Justice Official Who Probed US Attorney Firings Will Now Lead US Attorneys Office

The Justice Department's Office of Professional Responsibility -- which has lately been in a number of internal DOJ investigations into high-profile issues -- will soon have a new chief.

The Washington Post reports that Attorney General Eric Holder will name as the head of the office Mary Patrice Brown, a respected career prosecutor who currently leads the criminal division at the US Attorney's office for Washington DC. Brown will replace Marshall Jarrett, who has been there since 1998, and will shift over to lead the executive office of the US Attorneys.

That move could create an interesting situation for Jarrett -- and may represent additional evidence that Holder is determined to avoid charges that he's replicating the Bushies' politicization of the department. One of the major OPR probes he oversaw, along with the department's Inspector General, concerned the Bush administration's US Attorney firings. The investigation, concluded last year, found that several of the attorneys had been fired improperly, but was prevented from drawing broader conclusions thanks to stonewalling by key DOJ and White House figures. Now Jarrett himself -- who figures to have little patience for efforts to use DOJ for partisan gain, having spent the last decade probing evidence of wrongdoing at the department -- will be leading the office that oversees the US Attorneys.

OPR has also just begun a probe into the misconduct by DOJ prosecutors which ultimately convinced Holder to recommend dropping the charges against Ted Stevens. Judge Emmet Sullivan, who is seeking contempt charges against the prosecutors, betrayed a lack of confidence in Jarrett's investigation when he named his own special prosecutor to look into the issue.

And OPR has also been investigating the actions of lawyers for the Bush DOJ who wrote memos justifying harsh interrogation tactics. The office's report on that issue, which has not yet been released, was reportedly modified after input from former Attorney General Michael Mukasey and one of his deputies.

So Brown will certainly have her work cut out for her.

Judge Emmet Sullivan just recently smacked down some of the DoD/DOJ lawyers that are prosecuting the Detainees for continually using the testimony of a detainee/witness that is known by some to be insane. The problem is that everyone knew the witness was insane except the Defense. The Judge said something along the lines that if this didn't get fixed, stopped, etc, that he was going to have someone arrested. He also said that person would be one of the Higher-ups. While he didn't name Mukasey or any number of those in charge of the prosecution, they might want to start their own defense funds soon.

Is it correct that also Senator Kennedy knowing, knowingly, deliberately with full intent knew and stated his US Constitutional!!!! disapproval of Mulkasey and yet voted for his US Constitutional!!! Nomination!!!! and subsequent Approval!!!! to be seated and the US Attorney General. (Please note that it appears that Senator Kennedy used his Cardinal Senatorial status to also verbally block all Impeachment endeavors (and among many other similar concerns).

Also as some weeks ago, Therap has mentioned for his (and my) hopes (as mentioned as of seemingly last resort) of the American Bar Association to take appropriate action for the prosecution and/or removal from the American Bar Association of these and many other Executive, Judicial and Legislative Leaders, et all).

Please allow me to mention this reminder that in 10/2007 the American bar Association in their Published Magazine nominated and awarded former (seemingly publically disgraced and resigned)US AG Gonzales Attorney of the year for 2007 and nominated and awarded US AG Mulkasey Attorney of the Year for 2008 in their 11/2007 Awards with runner ups of a former US President//White House seemingly disgraced and resigned and several other runner ups such as Libby and/or Rove).

Please note that it is not my intent to offend anyone and I hope TPM will allow me to apply any corrections, modifications and/or retractions as may be necessary.

Please, is someone available to get through to US President Obama, US AG Holder and others in the Executive, Judicial and Legislative Branches of our 'We the People' US Government to also remind President Obama and others of his and their written promise to our (US Constitution, False Claims Act, Illegal Signing statements, prevention of Torture, Illegal rendition,Illegal wiretaps, legal//Illegal Secrecy, the complete abolishment of the enactment of the death penalty ecetra) Whistleblowers and his written promise to support the 'FEDERAL EMPLOYEE WHISTLEBLOWER PROTECTION RESTORATION ENHANCEMENT ACT (that he has already allowed to be voted out of the current so-called Stimilus Bill and with a seemingly illegal Signing Statement).

(Also, please note and remember California AG Garcetti who properly did his job properly and as mandated by all law, rules and regulations and was retaliated upon and lost his case in our US Supreme Court).

It will be a long, long journey before justice can be expected from the Justice Department. Dismissing the Ted Stevens case because exculpatory information was withheld was the right thing to do -- defense lawyers, however, hear variations on that story (in cases involving less prominent defendants) dozens of times a year. Prosecutors with a reputation for always turning over such information in a timely fashion are genuine rarities. Cases involving senators or governors naturally hog the headlines, but it is how we as a nation treat common people that matters most. I hope Holder realizes the scope of the problem.

Whatever became of the investigation of the U.S. Attorneys firings by Mukasey appointed Nora Dennehy? I thought she was hot on the trail.
