DoJ: What Policy?
I'd be remiss if I didn't link to McClatchy's great big picture story on GOP efforts to hype voter fraud efforts in Missouri last election cycle.
Bradley Schlozman, of course, was a major part of that effort. He was dispatched to be the U.S. attorney in Kansas City, and as I reported earlier this week and as McClatchy reports, he brought indictments against four ACORN workers just five days before the election on voter fraud charges.
Those indictments flew in the face of longstanding Justice Department policy not to conduct election crime investigations shortly before an election. I won't repeat my earlier reporting on this here, but suffice it to say that the investigation appears to have been conducted with some haste in order to land the indictments before the election.
No reasonable person could argue that Schlozman's indictments were not a gross breach of department policy. But that doesn't mean that the Justice Department isn't trying.
From McClatchy:
Justice Department spokesman Dean Boyd said the policy that prosecutors "refrain from any conduct which has the possibility of affecting the election" didn't bar pre-election indictments and was intended to ensure that investigators didn't intimidate voters during an election. Boyd said officials in the department’s Public Integrity Section approved the indictments.
Got that? A highly-publicized indictment targeting an organization that had registered tens of thousands of poor and minority voters didn't run the risk of intimidating them.
I think simply quoting from the Justice Department's manual, "Federal Prosecution of Election Offenses" is a sufficient rebuttal:
In investigating election fraud matters, the Justice Department must refrain from any conduct which has the possibility of affecting the election itself.... Federal prosecutors and investigators should be extremely careful to not conduct overt investigations during the pre-election period or while the election is underway.... Thus, most, if not all, investigation of an alleged election crime must await the end of the election to which the allegation relates.It should also be kept in mind that any investigation undertaken during the final stages of a political contest may cause the investigation itself to become a campaign issue. Many, if not most, allegations during this period come from political partisans who are actively involved in the election. It is not unreasonable to assume that such complainants may be seeking to trigger a criminal investigation of an opponent just before the election.

Weasel Watch Needs to take a look at Schlozman wrote on May 4, 2007 7:22 PM:Schlozman is yet another scumbag that needs to be forced to testify under oath. NPR did a story about him yesterday on All Things Considered titled "Attorneys Scandal May Be Tied to Missouri Voting" (you can listen to it at the NPR website). It has a clip of Schlozman's voice, claiming his prosecutors are not motivated by politics in any way (LOL!)- he sounds incredibly weaseley, almost like a cartoon character. Joseph Rich, a 36 year employee claims there has never been this level of politicization in the civil rights division, and that Scholzman "forced him to falsify performance reviews and that he imposed a political litmus test on new hires." I am not seeing this report being picked up- according to this longtime employee he says in the interview Schlozman forced him to FALSIFY performance reviews. Surely that is illegal.

Falsifying performance reviews must be illegal. When I was in corporate work, you just about had to jump through hoops to justify firing somebody. That's why the US Atty scandal stinks: No paper trail (as required by law, I think) and shifting reasons, depending on how the wind blows.

From what I know of the people at Public Integrity, at least during Bush's first term, if they thought something fishy was up, they wouldn't have signed off on it. For the most part, they're career DOJ people and really bright people (from real schools, not Regent...) who get the jobs through the normal merit process, not patronage placements. So to me, this indicates either (1) there's been high turnover at Public Integrity since Gonzalez took over to the point where the hacks are now in charge or (2) Boyd's lying or being misinformed. Or maybe Public Integrity is just so busy these days that a slip-up is inevitable. I don't know. In any event, it seems unusual to the extent that Public Integrity has been, I think, one of the few shining beacons in DOJ.

I actually agree with the policy as it stands. But I also think it is a policy that is kind of up for both (a) interpretation and (b) change. Look, the fact is the American People got what they paid for in electing GWB to a second term.
It's just an internal DOJ policy about how to exercise prosecutorial discretion. Again, I think it is substantively a good policy. But still. That kind of policy is not a law, it is set by the leadership of the agency. Leadership of our executive branch agencies are political appointees. That's how it works in our system. Don't like it, vote 'em out. Too bad we didn't.

