Reason for Suspicion

Having spent some time digging into the administration's stated reason for U.S. Attorney Carol Lam's firing, it's time to cleanse the palate with the reasons why we're so suspicious.

So here we go.

-- Lam was never confronted over her approach to immigration prosecutions, the given reason for her dismissal.

-- In November, shortly before Lam was fired, a Justice Department official brainstormed about how to explain firing several U.S. attorneys: "The one common link here is that three of them are along the southern border so you could make the connection that DoJ is unhappy with the immigration prosecution numbers in those districts."

-- Lam was fired midway into a historic, wide-reaching public corruption investigation that targeted a number of Republican members of Congress and the executive director of the CIA. Even Karl Rove has acknowledged the reasonableness of not dismissing U.S. attorneys who are leading "high profile cases, important investigations" -- though for some reason, this one didn't qualify.

-- Despite the fact that it was one of the highest profile federal investigations being undertaken at the Department, Lam's investigation into Duke Cunningham and others is never mentioned in the Justice Department emails that have been released. Not once. This must have been discussed at the highest levels, but we've seen no record of those communications.

-- The FBI's bureau chief in San Diego has said, "I guarantee politics is involved" in Lam's firing. When asked about the given rationales for her ouster (that she pursued corruption cases to the detriment of gun and border prosecutions), he responded “What do you expect her to do? Let corruption exist?”

-- May 11, 2006, the day after Lam informed the Justice Department that she planned to execute a search warrant on CIA Executive Director Kyle "Dusty" Foggo and the same day that it was reported that her investigation had spread to Rep. Jerry Lewis (R-CA), Alberto Gonzales' chief of staff Kyle Sampson wrote to a White House official: "The real problem we have right now with Carol Lam that leads me to conclude that we should have someone ready to be nominated on 11/18, the day her 4-year term expires."

-- On January 5th, 2007, less than a month after Lam had been told she was fired, but before it had been made public, Sampson wrote to his Justice Department colleagues, "... we granted 1-month extensions for [U.S. Attorney for Nevada Daniel Bogden] and [Western Michigan's Margaret Chiara], but not Carol -- right?" Lam was widely known to be leading a grand jury investigation into Foggo and others. Ultimately, she was granted a fifteen day extension, from January 31 until February 15; she ordered her office to bring the indictment against Foggo before she stepped down, and she succeeded.

I thought that Lam was either a real push-over or overtly loyal to the Republican ideology when she ducked commentary on the reasons behind her dismissal. Now, I'm not so sure. Looking into the #3 guy at CIA, huge private contractors, uncovering links to Senior Senators who are a crooked as a circle (see Duke Cunningham and Jerry Lewis and others closely tied to the military industrial complex), and getting static from the highest levels of White House? The woman is probably scared s*&%less. I know I would be if I was messing around with those people and that kind of money. I'm no conspiracy theorist, but this sounds like a bad Robert Ludlum book or something. If I were Lam, I'd stand WAAYYY back from the corners when I was crossing the street.

I read this from a commenter on Firedoglake. Why are there no emails about how the current cases will be continued to be covered? Anything at all on transition of prosecution on the big corruption cases? Why didn't that dog bark? Could it be that there was no plan to continue pursuing those investigations?

One other item in the timeline: on the morning of May 11, before the "we have a problem with Lam" email, the LA Times broke the story to the public that the investigation was going after Jerry Lewis, who was the chair of the most powerful (in terms of money) committee in the House.

I think the key to understanding why the Patriot Act was amended to allow the replacement of USA's is directly related to Lam, and she had been on the Administration's radar for a long time. According to the San Diego Union Trib, Lam had a reputation for prosecuting white collar crime and had been moving swiftly since 2003's raid on San Diego City Hall toward investigating the higher echelons of so. Cal politicians. As Lam got closer and closer to the big republican players, the urgency to do something about her grew. In March 2005 when Titan Corp admitted to bribery under Lam's tenure, I think that was the last straw. The DOJ mentioned her by name as a weak performer for the first time (that we know of) in the March 2, 2005 list emailed from Sampson to Miers. In June 2005 the Cunningham investigation starts, and in July his house is raided by the FBI. Then in August, the Republicans start making immigration arguments against her. By September, Duke Cunningham, Duncan Hunter, and Lewis all signed a letter to the President complaining about Lam. And on November 9, 2005 Brett Tolman emails Moschella that he will get the fix in on the Patriot Act. I think the timeline speaks for itself.

What about the emails on the RNC servers? Couldn't they have been discussing all that outside the government system?

I sure hope Waxman gets ahold of all those emails! That could really blow things wide open if they thought nobody would figure out that they were using a separate system for communication of things they didn't want a record of.

Didn't the DOJ respond to a California senator/congressman (not Issa, it was a democrat and I want to say Feinstein) in regards to Lam's performance on immigration issues? As I recall, the letter was sent in the summer of 2006 and it contained no hint that the DOJ was anything other than satisfied with her performance on the issue.

