GOP Sen: "I Can't Even Tell You How Upset I Am"

I've stopped counting how many toes the Justice Department stepped on when they purged eight prosecutors last December.

But one set of toes belongs to Sen. John Ensign (R-NV). Not only did the Justice Department go over Ensign's head to fire Nevada's U.S. Attorney Daniel Bogden, but they apparently "misled" him as to why they were doing it.

From The Las Vegas Review-Journal:

Ensign was particularly irate over the firing of Bogden, an independent who Ensign picked in 2001 to oversee federal crime prosecutions in Nevada. Bogden, a prosecutor in the Northern Nevada office of the U.S. attorney, was nominated by President Bush and confirmed by the Senate in October 2001.

In December, the Justice Department fired Bogden over Ensign's objections. Ensign said last month he was told the dismissal was for "performance reasons."

Justice officials initially told Congress that was the reason. But Tuesday, Deputy Attorney General William Moschella told a House subcommittee "no particular deficiencies" in Bogden's performance existed....

Ensign said Wednesday he was decidedly unhappy.

"What the Justice Department testified yesterday is inconsistent with what they told me," Ensign said. "I can't even tell you how upset I am at the Justice Department."

Asked whether he believed he was misled, Ensign said, "I was not told the same thing that I was at the hearing, let me put it that way."

Ensign said he pressed the topic at a meeting with White House officials Wednesday morning. He added he would be "making further inquiries."

"I am not pleased with the Justice Department at this point," he said. "I told the White House this morning if I could renominate (Bogden) I would."

The Review-Journal goes on to quote a "legal source" saying "it seemed clear that the administration was preparing to 'parachute in' a new U.S. attorney in Nevada [after Bogden's firing], possibly from outside the state, under the Patriot Act umbrella."

And so it continues....

Update: I missed this in my first reading of the piece, but Sen. Harry Reid (D-NV) is quoted as saying that someone from the Department of Justice actually told Bogden that they were planning of taking advantage of the Patriot Act provision to avoid Senate confirmation for their choice.

Ensign is probably pretty pissed. A U.S. Attorney (like judges) is nominated by a state's Senators, and are generally not flunkie friends of Karl Rove.

Not exactly a great legal mind functioning here that's for sure but remember shrub had him on the short list for the supreme court. Definitely agree on Specter; I'd like to note that, having followed votes on OpenCongress, Specter seems to be playing nice with the new majority party, and going along with most of their bills and amendments. Not sure if he's worried about 2010 or what, but I'm not complaining at the moment.

My first thoughts exactly. These days Republican is synonymous with weasel. Any Republican who kept office through the DeLay and Bush reign must have a little weasel inside, or a blind eye or two.

I don't see any outraged Republicans breaking scandals on their own, not from the copious insider knowledge they must have of the stuff that went down over the last several years.
It seems they're always the last to know what their own party was/is doing, and always late to the press conference to express shock and dismay.

Was there really anyone left out of the loop?

Anyone didn't get a check from Boehner during the good times? Unlikely. They all have something to hide, and each is going to defend the other as he would himself.

Nevermind, we'll find out, and they can continue feigning shock and outrage while stonewalling, just like the phonies they are.

Good old Specter, hardly a ghost of a man these days, was doing his damnedest to belittle Iglacias the other day, showing what an unprincipled Republican toady he's become. Nothing new for him, he's taken his orders from the WH and the party fund raisers for years now.

He kept asking "is that all" as if there was some other interpretation of Dominici calling him at home to drill him on the prosecution of a Democrat shortly before an election where corruption was a prominent issue, and then hanging up on him with the conclusion he's 'disappointed' in the response.

If he had left a horse's head in his bed, would Arlen Specter interpret that as a casually shared affection for animals and equestrian sports?

And as it turns out, such phone calls to prosecutors are against the rules of both houses of congress, so just what is Specter's problem in connecting the dots? Where's the big mystery? Is that phony really unaware of the rules? If so, what the hell is he doing on the committee?

And Hagel, talk about a damage control expert and phony. Where was Hagel on Iraq when it actually came to a vote? After all the noise he made the weasel found a way to vote party lines. Since the vote and since Bush went ahead with his escalation, public be damned? Hagel's been quiet as a mouse pissing on cotton balls. Another expert in delaying tactics and phoniness. Or should that be DeLay tactics?

These Republicans are all so compromised and the underlying power structure from Delay, the lobbys, the Bush WH, and all such ilk, is obviously still there and utterly corrupted.

That's the important context to this whole scandal, that the MSM isn't covering, and that TPM should reprise and boil down to the essentials.

It was the PATRIOT act provision which made this whole sordid affair possible, and it's clear now it was no accident but a deliberate part of the plan.

It's positively absurd that we still don't know who slipped that provision in, laying the groundwork for this little operation. And since it happened on Specter's watch, when did he know about it?

Frankly it's absurd anyone can pass legislation without putting their name to it, and no, lobbyists don't count.

No more of the "nobody knows who wrote that law" BS anymore. ENRON had better accountability than than some of the mystery laws passed by Republicans over the last several years.

Exactly right.

And that explains why he's trying to stonewall the committee hearing, giving Iglacias the 3rd degree, and apparently incapable of connecting any dots.

My bet is:

1) Specter's been involved from day one
2) knew of and endorsed the PATRIOT act provision
3) did it as a favor to the WH
4) knows he's in deep shit
5) is using the mystery aide to cover his own ass
6) is forgetting: it's the coverup, stupid.

Maybe Specter didn't know how badly the WH would bungle and abuse the power he gave them, but considering this administration, that's grounds enough to be canned.

Specter certainly didn't imagine the Bush WH intended good-deeds with the power to indefinitely postpone confirmation hearings on US Attorney replacements, thereby circumventing an essential check and balance on executive power.

Specter can't be so stupid to misunderstand the importance of the USA and their impartiality, specially regarding corruption cases, which aren't exactly rare these days.

TPM: please reprise this story from the beginning, cover the 'mysterious' PATRIOT act provision, Specter's connection to it, and redress the context of this whole scandal.

While the day to day is very important, the groundwork that went into these firings, that's most important to get the full effect of mendacity and scandal. It's not being covered by the MSM and most of the public is unaware.
