A shadowy private security company that has no known clients but claims to have helped foreign governments combat terrorism and will protect anything from cruise ships to Pakistani convoys has taken over a jail in a small Montana town, with plans to build a law enforcement training facility on the property.

The state legislature is looking into the matter and residents of Hardin, MT, were alarmed last week when executives from the firm, American Police Force, showed up in the town, which does not have its own police department, with Mercedes SUVs bearing "City Of Hardin Police Department" decals.

And the town has had to tamp down reports on conspiracy Web sites that APF plans to impose experimental H1N1 vaccines on residents under threat of quarantine in the jail.

Under a lease signed with Hardin, APF, based in Santa Ana, California, and incorporated just six months ago, is now in control of a 400-bed detention facility the town built a few years ago but never used, a town official confirmed to TPMmuckraker today. The town reportedly stands to make over $2 million per year.

Just what American Police Force plans to do with the detention facility, which comes with 50 acres of land in the small south-central Montana town, is unclear. Also not clear is who, if anyone, APF plans to put in the jail. (Watch a video tour of the jail here.)

Hardin, which is in default on the bonds it used to build the jail, recently undertook an unsuccessful campaign to make the jail a new home for Gitmo detainees. When that failed, the town turned to APF

The 10-year contract that is now awaiting final approval of lawyers gives APF the option of building a training facility, said Al Peterson, spokesman for the Hardin economic development authority. APF has said it plans to invest $30 million in the site, including $17M in the training facility, where law enforcement will get sniper training and learn "DNA analysis" skills.

And where is American Police Force getting the money for this venture? Company spokeswoman Becky Shay -- until about a week ago the Billings Gazette reporter covering APF -- says they are no plans to answer that question. She did not respond to a request for comment.

The matter has attracted the attention of the Montana state legislature, which is seeking more information about the arrangement between Hardin and APF. The committee that deals with legal matters will send a letter to Hardin officials to get more details on the deal, Representative Bob Ebinger (D) tells TPMmuckraker.

"Because of the apparent secretiveness of this, it gives the far right and far left to come up with all kinds of ideas. That's why I'd like to see some clarification," Ebinger says.

Peterson, the Hardin official, says the controversy sparked last week when APF executives appeared in black SUVs marked "City Of Hardin Police Department" was a misunderstanding of an act of goodwill by the company. The decals were taken off within the day, he says.

Peterson hopes lawyers will approve the contract by next week, and at that point, a press conference is planned and the contract will be made available. Asked if he knew about the background of APF and what they do, Peterson replied: "No comment."

Visitors to APF's Blackwater-esque Web site listen to Ravel's Boléro and peruse a menu of services that include: harbor patrol threat interdiction, interdicting terror activity, interdicting weapons of mass destruction, international airline security, cheating spouse investigations, polygraph testing, kidnapping response, weapons sales including "Nuclear/Biological/Chemical (WMD)," and, finally, private investigative services that draw on "vast global network of highly ranked officers and government officials."

APF's double-headed eagle coat of arms appears to be the same as Serbia's Prince Aleksandar Karageorgevich, Raw Story points out. And the AP reported that a lawyer for APF describes the firm as "a fledgling spin-off of a major security firm founded in 1984."

Late Update: Yet another strange development: This page on APF's Web site brags about "our extensive tactical firearms training facility, the U.S. Training Center." But the U.S. Training Center is part of Xe, nee Blackwater. And Xe spokeswoman Stacy DeLuke told us there is no affiliation between Xe and APF.

Given that the town was scammed once before by shady out of state contractors (those who convinced them that building a private jail without any prisoners to house would be a great investment in the first place), I think that's a perfectly reasonable assumption.

Add in the various promises made by these guys (free mercedes police cars, free health care for the whole town, medical equipment, dog catchers, whatever), and the fact that they only popped into existence (with a cookie-cuter website stealing graphics and text from all over the place) a week or two after this town made it's ridiculous appeal to house the Guantanamo detainees, I think it's a pretty good bet they're being scammed once again.