Rich's accusation that Schlozman was making hires on a political basis begs the question why Monica Goodling is now being investigated by DOJ for doing that, but Schlozman was just given a cush gig inside Main Justice after his brief tenure as USA in the Western District of MO came to an end.
Could the difference be that Goodling needed the hint to stay quiet if she is granted immunity and is forced to testify before Congress, while Schlozman has totally carried Bush's water on this deal?

Look, the fact is the American People are allowed to get upset when the duly elected President turns out to completely and utterly corrupt, regardless of whether they come to that realization during his/her first or second term. Listen, you can quibble with procedural niceties regarding the less-than-binding-effect of "internal DOJ policy" all you want, but at the end of the day you're left with the fact that all of this bullshit was happening at the direction of the White House. Scholzman, in all liklihood, was simply doing what he thought he had to do to make Bush like him. The great irony is that their best-laid plans for Missouri utterly failed and are now exploding their faces.

Schlozman's indictments came 5 days before the election. Schlozman could have waited until after the election to make his filing as per DOJ policy. The people had already been turned over. Voter fraud is wrong. But what Schlozman did was against DOJ policy and totally unnecessary. IMO he did it only to attempt to influence the election.
And the lawsuit Schlozman filed againt the State of Missouri for failing to update voter lists was thrown out by a Federal judge. So it seems that Schlozman jumped the gun here also.
Schlozman is clearly a Bushie even so far as to force the falsification of performance reviews. And he gets rewarded. What a joke!

It doesn't mention that ACORN had caught the employees and fired them weeks earlier though. It would be unAmerican to not allow them the right to vote, just as what the Republican Party is doing is UnAmerican. Why do Republicans hate America? Why do they hate black people?
One thing this article DOES leave out is Joseph Rich's charge that Schlozman forced him to falsify performance reviews and imposed a political litmus test on new hires- and the fact Schlozman has been given a new job despite these charges. Or the fact Goodling is under investigation for doing what Schlozman is accused of doing- yet there is no word on an investigation of Schlozman.

Everything else was secondary, if not completely marginal to him, especially legal precedent and existing statutory regulations that might get in the way.
In his own eyes, Schlozman was just doing his "job," which was, apparently, to foment political prosecution. But all he had to work with was some wayward and independently devious Acorners, acting on their own trivial greed.
Again, the Bushies' hubris made them believe Rove's 4th-Reich promises of a thousand years of Republican rule. When the Dems won back Congress in 2006, thier delusions should have been shattered, but unfortunately for them, they just refuse to read the epitaph on thier own political grave.
These guys really do believe they live in a different legal status that the rest of us. When you make people like that your legal standard, we get exactly what we have today. An can anyone doubt that somewhere in these emails, there will be one from the WH to Shlotzman saying "You're doin' a heckuva job, Shlotzie!!!"

at what point were these indictments publicized by the Rove PR department?
there was a big push on talk radio to detract from GOP election fraud by publicizing, exaggerating, and even fabricating election fraud by Dems, illegal aliens, and brown people in general. talk radio is the medium used for PR when they want to say anything they want without responsibility, create buzz, and establish 'rumors' that can then go mainstream.
were there any hints of the indictments leaked for talk radio before they were made public in TV and print?
as late in the game as those indictments came down there must have been some communication between this hack and the White House to coordinate the PR campaign.

