Ousted Prosecutor to Hold Presser on Indictments

At 12:15 PM Pacific time, U.S. Attorney Carol Lam will hold a press conference on a "criminal matter," according to a press release.

She's expected to announce the indictment of Kyle "Dusty" Foggo, the former #3 at the CIA, and Brent Wilkes, a defense contractor accused of bribing Duke Cunningham and the prime benefactor of the secret CIA contracts that have landed his best buddy Foggo in trouble.

But there's some added drama in that Lam will holding the presser, since she is one of the seven federal prosecutors forced out by the administration in December. The Wall Street Journal earlier reported that she'd ordered her staff to have Wilkes and Foggo indicted before her last day -- this Thursday.

Dismissing Justice Dept officials because they are getting too close to the malfeasance is never a wise move. It may delay things slightly, but once the people are out of government there is no reason for them to keep quiet.

It would be easy for the new guy to "drop everything" if, when he takes office, the staff haven't actually issued any indictments yet. He could make them jump through hoops forever without looking obviously dirty. But if he inherits an actual indictment, he has to proceed; dropping charges would probably lead to a congressional investigation. That's why Lam wanted indictments while she is still in office.

If, at the imminent press conference, Ms. Lam announces indictments of Foggo and Wilkes, that means that a FEDERAL GRAND JURY has already indicted the two men.

Ms. Lam's replacement, whoever that may be, has not yet been named so far as I know.

A federal judge would have to approve the dismissal of indictments if Ms. Lam's succesor were to seek such dismissal.

Congress does not "pick special investigators" if by that you mean "independent counsels" or "special prosecutors."

Selection of federal prosecutors is entirely the province of the Executive Branch, not the Legislative Branch.

The "independent counsel" law was allowed to expire a few years ago since such prosecutors were selected by judges -- a constitutional no-no.

The Federal prosecutors recently fired by the Bush (mis)Administration would make ideal special prosecutors for Congress to bring on board as the need arises. In the meantime, another Bush appointee taking the "perp" walk.
