In a colorful eight-page filing, Birther attorney Orly Taitz declares that she will appeal a federal judge's $20,000 fine, which she was ordered to pay within 30 days last week.
In his lengthy order imposing the fine, Judge Clay Land promised to authorize the U.S. Attorney to "to commence collection proceedings" if Taitz did not pay the fine. So stay tuned -- we may be building up to some kind of climactic final showdown.
Here's a taste of Taitz's latest (bolded text in original):
Judge Land's actions that amounted to misstating or misrepresenting ninety percent of what was presented in the pleadings and argument, completely ignoring ninety percent of the argument and facts, making extremely rude and demeaning remarks, showing bias; taken together, appear to be designed to silence her and, intimidate her and above all, punish her for what the Court perceived as political rather than "core" constitutional questions. It appears to be a thinly veiled threat to other attorneys not to pursue similar Constitutional issues, which will have a chilling effect on the ability of the public to use Federal Court system to uphold their constitutional rights. Judge Land's remarks amounted to nothing short of political lynching, which turned into feast and celebration by the media mob.
The filing with the US District Court for the Middle District of Georgia is dated Monday and was posted last night. Read the whole thing here.
Taitz also claims that she hired a private investigator who found "39 different social security numbers used by Mr. Obama" including numbers with links to Judge Clay Land's own district. This, Taitz says, is reason she should be granted further discovery.
She told TPMmuckraker last week that she had no intention to pay the $20,000 fine, which stemmed from frivolous filings in the Birther case of Taitz's former client, an Army captain.

I would be very curious to see any law type person weigh in on what a "notice of appeal" is normally supposed to look like and what sorts of standards an actual lawyer would follow in justifying one.
Though the really interesting thing to me here is that on dkos someone linked to some sample documents on a federal government website giving examples of what a "notice of appeal" would normally look like. They were all like... one sentence long, and contained no information except the name of the case, attorney and original judge. If the examples were to be trusted, this particular type of filing isn't a place where you make your case at all, it's just a piece of paperwork to get you in to the system. And she submitted like this eight page document full of allegations (but no specifics). Yikes.
Following horribly incompetent lawyers can be a fun way to learn about law!

mcc is right, this is a very, very weird "notice of appeal."
A notice of appeal is normally just one sentence on one page, stating who is appealing and what order or decision they are appealing. You don't need to explain why you are appealing or present any legal or factual arguments. Or even what part of the order or decision you're appealing. Just that you are filing an appeal.
But Taitz uses the notice to go on another 8 page rant.
It would be within the power of the judge to find her in contempt and issue another sanction based on the language in the notice of appeal. (I doubt he will. He'll probably decide that $20,000 is enough and let the appellate court strike the next blow.)

California has an unusual feature for their bar exam. Anyone can take it, whether they have been to an accredited law school or not. Orly has not. She went to Taft Law School which does not have ABA accreditation. Assuming she was the one who took her bar exam, she's formally deemed to be qualified to practice law. Her filings, however, argue that she is not qualified, though that may be a result of mental disease or defect, not merely inadequate preparation.

It's getting sad. The appeals court can sanction her for (a) disparaging the district judge; (b) disparaging them; and (c) filing frivolous arguments. 20K is the floor.
A notice of appeal is exactly that. It's not supposed to be a brief, and the briefing schedule doesn't start until the district court certifies that the record in the case is complete.

Ms. Taitz isn't who I would pick as the poster child for judicial abuse, but the fact is, when you put a robe on a mere mortal and, worse, tell them they have life tenure, the sky's the limit as far as the potential for an abuse of power.
Any litigator worth their salt who's appeared in a federal court will tell you hell hath no fury like a federal judge who, for good reasons or bad, is pissed off at you. Ms. Taitz may very well deserve the Rule 11 sanction she received from this particular judge (and I have no sympathy for her actions), but that doesn't mean she deserved some of the intemperate language the judge has used regarding her, simply because he can.
Remember, just because a judge comes down with both feet on a lawyer, doesn't mean the judge is always right.

The judge's language was not intemperate. It might have been strident and contemptuous, but not in a way that was ad hominem.
I was an appellate clerk, and there was one detail in the recitation of Taitz's misdeeds that really stood out and I think will be hard for an appeals court to overlook, and that was her telling the judge, to his face, that she was going to file case after case until he gave her the discovery she wanted on Obama's birth certificate. They are used to that kind of conduct with prisoners, less so with non-prisoner pro se civil litigants, but it does happen, but for an attorney to make that kind of statement is just an abuse of her position as an officer of the court.

This is just a bizarre filing of a person who clearly has no basic understanding of the law. Her Notice of Appeal is largely an appeal of the District Court's dismissal of her client's case.... her FORMER client's case. She has no standing to file an appeal for most of what she claims to be appealling as the right to any such appeal belongs to her former client alone.
Second, she keeps talking as if she is legally permitted to conduct discovery despite the fact that she has no client she's representing. The district court warned her, and yet, she persisted even after she herself voluntarily filed a Motion to Withdraw as Counsel which, of course, she also appeals because the Court granted it but kept jurisdiction for possible sanctions, something no Court of Appeals is going to reverse because the Court's conditions were stating a truism.
She has no grounds to appeal the dismissal, only the imposition of sanctions, which is based on the her insistence on proceeding with her case despite the fact that, well, she had no client and the case had been dismissed. She doesn't seem to appreciate the legal situation she's in AT ALL.
Seriously, inmates in prison understand the law better than she does.