In the Radio Act of 1927, Congress mandated the FCC’s forerunner, the Federal Radio Commission (FRC), to grant broadcasting licenses in such a manner as to ensure that licensees served the “public convenience, interest or necessity.” As former FCC commissioner Nicholas Johnson pointed out (California Lawyer, 8/88), it was in that spirit that the FRC, in 1928, first gave words to a policy formulation that would become known as the Fairness Doctrine, calling for broadcasters to show “due regard for the opinions of others.” In 1949, the FCC adopted the doctrine as a formal rule (FCC, Report on
Editorializing by Broadcast Licensees, 1949). In 1959 Congress amended the Communications Act of 1934 to enshrine the Fairness Doctrine into law, rewriting Chapter 315(a) to read: “A broadcast licensee shall afford reasonable opportunity for discussion of conflicting views on matters of public importance.” "A license permits broadcasting, but the licensee has no constitutional right to be the one who holds the license or to monopolize a...frequency to the exclusion of his fellow citizens. There is nothing in the First Amendment which prevents the Government from requiring a licensee to share his frequency with others.... "The Wall Street Journal's editorial board is confusing the Equal Time principle in current law with the Fairness Doctrine, a policy which the FCC abandoned in August 1987. The Fairness Doctrine, instituted in 1949, required licensees to "Cover vitally important controversial issues of interest in their communities" and to "Provide a reasonable opportunity for the presentation of contrasting viewpoints." The Fairness Doctrine also codified what became known as the "Personal Attack Rule" and the "Editorial Rule." The Personal Attack Rule required broadcasters to notify the subjects of on-air personal attacks that an attack had occurred, and to then provide them with an opportunity to respond. Similarly, the Editorial Rule allowed political candidates to respond either to criticisms or to station endorsements of another candidate." - Media Matters
"There are many misconceptions about the Fairness Doctrine. For instance, it did not require that each program be internally balanced, nor did it mandate equal time for opposing points of view. And it didn’t require that the balance of a station’s program lineup be anything like 50/50. Nor, as Rush Limbaugh has repeatedly claimed, was the Fairness Doctrine all that stood between conservative talkshow hosts and the dominance they would attain after the doctrine’s repeal. In fact, not one Fairness Doctrine decision issued by the FCC had ever concerned itself with talkshows. Indeed, the talkshow format was born and flourished while the doctrine was in operation. Before the doctrine was repealed, right-wing hosts frequently dominated talkshow schedules, even in liberal cities, but none was ever muzzled (The Way Things Aren’t, Rendall et al., 1995).
The Fairness Doctrine simply prohibited stations from broadcasting from a single perspective, day after day, without presenting opposing views. (ala FOX, despite FOX's constantly repeated self-proclamation of somehow being "Fair And Balanced" -ed). In answer to charges, put forward in the Red Lion case, that the doctrine violated broadcasters’ First Amendment free speech rights because the government was exerting editorial control, Supreme Court Justice Byron White wrote: “There is no sanctuary in the First Amendment for unlimited private censorship operating in a medium not open to all.” In a Washington Post column (1/31/94), the Media Access Project (MAP), a telecommunications law firm that supports the Fairness Doctrine, addressed the First Amendment issue: “The Supreme Court unanimously found [the Fairness Doctrine] advances First Amendment values. It safeguards the public’s right to be informed on issues affecting our democracy, while also balancing broadcasters’ rights to the broadest possible editorial discretion.” Indeed, when it was in place, citizen groups used the Fairness Doctrine as a tool to expand speech and debate.
For instance, it prevented stations from allowing only one side to be heard on ballot measures. Over the years, it had been supported by grassroots groups across the political spectrum, including the ACLU, National Rifle Association and the right-wing Accuracy In Media. Typically, when an individual or citizens group complained to a station about imbalance, the station would set aside time for an on-air response for the omitted perspective: “Reasonable opportunity for presentation of opposing points of view,” was the relevant phrase. If a station disagreed with the complaint, feeling that an adequate range of views had already been presented, the decision would be appealed to the FCC for a judgment. According to Andrew Jay Schwartzman, president of MAP, scheduling response time was based on time of day, frequency and duration of the original perspective. “If
one view received a lot of coverage in primetime,” Schwartzman told Extra!, “then at least some response time would have to be in primetime. Likewise if one side received many short spots or really long spots.” But the remedy did not amount to equal time; the ratio of airtime between the original perspective and the response “could be as much as five to one,” said Schwartzman.
As a guarantor of balance and inclusion, the Fairness Doctrine was no panacea. It was somewhat vague, and depended on the vigilance of listeners and viewers to notice imbalance. But its value, beyond the occasional remedies it provided, was in its codification of the principle that broadcasters had a responsibility to present a range of views on controversial issues. From the 1920s through the ’70s, the history of the Fairness Doctrine paints a picture of public servants wrestling with how to maintain some public interest standards in the operation of publicly owned but corporate-dominated airwaves. The 1980s brought Regan with an army of anti-regulatory extremists; not least among these was Reagan’s new FCC chair, Mark S. Fowler. Formerly a broadcast industry lawyer, Fowler earned his reputation as “the James Watt of the FCC” by sneering at the notion that broadcasters had a unique role or bore special responsibilities to ensure democratic discourse (California Lawyer, 8/88). It was all nonsense, said Fowler (L.A. Times, 5/1/03): “The perception of broadcasters as community trustees should be replaced by a view of broadcasters as marketplace participants.” To Fowler, television was “just another appliance-it’s a toaster with
pictures,” and he seemed to endorse total deregulation (Washington Post, 2/6/83): “We’ve got to look beyond the conventional wisdom that we must somehow regulate this box.”
Of course, Fowler and associates didn’t favor total deregulation: Without licensing, the airwaves would descend into chaos as many broadcasters competed for the same frequencies, a situation that would mean ruin for the traditional corporate broadcasters they were so close to. But regulation for the public good rather than corporate convenience was deemed suspect. Fowler vowed to see the Fairness Doctrine repealed, and though he would depart the commission a few months before the goal was realized, he worked assiduously at setting the stage for the doctrine’s demise. He and his like-minded commissioners, a majority of whom had been appointed by Reagan, argued that the doctrine violated broadcasters’ First
Amendment free speech rights by giving government a measure of editorial control over stations. Moreover, rather than increase debate and discussion of controversial issues, they argued, the doctrine actually chilled debate, because stations feared demands for response time and possible challenges to broadcast licenses (though only one license was ever revoked in a dispute involving the Fairness Doctrine- California Lawyer, 8/88).
The FCC stopped enforcing the doctrine in the mid-’80s, well before it formally revoked it. As much as the commission majority wanted to repeal the doctrine outright, there was one hurdle that stood between them and their goal: Congress’ 1959 amendment to the Communications Act had made the doctrine law. A controversial 1986 legal decision by Judge Robert Bork and then-Judge Antonin Scalia, both Reagan appointees on the D.C. Circuit of the U.S. Court of Appeals in a 2-1 opinion avoided the constitutional issue altogether, and simply declared that Congress had not actually made the Fairness Doctrine into a law. Wrote Bork: “We do not believe that language adopted in 1959 made the Fairness Doctrine a binding statutory obligation,” because, he said, the doctrine was imposed “under,” not “by” the Communications Act of 1934 (California Lawyer, 8/88). Bork held that the 1959 amendment established that the FCC could apply the doctrine, but was not obliged to do so-that keeping the rule or scuttling it was simply a matter of FCC discretion. “The decision contravened 25 years of FCC holdings that the doctrine had been put into law in 1959,” according to MAP. But it signaled the end of the Fairness Doctrine, which was repealed in 1987 by the FCC under new chair Dennis R. Patrick, a lawyer and Reagan White House aide. A year after the doctrine’s repeal, writing in California Lawyer (8/88), former FCC commissioner Johnson summed up the fight to bring back the Fairness Doctrine as “a struggle for nothing less than possession of the First Amendment: Who gets to have and express opinions in America.”
Though a bill before Congress to reinstate the doctrine passed overwhelmingly later that year, it failed to override Reagan’s veto. Another attempt to resurrect the doctrine in 1991 ran out of steam when George H.W. Bush threatened another veto. What has changed since the repeal of the Fairness Doctrine? Is there more coverage of controversial issues of public importance? “Since the demise of the Fairness Doctrine we have had much less coverage of issues,” says MAP’s Schwartzman, adding that television news and public affairs programming has decreased locally and nationally. According to a study conducted by MAP and the Benton Foundation, 25 percent of broadcast stations no longer offer any local news or public affairs programming at all (Federal Communications Law Journal, 5/03). The most extreme change has been in the immense volume of unanswered conservative opinion heard on the airwaves, especially on talk radio. Nationally, virtually all of the leading political talkshow hosts are right-wingers: Rush Limbaugh, Sean Hannity, Michael Savage, Oliver North, G. Gordon Liddy, Bill O’Reilly and Michael Reagan, to name just a few. The same goes for local talkshows. One product of the post-Fairness era is the conservative “Hot Talk” format, featuring one right-wing host after another and little else.
Disney-owned KSFO in liberal San Francisco is one such station (Extra!, 3-4/95). Some towns have two. When Edward Monks, a lawyer in Eugene, Oregon, studied the two commercial talk stations in his town (Eugene Register-Guard, 6/30/02), he found “80 hours per week, more than 4,000 hours per year, programmed for Republican and conservative talk shows, without a single second programmed for a Democratic or liberal perspective.” Observing that Eugene (a generally progressive town) was “fairly representative,” Monks concluded: “Political opinions expressed on talk radio are approaching the level of uniformity that would normally be achieved only in a totalitarian society. There is nothing fair, balanced or
democratic about it.” For citizens who value media democracy and the public interest, broadcast regulation of our publicly owned airwaves has reached a low-water mark. In his new book, Crimes Against Nature, Robert F. Out of curiousity, is Schlozman gay? He doesn't appear to be married. Someone named S. L. Eaton is listed at 717 Slaters Lane in Alexandria, Schlozman's home address, but Schlozman is 717B and Eaton could be 717A.
Schlozman's property is sometimes listed as 717B Massey Lane in Alexandria but it is apparently the same property listed at 717B Slaters Lane.
Someone at 717 Slaters Lane is running a child care service business named "A Place Like Home Daycare" but again, it could be the person who lives at 717A Slaters Lane.
A couple of Schlozman's cases are interesting. I'm curious as to what was behind the one in Pennsylvania which involved absentee ballots. I'm wondering if another one in California was an excuse to take a vacation there a la Kyle Sampson's big Palm Beach criminal case.

