WH Moved Swiftly to Replace US Attorneys
The administration is replacing U.S. Attorneys throughout the country. How'd they get that power?
It was an obscure provision in the USA PATRIOT Improvement and Reauthorization Act, and it didn't take them very long to use it. The president signed it into law in March of last year -- by June, they were already moving to replace unwanted prosecutors.
Former Arkansas USA Bud Cummins told the Wall Street Journal that "a top Justice official asked for his resignation in June, saying the White House wanted to give another person the opportunity to serve." Cummins was finally forced out in December, replaced with Timothy Griffin, formerly the research director of the Republican National Committee.
Section 502 of the PATRIOT Act reauthorization, which was first drafted in July of 2005 and finally signed in March of 2006, changed the law regarding the appointment of U.S. Attorneys. Whereas before the relevant federal district court would have appointed a replacement within 120 days after the Attorney General picked one, now that pick stood without challenge.
How did this (brief, legalistically worded, but powerful) section get in to the bill? It's not clear. Sen. Dianne Feinstein (D-CA) has consistently referred to the provision as "little noticed." What is clear is that Feinstein and her colleagues did not expect the provision to be used in this way. We'll have more on this as we learn more.

Sad that any Congress credibly expected Mr. CheneyBush not to abuse executive authority. Mr. Griffin, in particular, is a close shot across the Democrats' bow. He has spent his entire career digging out dirt exclusively on Democrats. Unlike, say, his former Republican colleague in San Diego who convicted Republican Rany Cunningham of bribery and put him jail. She was undoubtedly replaced pour encourager les autres into not repeating her "disloyalty".

the AG can appoint a judge for up to 120 days. The President has 120 days to nominate a successor to that appointment and if he does not do so then the District Court can appoint someone to fill the spot until the President can do so.
Unclear to me is whether 546(c)(2) means Senate confirmed or merely nominated.
Also unclear to me is what the point of this is. Basically the District Courts are removed from choosing their membership even if the 120 days is past.

Best I can figure, here's the original Title 28, Section 546, and the italics represent the language that the PATRIOT Act removed:
(a) Except as provided in subsection (b), the Attorney General
may appoint a United States attorney for the district in which the
office of United States attorney is vacant.
(b) The Attorney General shall not appoint as United States attorney a person to whose appointment by the President to that office the Senate refused to give advice and consent.
(c) A person appointed as United States attorney under this
section may serve until the earlier of -
(1) the qualification of a United States attorney for such district appointed by the President under section 541 of this title; or
(2) the expiration of 120 days after appointment by the Attorney General under this section.
(d) If an appointment expires under subsection (c)(2), the district court for such district may appoint a United States attorney to serve until the vacancy is filled. The order of appointment by the court shall be filed with the clerk of the
court.
What'd I love to see is the argument for why this makes us any safer against terrorism. It's not like the original law left any vacancies, and the Prez+Senate had four months to replace temporary appointees.

Abuse of the law for political purposes. Is it provable? You can't just change legitimately appointed officials because you don't like what they're doing. You can't appoint judicial officials with specific ends or prosecutions in mind. There's no democratic or republican justice, only due process for all.

There may be something to look into re: why are all these happening at once, or why are some in particular being forced out, but it's not like they are federal judges.

And exactly how are they going to do that? Even if a repeal passed both houses of Congress, the president is going to veto it. And I doubt they could pass a repeal by a veto-proof margin in both the House and the Senate. So we're stuck until we can get a new president.
I'm beginning to be very sorry that they didn't institute a parliamentary system in 1789. Then again, that would have given us a Republican president in 1994.

Besides, it's the Assistant United States Attorneys who actually do all the work. They have civil service protection and most have been around a lot longer than Bush has. I'm sure there are as many Democrat AUSAs as there are Republican.
Should you watch the administration like a hawk? Sure. Is this "the start of martial law in the US?" I doubt it.

Under the old law, the President or Attorney general could make a temporary appointment to fill the vacancy until a permanent replacement US Attorney was confirmed by the Senate.
If a permanent replacement was not comfirmed within 120 days, the Federal District Court judge appointed a temporary US Attorney, who may or may not be the person appointed by the President or Attorney General.
The new Patriot Act, changed this provision so that the temporary US Attorney is not subject to replacement by the District Court after 120 days. The result of the change is the President can appoint a US Attorney and never submit a name to the Senate, effectively nullifying the confirmation process.
I'm surprised they didn't attempt to do the same thing with Federal Judges.

First of all, this is section 502 of the Patriot Act reauthorization. Figure that means there are at least 501 sections before it, which probably means this is one or two paragraphs buried somewhere on page 600 or so of the bill.
You have months of committee hearings in both the House and Senate, where the language of their respective bills are hammered out. After the bills are passed by both the House and Senate they go to a conference committee to reconcile the differences in the language used by the two houses, and here's where the alligator gets into the swamp.
Under Republican control, the conference committee was totally Republican, no Democrats appointed by either the Speaker of the House - Dennis Hasthart or by the President of the Senate - Dick Cheney.
The conference committee gets to rewrite the bill any way they see fit, before reporting it back to the House and Senate where it is subject to a UP or DOWN vote, no ammendments allowed.
Frequently this UP or DOWN vote took place only hours after the conference committee reported the bill out.
Even if the changed bill has been printed and distributed, how much time do the Democrats really get to read through a thousand plus pages of a bill to find the one paragraph where the conference committee has slipped a partisan mickey into the bill? How long does it take to find the partisan screw job, and will our intrepid heroes find the answer in time?
