In Utah, DHS Raids Raise Concerns
A troubling report from the DHS immigration raids yesterday, from the Salt Lake (Utah) Tribune. In this case, DHS agents allegedly separated workers by their skin color -- light-skinned were considered citizens, dark-skinned got scrutiny. Predicatably, they swept up at least one dark-skinned U.S. citizen up with immigrant workers:
If only for a few minutes, Maria felt like an ''illegal alien'' in her homeland - the United States of America.She thought she was going on break from her job at the Swift & Co. meat processing plant here [in Hyrem, Utah] on Tuesday, but instead she and others were forced to stand in a line by U.S. immigration agents. Non-Latinos and people with lighter skin were plucked out of line and given blue bracelets.
The rest, mostly Latinos with brown skin, waited until they were ''cleared'' or arrested by ''la migra,'' the popular name in Spanish for Immigration and Customs Enforcement (ICE), employees said.
''I was in the line because of the color of my skin,'' she said, her voice shaking. ''They're discriminating against me. I'm from the United States, and I didn't even get a blue bracelet.'' . . .
Women were crying as they were handcuffed with plastic ties and put on the buses. Some weren't allowed to get their belongings from their lockers. Maria, who declined to use her last name, argued with an agent because she was getting the coat for her 34-year-old niece, Blanca, who was arrested.''She [the agent] told me, 'Do you think it's going to be cold in Mexico?' '' Maria said, holding back tears.
The paper confirms that the federal agents took an undisclosed number of people away in buses away to an undisclosed location.

What's more, what sort of legal recourse do these people have now? Who can teh citizen's they've taken get in contact with to help them? My guess is they've been given the same rights as gitmo inmates.

This does not change the facts. Illegal is still illegal; they should be rounded up and deported.
What it does do is demonstrate a clear need to take measure to avoid racial profiling. This is likely impossible, because poilce authorities at all levels tend to view dark skin as meaning you are likely a criminal.

It's reminiscent of the anti-Japanese wave and the arrests made in California that put Japanese-American citizens and residents (but not German-American citizens) in camps in the 1940's.

If the INS has info on a particular work place, they should be required to treat all the workers the same. Accents, skin color, etc. shouldn't affect the treatment and they should be required to the same checks on every person. This would force them to treat everyone better and would also give many naive citizens an idea of what it's like to be an immigrant. I keep thinking of the many occasions when Asian-Americans in this country who are asked "where are you from," and the questioner gets annoyed when the person answers "New York" or "Iowa City." (instead of China, or Japan, etc.).

These people were not begging on the streets. They were working in meat packing plants, doing jobs that you probably wouldn't want to do, for money that you probably couldn't live on. I can assure you that the entire restaurant industry in New York, and probably the agriculture industry in California, would collapse if it weren't for illegal workers.
Of course, we need to do something about illegal aliens, but treating them like animals isn't the answer.
And neither is ethnic stereotyping.

So long as we are just arresting and deporting the workers, but winking at the businesses that pay cut-rate wages to maximize profits, the problem will continue. But in actually, they are really only looking for a better life, same as Mexicans, Hondurans, etc. Very very few of the people from Cuba actually came here as political refugees.
Anyway, our overall immigration policy is in serious need of an overhaul, without somehow trying to justify white racist tendencies.

I think this sums up the problem nicely. Treating another person's rights casually (lazily) is, indeed, treating them in a harmful (malicious) manner. Constitutional rights are only meaningful when they are respected equally and without exception. Oterhswise, they would be 'constitutional privileges.'
Of course, this can be taken to extremes. Hurting my feelings because you can't guess my ancestral country of origin from my surname is not malicious. Arbitrarily putting me into a line of people to be deported based on my skin color is malicious.
Knowing the difference in the above examples probably requires that you experience it at some level. Tragically, until they come for you, you don't have an appreciation for the difference.

Swift needs to be made an example of. The company should face heavy sanctions for its lax enforcement of US labor laws. Will that happen? It all depends on which legislators Swift contributed to in the last election cycle.