According to a 2/26/07 Legal Times story by Jason McLure about the slow pace of the Jack Abramoff case, "No End in Sight for Abramoff Investigation" (link below), Edward Nucci is a former federal prosecutor in Miami.
From Legal Times:
"The public integrity section has seen similar flux. [Noel] Hillman, a former prosecutor in New Jersey and protégé of Homeland Security Secretary Michael Chertoff, supervised the case from its beginnings until he was nominated to a federal judgeship in New Jersey. Hillman left the section in January of 2006, shortly after helping arrange Abramoff’s plea, a deal that required coordinating with the U.S. Attorney’s Office in the Southern District of Florida on a parallel investigation into Abramoff’s purchase of a casino company known as SunCruz.
Hillman has been succeeded by a number of acting chiefs. His initial replacement, Andrew Lourie, left for another Justice Department post in Florida last summer. Lourie was then succeeded temporarily by another prosecutor, Brenda Morris, who was in turn replaced this summer by current acting chief Edward Nucci, a former federal prosecutor in Miami.
The turnover meant that new prosecutors had to be brought up to speed on the inner workings of a complex and closely scrutinized case.
“That whole section seemed like it was in transition,” says a government source with knowledge of the case. “You had people leaving and new people coming in.”
Choosing leadership of both sections falls to [Alice] Fisher, the head of the DOJ’s Criminal Division. But so far there’s been no indication when permanent bosses for either of the sections handling the Abramoff case will be named. The Justice Department declined to comment on the time line for naming permanent replacements..."