If her performance on the subject truly was subpar, shouldn't the letter have stated that the DOJ was unhappy, looking into alternatives,...

What is the present state of knowledge regarding the physical paper trail of the dismissal proceedings regarding Lam? Where is the documentation drawn up to prepare for the transition? What is typical when there is a changeover at the US Attorney's office? Even when there is a changeover of Administrations, what kind of paperwork gets drawn up.

While the impressive work regarding the email records is invaluable, I am equally curious about the plain ol' record of letters, contracts, disposition of retirement income and health insurance, etc. Also, has anybody looked into the communications between the DOJ and Lam's current employer?

It is impossible to prove that there was no evidence that she had ever been confronted with a performance appraisal complaining about her immigration policy. Unless you have a video crew following her 24-7, you can't prove it with 100% certainty.

What has been proven thus far, and I would argue proves beyond a reasonable doubt, is that no performance appraisal took place. The reasons, in addition to Kiel's are as follows:
1. The DOJ and WH have both the resources and the incentives to release this information. There is no incentive for holding back this information. Yet, no performance appraisal has been released. Why is this?
2. Other than Ryan, no performance appraisal exists for any of the other fired prosecutors. Again, why is this?
3. The DOJ has e-mails showing that they hadn't looked at Bogden's record before he was fired. Given the lack of a performance appraisal for anyone else, it isn't a leap of faith to assume that no performance appraisals exist for others either.

To me, this is because no performance appraisal took place and proves beyond a degree of reasonable doubt. Positive evidence to prove Kiel's assumption is impossible, as of right now the void of evidence, with the incentives for the WH to provide the evidence, makes the assumption that performance wasn't the reason operative.

I may be wrong again, but I would geuss that is what was meant by the "we should talk about this on the phone" comment, they kept all conversations about those investigations out of their email communication loop, an act which in and of itself constituted a conspiracy.

And the proof is not a particular email, except maybe that tiny excerpt I alluded to, it is in the ABSENCE of any electronic communication concerning Lam's investigations into Foggo, et al.

Sometimes, absence is more conspicuous than appearance.

Can Waxman's committee empanel some grand juries or sub-committees to concentrate on some of these issues? There's so much to deal with, it seems like we would all be better off if there were specific panels to engage particularly guilty parties.

While it is true that a Rove "impeachment" (not legally possible, but certainly a comforting delusion) or just an under-oath investigation, would probably tie all of these investigations together, and to Cheney.

But considering so many options on one committee is difficult, at best.

Seems to me the appointment of more than ONE special prosecutor is in order in these days of discovery. And with majority in both houses, it should not be nearly as difficult to reinstate the special prosecutor laws. Anyone who voted against them would be clearly in cahoots, and subject to extreme public scrutiny themselves before their next election.

I thought it was just another example of serious prosecutors never saying more than they have to. Another example is Patrick Fitzgerald's statements after the Libby trial. Seemed perfectly in character for the kind of job she does.

I would say that corruption cases are more important, especially in this case. These bribes involove Defense contracts, which equals National Secuity, which equals Crime Against All Americans. I don't think an immigration case has as much impact.

the trick is, they can't talk about ongoing investigations anymore than the fired USAs could talk to the members of congress who were trying to muscle them...

but i'm sure the questions can be framed in such a way that gets an amswer other than 'i can't talk about an ongoing investigation'.

it's not the way you're reading them. it should be made clear that sworn testimony is the basis for the part about lam never being confronted.

Thank you Paul Kiel for efforts such as this post. There is so much there there it's sometimes hard to abstract it all. Hard not to get obsessed; really, another great roundup.
I think Sampson's e-mails of April and May about some plan to create a pretext for Lam's axing are key. They come in light of, I believe March's passage of the patriot act. You can make a damning case just focusing on Lam. Does anybody know who is going to question Sampson Thursday? I hope they keep it simple. Investigate.

First off, TuiMel, it's also worth noting that Lam herself said in her congressional testimony that she had never been confronted about the immigration issue.

She also gave a careful explanation of her immigration enforcement strategy, saying that she was going to focus on the bigger cases and leave some of the smaller stuff to local authorities. I have not seen any reporting on how that effort worked out. I would like to.

However, there is some evidence those of us on the suspicious side of this argument have to consider.

Most convincing to me:

1) Gonzales DID send more prosecutors to San Diego to focus on immigration in the summer of 2006. I learned this from TPM. Is it really possible he sent 20 more prosecutors to Carol Lam and they didn't discuss whether immigration was a high enough priority? 2) And there is the email below from Sampson which was posted in the comments from the TPM article above. The email may be a smokescreen, but it is one of the things which does need to be explained away to make the case that immigration had NOTHING to do Lam's firing.

I'm NOT claiming firing her was okay – even if she WAS fired over immigration, that is still terrible management since she had such high-profile success with the Cunningham case. One way or another, It sent a terrible signal to other prosecutors that successfully pursuing Republican corruption didn't win points with the DoJ poobahs.