I don't have a clue where to start a theory on this one.

But that whole "act of goodwill" with the City of Hardin Police decals is damned suspicious. Last time I checked, impersonating a police office was a crime. Via Wikipedia

Police impersonation is an act of falsely portraying onself as a member of the police, for the purpose of deception. In the vast majority of countries the practice is illegal, and carries a custodial sentence.


The following impersonations class as the offence:

Verbal indentification: The imposter announces to the unsuspecting victim that they are a police officer.
Fake Warrant card: The imposter, though not in any special clothes, displays a police-like badge to the victim. While a real police officer will be able to differentiate between the real and fake badge, the average individual may not.[original research?]
Fake uniform: The imposter wears a uniform that looks very much like that of a police officer.
Fake vehicle: The imposter places lights, decals, or other equipment on a personal vehicle to disguise it as a police car and enable the offender to make arrests or traffic stops.

Watch for this story to vanish down the memory hole, once the Montana legislature is "briefed."

Legally, it doesn't matter whether or not there is a police force that goes by that name. There are lots of small towns with no police. You can't pick up a badge, put a light on your car, and go around telling people you are their police. In other words, it's not the location, it's the intent to deceive.

Reading that linked story, I can't decide whether I am more mystified by the circumstances of this case, or appalled by the city's callous attitude toward prisoners as a source of income.

When prisoners are income and income isn't flowing, there might just be an incentive to create prisoners to get that income flowing. Ya think?

Being of Serbian royal decent, in fact my surname means Son of Saintly King in Serbo-Croatian, I am appalled that anyone would attempt to co-join the coat of arms of a dynasty that has a long history of corruption, cowardliness, torture and social abuse in the same line as an American police force.

I don't know-if this was just a straightforward scam for funding, why go to all the trouble of driving around in (presumably) expensive SUVs with custom decals?

This has hoax written all over it. Not only does the site look like it's from a cheesy video game, the domain name americapolicegroup.com is registered through godaddy, a third-rate web hosting service AND was created on May 15 of this year with only a one year lease.


If, as their site claims, they work in "every country in the world" I would think they would have a bit more of a presence.


Also it looks like one of their phone numbers is connected with a strip mall office building that looks pretty empty when it was passed by by the google street view folks.

The company appears to be an offshot of Defense Product Services. They're a small outfit that has about 17 contracts worth about $26 million in Iraq and Afghanistan. Mainly vehicles, clothing gym gear, some weapons and protective clothing.

The APFG website is a rip off of Xe/Blackwater. I suspect this is a shell company attempting to break into the big time. If they get the contract signed, they will get backing. If not, they're toast. I've seen this before, as I've been in the business about 38 years.

Another thing the city of Hardin should fill good about...if you check under the careers tab on their web site then look at the application, one of the questions is "Have you ever been convicted of a Felony?" then in parenthesis it says "This will not necessarily affect your application".

It appears that the Town of Hardin has signed a multi-year lease, with a value in 8 figures, with a tenant that is a start-up company. As a lawyer, I would never permit my client to do that without a guarantee from a third party with established credit. So who is that third party? Or did the lawyers for the town completely miss this issue?

this is the administrations solution to the gitmo problem. it's stupid but they probably liked the idea when the town volunteered to take the prisoners but cowardly politicians didn't want their hands dirty so the solution was to set up a company (6 months ago), let them set up shop like they were doing something else, then give them the contract since they happen to have a prison. sounds crazy and I know i have alot of holes in my logic now but who wants to bet the gitmo prisoners we can't find a home for end up there, even if its a temporary home ut i bet they meet the deadline now.

Technically, this crest has the same kinds of minor differences from the Karageorgevich coat of arms that I think you'd see in a younger son - the slight differences in the supports for the crown and, moreso, the fleur de lis. Either it's a younger son, or else they wanted to "French it up" for some reason.

(That listing on Burke's Peerage, by the way, misspells von und zu Liechtenstein, so I have my doubts about the whole family.)

It may be someone grabbing the coat of arms just to look fancy, but it seems a little too precise for that.