PROCEDURAL POSTURE: Defendant, a political party director, was convicted by a federal jury in the U.S. District Court for the District of New Hampshire of conspiracy to make or cause the telephone of another repeatedly or continuously to ring, with intent to harass any person at the called number, and in aiding and abetting another in doing so, in violation of 47 U.S.C.S. § 223(a)(1)(D). Defendant appealed.
OVERVIEW: Defendant's first and most far-reaching claim of error related to the proper meaning of § 223(a)(1)(D)'s "intent to harass" requirement. The court sided with defendant on the issue. The district court's jury instruction broadened the statute unduly. To equate harassment with any repeat calling done in bad faith was to enlarge the scope of the statute. The court read subsection (D) to require an intent to provoke adverse reactions in the called party and held that a bad motive of some other kind standing alone was not enough. Regarding acquittal on the conspiracy and aiding and abetting convictions, there was testimony that would have allowed a properly instructed jury to conclude that defendant knew that the disruption was to be caused by multiple phone calls made in order to tie up phone lines. Also, defendant knew that the scheme if carried out would have disrupted communication; but, he may not have cared about the subjective reaction of the persons at the receiving end. However, a jury could have convicted defendant under subsection (D) on the evidence unless a purpose to harass was required; the purpose issue, not developed by either side on appeal, was left for remand.
OUTCOME: The court reversed the judgment of conviction and sentence; the court remanded the case to the district court for further proceedings consistent with the court's opinion.

