"executive privilege" is an abstract myth.

Show me the part of the Constitution that details "executive privilege" exemptions and then I'll start listening to these claims.

For an Administration that claims to be "strict constructionist" on the Constitituion their words really ring hollow.

A couple of things that have struck me as odd over the past few years was the justice department's focused prosecution of enviro-vandals (terrorsists?) and secondarily their prosecution of medical marijuana.

Have there been USA's who have been leading the charge against these dangerous individuals?

I know it's just messed up priorities, but it's also a media weapon against environmentalism and democratic voting states. It'd be interesting to discover the strings behind the puppets.

Two pernicious legal theories have been abused over the past 50 years to hide government malfeasance from the public: "executive privilege", and the state secrets doctrine.

I've always been offended by the executive privilege argument though. If your advice to the president is so scurrilous you'd die of embarrassment if it were revealed to the public, maybe your advice isn't very good.

Stated another way, if your honest advice is too shameful to share with the people, it's too shameful to share with the President in secret.

I can't believe the media doesn't have the balls to challenge this doctrine. It is the most bullshit excuse for secrecy I've ever heard.

And while they're at it, how about they subpoena the emails from non-governmental accounts... Yahoo, AOL, Hotmail, gwb43.com... it seems like this is where the juicy stuff is likely to be, and the clearest evidence of obstruction of justice.

anybody out there at Yahoo Mail, perhaps now is a good time to make a back-up of Karl Rove's email folder.

I will lose all hope if there is any compromise on this issue. There is absolutely no shield for Administration lackeys like Rove under "executive privilage" www.thinkprogress.org has a great article about the precidents related to this matter... in short, Rove is screwed. Even the NRO has an editorial saying the same thing. The people want testamony now and they want it under oath. We should let our representatives know it.

Cheney used these dubious classifications to avoid revealing the truth about his "Energy Industry Task Force."

It wasn't exactly fiction, everyone was so worried about the socail and moral agenda of these Bush SCOTUS appointees, they missed the real issue, which was protecting corporations from legal liability.

It is the one underlying thread to everything that has happened to the court since "Gore v. Bush." The social agenda was it's usual smokescreen, the real story is that these "Justices" are there to make sure no corporation is left behind.
