Here's the Justice Department's undated motion to dismiss the case, which lays out the rationale in detail, and was presumably filed yesterday or this morning.

It is unfortunate that the DOJ screwed up their case againist Stevens. Any person like Stevens, in a position of responsibility and power, knows the risk(s) he is taking when he willfully breaks the law, and especially does so over a period of many years.
I am 71 years old and feel I have earned the right to say this; Unless we are willing to offer the same mercy to an average Joe, Stevens age, his lost re-election and any disgrace he may suffer are not reasons of themselves to dismiss the charges against him nor keep him out of prison.
Try him again and throw the book at him.