Fla., in response to concerns by the Muslim and minority communities there about the unfair disparate impact of antiterrorism investigations on them -- wasn't all too encouraging. I will say that it seems a tad speculative to infer that Nucci deliberately tanked the Tobin appeal -- but, sadly, we're at a point now where such questions still have some traction. As noted, Eric F. Kayira of 3945 Hartford Ave in St Louis MO was a director of the American Center For Voting Rights Fund, according to AC4VRF's 2005 990.
At the time, Kayira was "of counsel" at Lathrop & Gage from 2001 to 2006. He is now with another St Louis firm, Blackwell Sanders (link below). On the BS website, Kayira lists himself as "American Center for Voting Rights, Vice President."
Not for nothing but Kayira is black. How does a black guy get so far away from being black that he actively supports the disenfranchisement of black voters?

In 2004, prominent Kansas City Republican Jack Craft joined the firm, as did his Harold Fridkin, who is prominent in local Democratic circles.
The firm launched its Washington affiliate in 1994. The affiliate, which is staffed by two lawyers, has two components: a government relations practice, which includes lobbying, and a commercial debt collection practice.

The Democratic Party of Missouri issued the following news release:
Just one day after Republican legislators proposed a plan to outlaw third-party management of fee offices, the Missouri Democratic Party today called on Gov. Matt Blunt to order all of his fee office operators to disclose their financial arrangements with management companies, so the public can know where their money ultimately is going. Democrats also want Blunt to order the management companies, which the governor's friends run, to disclose all of their owners.
The Associated Press reported in April that the FBI is investigating these management arrangements, which never existed prior to the Blunt administration.
"It's past time for Gov. Blunt to come clean with Missourians about who profits from these fee office management companies and how much of the public's money they receive," said Jack Cardetti, Missouri Democratic Party spokesman. "While we know the Governor's friends run these companies, a concerted effort has been made to hide the identities of others who are making money off this scheme."
While many questions surround the management companies, here are some facts we do know:
* News reports indicate that Blunt allies Garret Lott and Andrew Cohen run a management company that controls the most profitable fee offices on the eastern side of the state. Lott worked on Blunt's gubernatorial campaign and now works on Sen. Jim Talent's reelection effort.
* Stephanie Goodnight runs the company that manages offices on the western side of the state. Goodnight is a cousin of Tracy Graves, a fee office operator and the wife of former U.S. Attorney Todd Graves.
* Gov. Blunt's friend lobbyist Jewell Patek controls the shell companies the fee offices use to hide their transactions from the public. The Associated Press previously reported that Patek would call prospective fee office operators to tell them a limited liability company already had been established to run their offices. Attorneys at Lathrop & Gage, the law firm Gov. Blunt's campaign employs, organized many of these shell companies. According to official bid documents, Patek has financial ties to the governor's brother, Andy Blunt. Also, Patek's lobbying firm employs James Harris' fiancée. Until recently, Harris was Blunt's appointments director and helped award the fee offices.