Our government is the real problem for turning a blind eye all these years particularly during the Bush years. Now they claim there is no way to make all illegals go home. There certainly is, cut off all benefits they are receiving and they will leave.
Both parties want cheap labor which also has the effect of pushing all wages down. We are our own worst enemy if we allow all these problems to continue.
Then we have our own citizens supporting letting illegals stay because they want cheap prices and don't care about the overall effect of allowing our borders to be flooded.
As long as our government stalls and does nothing this problem will only become worse. Start a guest worker program at our peril. All children born of these guest workers will become citizens and cost us even more in social and economic problems because their parents aren't citizens. A guest worker program is just another form of amnesty whether Congress admits it or not. Once you have amnesty it only encourages ever more illegals to come. That's exactly what happened after Reagan granted amnesty.
Go ahead. Support keeping illegals here and watch your own wages plunge ever more downward.

The anchor baby feature allows babies of illegal people to become citizens whether their parents are citizens or not. Then with the low wages we pay illegals these families end up drawing benefits because they have a child who is a U.S. citizen.
Take away the anchor baby benefit which would likely require a Constitutional amendment and it will help resolve some of the incentive to come illegally.

Every group that's already in a country vilifies those who are just arriving, because they tend to be from the lower classes and are seen as a dangerous cultural and economic element. Problem is, every single time this has happened in the US (and in Europe) it's proven to be positive economically and culturally in the long run--those people often become more patriotic than those already in-country. That's why you don't see any "No dogs or Irish" signs anymore, or why a Catholic can become President.
But no, everyone locks onto the small percentage who are either stridently foreign or illegal, claiming all kinds of idiotic things about them ("they take our jobs" "they live off our welfare" "they don't pay taxes") all of which may be true in individual cases, but not in aggregate. It's usually nothing more than a cover for base classism or racism.

Contrary to what many in the US believe, German-Americans WERE interned in the 1940's. Putting innocent people in camps during wartime was nothing new in WWII. Canada did the same in WWI as well, with my own great-grandfather being being forced against his will to work on a farm for the duration of the war.

So what I'm wondering is why USC 18:242 wouldn't apply:
"This statute makes it a crime for any person acting under color of law, statute, ordinance, regulation, or custom to willfully deprive or cause to be deprived from any person those rights, privileges, or immunities secured or protected by the Constitution and laws of the U.S.
This law further prohibits a person acting under color of law, statute, ordinance, regulation or custom to willfully subject or cause to be subjected any person to different punishments, pains, or penalties, than those prescribed for punishment of citizens on account of such person being an alien or by reason of his/her color or race.

I was working in an Irish Pub and restaurant in San Francisco that was the subject of an INS raid in 1989. They pulled aside all the kitchen help for the third degree, because they were either Mexican or Filipino. Meanwhile, they failed to question the two real "illegals" who were working for us -- one was Irish and the other Quebecois (Canada).

Donald, the article I responded to talked about how "The rest, mostly Latinos with brown skin" were treated diffently because of the skin tone. Latinos generally come from Central and South America. I haven't heard of many from Belorus or the Ukraine. And, I was in Sacramento 3 weeks ago. I travel a lot.
I responded to the article. Maybe you should have read it before you jumped on me. I never said, or implied, that people of European extraction were not in the pool of illegal immigrants. But it is certainly true that they are not walking across a wide open border or riding in by the truckload. They do not constitute a flood, as do the illegals coming in from Central and South America.

Our immigration allotments are the most liberal they've ever been. We take a larger percentage of people in legally every year than ever before, and considering we have our largest population now the actual number is considerably larger. Yet, this isn't enough. What you actually mean is Americans won't or can't (legally) do the jobs that illegals will do for $2 or $3 an hour...

It has to do with an external culture moving here wholesale, contrary to this nation's laws (and frankly I don't know of a single nation on earth you're allowed to move to unsupervised and undocumented).
