs?
It's hard to make sense out of the complete statement in any other way than to think he's playing scared for himself or someone else who pays.

They should have been this concerned with the Alberto Gonzales nomination, or the Rumsfeld nomination or any number of federal judgeships that were set aside for lunatics. It doesn't really matter to me about the Mark Rich pardon. The bottom line is that Clinton ultimately pardoned him, not Holder.

I'm fine with this. Specter is on record, right now, as having serious concerns about the abuse of the power to pardon. Now let us see what he does after Bush exercises his pardons.

I think this will go away once we get the Bush pardons. It's real simple--threaten to investigate what will obviously be controversial pardons made by Bush if Spectre makes a big fuss over Holder.

"Yet another federal investigation. From USA Today:

The FBI is investigating whether a member of Sen. Arlen Specter's staff broke the law by helping her husband, a lobbyist, secure almost $50 million in Pentagon spending for his clients, the senator acknowledged Tuesday.... The federal probe stems from a February report by USA TODAY about Siegel. Specter helped direct $48.7 million in Pentagon spending over the past five years to clients of her lobbyist husband, Michael Herson.

Specter has acknowledged he used his position on the Senate Appropriations Committee to put special-interest language in Pentagon spending bills directing the money to clients of Herson's firm, American Defense International.

Specter says he didn't know of the link to Siegel, who was one of his top advisers on spending issues until last fall."

This morning, Roll Call reported that the FBI reviewed Specter's financial disclosure records this past April.

Spector most certainly did know who Michael Herson was. Vicky Siegel Herson, the top advisor and senior aide referred to in this story, was married to him for seven years before this story broke. Plus Herson ran for Congress in a New Jersey shore district in the early '90s and he was an intern in the Reagan administration.

I looked into Herson's somewhat checkered past and I'm very surprised the FBI dropped the case.

Herson built a pretty decent sized lobbying firm doing a lot of business in the Middle East before 9/11. Another member of the firm, Jim Zumwault (the admiral's son), led the first delegation of US business ever to visit the DPRK - a delegation that included major companies such as GM and MCI.

Maybe we can convince the Honorable Henry Waxman to investigate the FBI's investigation of Senator Spector.

Specter always talks a good game. Ranting and raving about Gonzo and how inexcusable his behavior was and he has no business running the DOJ. But then it is all about lets look ahead instead of behind. WE must look forward to the future. He is a Republican, he will caucus with Republicans and many favors must be granted upon review of any new legislation before he does not vote with the Reps.
But, he will be wooed and so with the sisters from Maine. Who knows, it might work out in the end.

But either way it goes, get the Dems down there in Penn with a whole hell of a lot of money and get him out of there.

Don't stop after you comment here -- go to Specter's website and challenge him to live up to his many fine speeches about the constitution, the rule of law, etc.

He cannot be allowed to do his usual MO of caving to the right-wing idiots. Hammer him, constantly and repeatedly, and force him to do the right thing and support the hearings.

Lets search the record to see if the honorable Sen. Specter raised such concerns with the AG nominations of Gonzalez or Mukasey. Why didn’t Mukasey’s support of torture raise a red flag for Specter? Why didn’t the nomination of Bush’s personal attorney for AG raise a red flag for Specter? Its seems Specter has selective enforcement of his values

Read between the lines. Republicans are trying to make Obama look bad and Holder's the only available target (thus far).

Wow. Just wow.

The thing that really grates about this (and some of his other recent positions, e.g., FISA) is that Specter knows better. He is not just a conservative tool. He has been in Washington for a long time, and clearly understands how this should go down. Thank goodness Leahy sent him a sternly worded letter (SWL?). That will show him!

Holder also stands to reverse the damage done by the Bush DoJ to the rights of women and minorities. National Women's Law Center and others are calling today in a press conference for swift confirmation of Holder. We blogged about these issues today at RH Reality Check, www.rhrealitycheck.org.
