Not so fast...
This morning's hearing, at which astroturf lobbyist Jack Bonner was scheduled to testify about the forged letters sent by his firm to lawmakers, has been postponed a week.
Rep. James Sensenbrenner, the ranking Republican on the Select Committee For Energy Independence and Global Warming, complained at the outset that he hadn't had 48 hours to read witnesses' testimony. In response, Chair Ed Markey announced the postponement.
"In the interests of fairness, [Markey] decided to postpone the hearing so all sides could review the testimony," said Markey spokesman Eben Burnham-Snyder.
"I think the chair did the right thing and I salute him for it," said Sensenbrenner.
Spokespeople for the committee declined to say which testimony Sensenbrenner didn't have in time, saying that witnesses "from both sides" had submitted statements after the 48-hour-rule window. But they confirmed Bonner only agreed yesterday to appear, and said that the witnesses whose testimony Sensenbrenner felt he didn't have enough time to review included "people on the fraud side."
The other witnesses are from groups whose names were forged on the letters, and, according to one report, Rep. Tom Perriello, who received several of the letters.
The letters, sent by Bonner's firm on behalf of a coal-industry client and purporting to be from community groups, urged lawmakers to oppose climate change legislation. Bonner has blamed the episode on a temporary employee.

What is the problem with Rep. James Sensenbrenner? Doesn't he, or his staff, know that every Representative is required to have 48 hours to read witnesses' testimony before they give it?
If this is not a legal, or a procedural, requirement why did Rep. James Sensenbrenner fold so quickly to unrealistic Republican demands?

I think you need to reread the article. Sensenbrenner complained that he didn't have enough time to read the testimony. Both sides submitted new materials inside of the 48-hour window. Chairman Markey rightly postponed the hearing.

My comment should have read:

The question remains: "how can testimony be reviewed before it is given?"

Has anyone considered calling the employee who allegedly forged the letters to testify? He/she can help explain the whole mess or plead Fifth Amendment rights. Who is afraid of the truth here?

I suspect that Bonner's defense will be it was a temporary employee and that the business had rules that forbade this kind of behavior. Therefore he, Bonner, isn't at fault and cannot be held responsible.
The answer to that is if you make a rule that a person is not allowed to swim and then throw him into a swimming pool, whose fault is it if he swims? Bonner had set up his whole business plan so that this kind of behavior was inevitable. He rewarded and punished people in such a way that their only option on occasion was to do something unethical if they didn't want fired. And since this isn't the first case where this happened, then yes, Mr. Bonner, you most certainly ARE responsible for what happened.
