Wilkes Expected To Leave Prison Today, Pending Appeal

Brent Wilkes, the former defense contractor who's serving a jail sentence for bribing former GOP congressman Randy "Duke" Cunningham, is expected to leave prison today, reports the San Diego-area North County Times .

Says the paper:

On Monday, a federal judge signed the order allowing Wilkes to leave prison on bail while he appeals his conviction for the bribery of the ex-North County Republican lawmaker. As of this morning, however, the 54-year-old remained behind bars at Terminal Island Federal Correctional Institution in Los Angeles County.

This has been in the works for a while. Back in March, an appeals court ruled, in the words of the North County Times, "that his appeal raises such a substantial question of law or fact that it could lead the appeals court to overturn his conviction, force a new trial or order a punishment that would include no jail time."

As a result, the court ruled that Wilkes could leave jail while conducting his appeal -- as long as he could make bail.

For a while, he couldn't. Wilkes' properties depreciated in value thanks to the housing slump, which hit southern California hard. But on Monday, a judge ruled that properties' value was enough to ensure that he would show up for future hearings, and that he doesn't pose a flight risk.

His lawyer said in an email to the paper that she hopes Wilkes will be home with his family by tonight.

Wilkes is currently serving 12 years in federal prison for bribery, conspiracy, fraud, and wiretapping. Prosecutors argued he bribed Cunningham with prostitutes and lavish vacations, among other items of value.

I just want to say that as someone who hails from the early 19c. I deeply *deeply* appreciate David Kurtz's header for this page on the front page: "Free Wilkes."

Now would n't it be fun if we could with this new administration 's DOJ revisit some of the events that surround this bribing congresscrtitters business. Hey maybe we could depose Ted Olsen & Ms Yang as to why how come Teddy's law firm who was representing Chairman Lewis as he fended off pay to play corruption alllegations -why would Ms Yang who as seating US Attorney was investigating Lewis -abruptly quit Justice -and with a big sign on bous go to work for Mr Olsen's law firm ? Wilkes was all part of this mess-and don't forget that at about this time US Attorney Carol Lamm - who was also investigating pay to play corruption in SoCal was fired . Gee the station chief FBI San Diego also quit in protest over Lamm's removal stated in the press that he could guarentee that Lamm's being fired was politically motivated.
Maybe as part of Wilkes plea bargain the incoming DOJ can get more information regarding the apparent prid quo pro that arises out of the abrupt hiring of Ms Yang & firing of Ms Lamm-
meanwhile maybe we ought to hold Mr Olsen's passport until we get these pending depositions finished ! -

PS Wilkes also had very questionable no bid contracts with the OVP too -please remember that too incoming DOJ'ers -

I'd like to see some stats as to just how many folks making less than, say, forty thousand dollar a year are allowed out of prison while awaiting an appeal... or just how many folks making that much even appeal?

Isn't justice great?
