AP: Sampson to Ask, What's Political Mean, Anyway?

From the AP:

Eight federal prosecutors were fired last year because they did not sufficiently support President Bush's priorities, Attorney General Alberto Gonzales' former chief of staff says in remarks prepared for delivery Thursday to Congress.

"The distinction between 'political' and 'performance-related' reasons for removing a United States attorney is, in my view, largely artificial," said Kyle Sampson.

The aide, who quit because of the furor over the firings, is to testify before the Senate Judiciary Committee. A copy of his prepared remarks was obtained Wednesday by The Associated Press.

"A U.S. attorney who is unsuccessful from a political perspective ... is unsuccessful," Sampson said.

This is gonna be fun.

So, does he think Obstruction of Justice can be circumvented for "political" reasons? What's his definition of "Justice", anyway? If this is not clearly laid out in statutes, then perhaps the time has come for it to be. I think there ought to be a law against removing a U.S. Attorney who's investigating someone either a.) in Congress, or b.) in the White House, unless approved after a review by the Senate and House. Perhaps that's unwieldly, but I think the idea is clear enough. Hopefully such laws will be considered by the current Congress.

I've posted the info elsewhere, but if you really want to know what the president's priorities were and are, check out that study that came out last month that Paul Krugman cited in his column (and has been cited several times on this blog and elsewhere), the one that found that local democratic officials were 7 times more likely than Republicans to be investigated, indicted and prosecuted. In Memphis, the FBI and U.S. Attorney's office concocted an elaborate sting (set up a fake computer company with fake executives and bagmen) to net democrats. A local Memphis-based blog ran a post on Friday which included what the hosts purport to be an actual discussion between FBI agents and a suspect they are pumping for information. They specifically ask for any dirt he knows about Democrats. They tell him they want Democrats taking payoffs or involved in other corrupttion. The sting netted about 8 Democrats and one (token, insignificant Republican who quickly pled guilty and is already out of prison). The trial for the biggest fish netted to date starts April 9. He is John Ford, brother and uncle to former U.S. Congressmen Harold Ford, Sr. and Harold Ford, Jr., respectively. In another sting, another brother/uncle of the Harolds was indicted, City Counciman Edmond Ford. An ongoing probe of evertything and anything he might ever have done in his life led the FBI to subpoena his utility bills from Memphis, Light Gas & Water. This in turn led to another "scandal" that you may have read about in the New Times recently. U.S. Attorney Gretchen C.F. Shappert of Charlotte was among the attorneys whom federal Justice Department officials wanted removed as part of a sweeping housecleaning this winter, according to e-mail messages released this week to the House and Senate judiciary committees.
Shappert, a Republican who has been on the job since May 2004, was on a list under the category, "USAs [U.S. attorneys] We Now Should Consider Pushing Out," according to the e-mail messages.

In the end, she was allowed to stay on.

It is unclear why Shappert was under scrutiny. But among her prosecutions in the past year was that of Sam Currin, a top figure in North Carolina Republican circles.

Currin and two co-defendants were indicted in April. Currin was charged with seven felonies, including tax fraud conspiracy, perjury, obstruction of justice and witness tampering in a fraud case involving offshore investments. He pleaded guilty to three charges in November and is awaiting sentencing.

Currin is a former U.S. attorney who worked in the Raleigh office covering the Eastern District. He also is a former Superior Court judge and former chairman of the state Republican Party.

Shappert is the latest name to surface in the ongoing Washington scandal involving the firing of eight U.S. attorneys across the country. The Justice Department initially said the attorneys had poor performance reviews, but interviews and testimony before Congress show that some attorneys felt pushed to step up investigations into Democrats or go lightly on Republican targets.

The one thought that might be scariest of all is if this AG thing is only a smoke screen laid by the anti-Christ, Rove, to cover even more incriminating plots. The entire issue is moot.

The only important part of Sampson's testimony will be the questions, which should be used to nail down the various ways in which the Congress was misled, and the various ways in which the emails make it clear that it was the DOJ's and White House's intention to mislead.

That particular net will snare quite a few fish, and they can't be allowed to escape by trying to "correct and clarify their remarks" after the fact.

What's amazing to me is that federal prosecutors need witnesses to testify to prove their cases, yet the justice dept. officials won't testify to congress.

They want average citizens to do their part (as witnesses) so the justice system will work. Yet the justice department employees won't do their part. When it's a bit uncomfortable for them, they take the fifth before they are even asked a question.

What kind of example is that?

Not that it really needs to be said at this point, but I think there's a big difference between focusing on issues that are part of your political ideology, like immigration or being lax on environmental laws. That I would criticize, but you won the election so you get to do that.