AG has given additional thought to the SD situation and now believes that we should adopt a plan - something like the following:

• Have a heart-to-heart with Lam about the urgent need to improve immigration enforcement in SD;
• Work with her to develop a plan for addressing the problem - to include alteration of prosecution thresholds; additional DOJ prosecutors; additional DHS SAUSA resources; etc.
• Put her on a very short leash;
• If she balks on any of the foregoing or otherwise does not perform in a measurable way by July 15 (my date], remove her.
• AG then appoints new USA from outside the office.

This seems to me like the sort of thing for ODAG and EOUSA to execute. Can you think about how to do this right, tune up my plan/list of bullets, and be prepared to (1) present such plan to the AG tomorrow or early next week for his approval and (2) execute the plan next week?

Carol Lam is the canary in the coal mine: It was her name, and the cases she was prosecuting, that made me take notice from the moment the story broke in December. As more information becomes available, we see that many of the US Attys were pursuing cases that the WH might not like (or not pursuing so-called voter fraud, or both), but Carol Lam's case is the one to watch. Because the particular tentacles of corruption she was in the process of revealing almost certainly reach right into the WH.

How about the fact that Lam was on the short list to be fired from early 2005 (and she was the only who was always on the list, except for Cummins who was forced out earlier than the rest). The WH and DOJ has already decided to get rid of her long before they decided that immigration was the excuse.

Kindadukish, the date on that email invalidates any reasonable use it might have to exculpate Samson and Gonzales. The decision to remove Lam had been made by the time this email was released. This email details how they were planning to gin up a justification for removing her. It's a classic corporate dismissal. You micro-manage a middle manager to the point where they quit out of humiliation or frustration, or you force a mistake or confrontation that you can justify to remove them.

It is disingenuous to select an email that was quite obviously written for the benefit of future investigators and cite it as evidence of good faith. Everything about Carol Lam's firing stinks. If there was no intention to derail her, then what is the status of the U.S. Attorney's investigation into MZM?

It's easy to get carried away but let's recognize that in fact this stuff doesn't happen here in the US. As bad as things seem corruption wise this most efficient means of silencing people simply doesn't happen here.

Think about it. I mean really think about it. It's pretty important not to ever imply in mixed company that physical threats are made or carried out or ever even implied by our GOP advisaries. It's a very bad arguement because there is no instance of it happening and it will make people envision you with a tin foil hat.

I know all about the elimination talk and it's encouragement by ever higher orders of GOP politicians. This is pretty much a seperate issue. It is a real and serious issue but in any of its itterations it pertains to citizens going crazy, not governement officials.

Having said all that I fear for the life of the prospective Democratic presidential nominee. Depending upon who it is my fear in rising order would be Edwards, Clinton, Obama.

Lam is held in high regard here locally in San Diego as an attorney and former judge. In regards to earlier comments that she probably was quiet about her forced resignation out of fear of retribution, I don't think so. It's a well-known fact here that she honestly had NO IDEA why she had been asked to resign, but that info came from those around her and not directly herself. It is neither her personal nor professional style to go public to make a scene. In fact, she continued to manage her office very cooly and professionally after it became public knowledge that she had been told to resign.

I have not always agreed with some of her prosecutions here in San Diego, but I could never say that she was insincere about pursuing what she believed was in the public interest. Her ethics and values make her a hero to me.

Btw, as I recall, she was a compromise appointment. Back in 2001, since there was no Republican senator from California, she was appointed to the position because of her independent partisan affiliation to appease Feinstein on the Judiciary Committee. She made it clearly known then to those who appointed her AND to the public that her number one priority would be white-collar crime (not immigration). She stuck to her guns and will go down in history for getting fired for doing the job that she promised to do!

I have been a (State) Prosecutor. Prosecutors rely on their affiliate law enforcement personnel to supply the evidence which proves the case. A conscientious DA bonds with conscientious cops. Lam was stewarding cases built by the FBI. The FBI chief in San Diego expresses his frustration, as cited in the original post. Recognize the context: this may have been years of police work building a case, and law enforcement invests in the work and the justice of the outcome. The FBI perspective is not partisan. They probably look right past the politics (which they understand), to the fact that their case is being undermined, squandered. If the FBI chief knew that Lam's successor would be pursuing the case (with professional diligence) he could afford to keep his mouth shut. Therefore, I conclude that the FBI knows that Lam's ouster EQUALS the sabotage of the case, regardless of pronouncements yet to come that the case is still alive. Think how our tax dollars have been wasted (overall investigation, witness development, accounting work, legal research). Consider how demoralizing this is for the investigators. These are largely unrecognized collateral damage from the Executive's Obstruction of Justice.

It is pretty clear from the email reported here and what I have downloaded and read, that the DoJ and WH staff were being very careful to keep the real reasons for firing these attorneys out of their email communication to avoid getting caught. In the one email speaking about the real reason for needing to get rid of Lam, there was an explicit request for the recipient to call and discuss. Phone calls are generally not recorded and less likely to damage the perpetrators, unless the participants are put on the stand under oath and asked specific questions about what was discussed.
