An affidavit from conspiracy theorist Lucas Smith filed in a now-dismissed Birther lawsuit details charges that attorney Orly Taitz, among many other things, asked Smith to perjure himself. The federal judge in the case has said he was "deeply concerned" about the charges, along with similar claims from at least one other prospective witness.

Lucas Smith, a Birther activist whose past claims have been debunked by even Birther-friendly WorldNetDaily, claims Taitz wanted him to falsely say in court that an incident where he was almost hit by a car in Los Angeles amounted to an "attempt on my life" by operatives sent by President Obama.

In dismissing Barnett et al v. Obama et al, Judge David Carter, of the U.S. District Court in the Central District of California, voiced concern about affidavits charging Taitz suborned perjury. "This Court is deeply concerned that Taitz may have suborned perjury through witnesses she intended to bring before this Court," he wrote late last month.

The judge did not get into detail about the affidavits, but Smith's affidavit fits the judge's description and Taitz suggested in a followup filing that Smith was among the potential witnesses in question.

The Orange County Register, which obtained the affidavit from author Lucas Smith, runs down the charges, which get seriously into the Birther weeds:

Among allegations made in the affidavit from Smith is that Taitz asked him to say that he was the one who obtained a document that was alleged to be a 1964 Republic of Kenya Certified Copy of Registration of Birth of Barack Hussein Obama II. That document had been called a forgery by experts and in his affidavit, Smith said his research also concluded that the document was fake.

Taitz did not immediately respond to our call for comment, but she told the OC Register the charges in the affidavit are false, and that it was probably written under pressure from unspecified sources. [See update below for Taitz's response.]

Keep in mind while reading that this is how Smith describes himself in the affidavit:

l, Lucas Smith, often spend my days and sometimes my nights marshaling evidence which aides in establishing under both standards of evidence, preponderance of the evidence and beyond a reasonable doubt, that US President Barack Obama was born at Coast Province General Hospital, Mombasa, British Protectorate of Kenya and is ineligible to serve as President of the United States.

Late Update: Calling from Illinois where she is attending the Continental Congress 2009, Taitz told TPMmuckraker the affidavit contains nothing but "slanderous, defamatory accusations from third parties." She said she had "no clue" about the Los Angeles near-accident issue, and "I never asked anyone to lie."

Taitz also told us she is stunned the judge referenced the affidavits in his order without first giving her a chance to respond.

I have to say though, please go back to the "come hither" one. That was horrible as well, but at least her face was small in it. This one is at least as bad as the first.

I'm all for strong press freedoms, but in this case...think of the children! Heck, for that matter, think of the adults! I have hundreds of perfectly good neurons that will now probably never work properly again after too much exposure to Orly.

Allegations of maritial infidelity involving Taitz (the come slither photp you've been using makes sense now), and even conspiracy theorists finding Taitz crazy, and an emerging consistency of seeking perjurious testimony. This is the most interesting "affidavit" I've ever seen.

gamepolitics.com has a lot more info about Jack Thompson such as what finally got him disbarred and his legal antics that cost the taxpayers millions of dollars. As an anti-video game lawyer he often advised politicans that the anti-video game laws they were crafting were legal but they weren't so they got tossed out. This didn't happen once but multiple times.

I'm a first year law student and can tell you that this is not the worst filing I've ever seen. Even Taitz's aren't as bad as one we studied. But it is still amazing how unprofessional these are.

Not sure which is funnier, the part in the affidavit where he solicits from "Patriots and concerned citizens" to donate money to one of two of Charles Lincoln's websites www.spritualpatriot.com because the "renowned" and "honorable" Charles Lincoln III is funding this loon, or where he allegedly quote verbatim, said "honorable and renowned" Chuck, about his describing how hot, tight and wet Orly is in the sack, which lead to Lucas's falling out with Orly because she is a dishonorable slut for sleeping with Lincoln.

Please don't think this is a defense of Orly, who I think should be both disbarred and behind bars, though I can't decide if a penal or a mental institution would be more appropriate. On the other hand, I am not a believer in 'any stick to beat a dog.' And I wouldn't push the story of her 'suborning perjury' based on the testimony of people (Smith and Sinclair, certainly) who are already -- who were, previous to the birther idiocy -- shown to be perjurers.

Maybe every word in the affadavit is true, or it is all moonshine. That's the problem with it, and if you don't stress his past history, you give the affadavit far too much credence, more than it deserves.

I have no idea whether any of this is true, but if you take this affidavit at face value, Lucas Smith really did not object to the perjury until Taitz refused to pay him some money and complained about him gossiping about her. He was okay with everything up until then.

Additionally, his esteemed friend is the person sleeping with Taitz - if his claims are true - and yet retains his admiration and respect while she is tainted and vilified and gratuitous explicit sexual commentary is included to humiliate her as a woman. It has no bearing on the affidavit about perjury, it is purely an attempt to humiliate.

I despise Taitz, but Smith is as contemptible as she is. I hate it when men use sexual slander to defame women and that's all this is.

FYI, an Indiana Appeals court judge just shot down the "two citizen parent" argument.