This guy is one shady character, with a very checkered past. I feel bad for the town of Hardin for building this white elephant of a prison. What the city council in the town of Hardin did was to build their own version of a field of dreams, problems is they (the council) never consulted with the state legislature on what they planned to do. They just assumed once the prison was completed inmates from around the county would arrive but it didn’t quite work out that way. The town of Hardin went against the grain and now the state is playing hardball. To make matters worse, the bond for the construction of this new prison is about to come due, that poor town is screwed.
So this shyster smelled the blood in the water and arrives like the white knight in shining armor. The city attorney for Hardin never bothered to do a background check on this guy until the local town folk started asking questions. Me thinks the attorney might be out of a job soon as the town of Hardin fall farther & farther into the abyss of dept

I have learned a few lessons over the years I've surfed the posts in TPM:
TPM is liberal...Fine! So am I.
TPM is visited by conservatives...Some making excellent points.
TPM endures trolls.
Comments are repetitive, offering little additional input relative to the initial posting.
Reading through the comments in this post, one sees a good example of what is so annoying! Yet, I have to read them all to find comments that are pertinent. Sigh! The jail is a place to where people will disappear. Want to know who they have? You will need a search warrant and maybe some guns. Where will we have the next Waco? Ruby Ridge? Hardin.

We have become so hardened to the crazy that this is being tolerated. These guys brandishing automatic weapons and driving fake police cars should be arrested. Impersonating a police officer is not an offense against the City of Hardin. It is an offense against the state.

No need for conspiracy theory.

They are a Federal government effort to stay concealed but hire out to mercenaries the job of cracking down on supporters of Montana HB246 law.

Note the time of their incorporation, and, yes, they are affiliated with Xe.

Naturally they need to increase the number of beds available; after all there are a lot of citizens who won't stand for their firearms states' rights to be taken away from them.

They'll increase their size as needed. After all, they have an unlimited bank account behind them to do what they've been hired to do.

Also note their position: far enough away from Billings, MT's largest city, to remain inconspicuous, but close enough to be on hand for whatever work they need to do. Near the major airport and right on I-90. This way they keep FEMA out of it too.

Jones also claims there are soldiers there from many different countries (wearing their countries uniforms). Could this be some NATO thing? There is an email out today from Wayne Madson identifing 55 cities who have hired the Blackwater Goons to "train their police forces". A very small town in my State is one on the list. What the hell is going on here.

I believe Gitmo is a national disgrace and as long as we keep prisoners there (some guilty some not) we will continue to be hated around the world. If this prison is in fact a high security one, where no one can escape....then why not bring the prisoners from Gitmo there? Whats wrong with that scenario. We have super max prisons all over this country and no one has ever escaped. Dont you want the taint of torture and the effects of the Bush/Cheney regime to be dealt with?

With some careful web searches I have tried to get a handle on whether or not this is really a Blackwater (aka "Xe") operation --- and it is just too confused. My hunch is that this is the work of the crypto-fascists at Blackwater/Xe . But the matter needs more digging by a competent journalist like Jeremy Scahill or the staff at TPM. What is clear is that the degree of cloak and dagger mystery about who and what is doing all this is very disturbing. When Blackwater started the process to establish its Blackwater training facility at Otay Mesa near San Diego (aka "Blackwater West") several years ago there was a well-organized resistance effort. But that was is California. People here can be a little feisty. Hardin is in Montana. It's a lovely state but those people up there are naive enough to keep re-electing the likes of Sen. Max Baucus who has taken over $3,000,000 in campaign contributions since 2003 from BigPharma and the medical insurance lobby to sandbag any meaningful overhaul of medical insurance. Those people up there are a little too trusting and will let Baucus get away with that kind of stuff. They believe he's doing them right because he tells them his brand of medical coverage is really what’s good for them. Even though they are getting screwed. (And he probably sprinkles in a little NRA, pro-life and "birther" babble for good measure.) Hardin, MT is a much more user friendly setting for Blackwater/Xe to conduct its nasty businesses.