As noted above, the American Center For Voting Rights (AC4VR) made a $28k grant in 2005 to the Center For Ethics and Free Market at PO Box 16082 in St Louis MO 63105. The purpose of the grant was to promote "voting rights and education."
The problem is that the Center For Ethics and Free Market is a "fictitious domestic registration", according to the Missouri Secretary of State.
Who is behind the Center For Ethics and Free Market?
On the AC4VR website in the internet archives, there is a link to a June 2004 report by the Center For Ethics and Free Market entitled "Laying the Groundwork: A Study of Voter Registraton in Missouri" with a link to the Center's website (link below).
The "Laying the Groundwork" report is on the Center's website. I wonder if AC4VR paid $28k to the Center in 2005 for this 9-page report. If so, AC4Vr paid for a report produced before AC4VR was founded in 3/05.
On the Center's website, it claims to be a Missouri-based non-profit dedicated to promoting ethical standards in public service, accountability in public policy and to the establishment of free market principles in government.
But I can't find any indication that the Center For Ethics and Free Market is a registered non-profit with the IRS or the state of Missouri.
At least two members of the Center's Board of Directors have GOP affiliations. In fact, Richard H. McClure was former Governor John Ashcroft's chief of staff for seven years and before that, deputy chief of staff and assistant to Illinois Governor Jim Thompson (Whew! Some resume!)

The brief is signed by Patrick J. Rogers and Megan T. Muirhead of Modrall, Sperling, Roehl, Harris and Sisk, P.A. as attorneys for Amicus ACVR.
But expenses incurred to prepare this brief would be recorded in 2006, not 2005.

"crack cocaine' the NAACP – Hearne and the Republicans are using racist code words'" Arnebeck said. The Wood County case was withdrawn in June 2005' but not before it was revealed that the plaintiff' Mark Rubick' had been "indemnified" and held "harmless" by an obscure group' the Free Enterprise Coalition' with ties to the Republican Party. Signing as the "Authorized representative" for the Coalition was one Alex Vogel.
Who is Alex Vogel?
This is the same Alex Vogel who is now identified as Senate Majority Leader Bill Frist's attorney. Vogel was busy in December explaining why Frist's so-called AIDs charity' World of Hope' Inc.' paid nearly a half million dollars in consulting fees to his "political inner circle'" according to the Washington Times.
While Vogel fights to keep secret the amount of money that Frist's 96 World of Hope donors gave to the "charity'" his top level political connections are emerging in the media. Vogel co-founded a lobbying firm with Bruce Mehlman' the brother of Republican National Committee Chair Ken Mehlman. Vogel and Mehlman's lobbying firm has close ties with the U.S. Chamber of Commerce.
Arnebeck recently won a ruling against the U.S. Chamber of Commerce' which he claims gave $14 million secretly to Ohio Republican candidates in the 2002 and 2004 election cycle' allowing the GOP to dominate Ohio's Supreme Court.
Vogel also served as a member of the National Republican Senatorial Committee and as parliamentarian at the 2004 Republican Party platform hearings.
Other players tied to Bush-Cheney
While Vogel helped create the voter fraud myth and Hearne acted as the group's general counsel' a man named Jim Dyke acted as spokesperson for the dubious ACVR. Dyke served for many years as Republican National Committee Communications Director. In October' Dyke emerged as a White House spokesperson on National Public Radio pushing the ill-fated nomination of Harriet Miers for the Supreme Court..."

As I noted above, AC4Vr filed a brief in new Mexico in 10/06 and PA lobbyists represented AC4VR as late as 9/06.
AC4VR and AC4VRF didn't file 2005 990s until 11/06 so we probably won't see the 2006 990s until 11/07.
We could ask Deborah A. Kolarich, CPA, if AC4VR and AC4VRF is still active. As I noted above, the books of both entities are in her care, according to the 2005 990s.

I haven't spent any time analyzing the World of Hope 990s but I noticed an odd pattern of donations in 2004. In 8/04, several organizations received a donation of $5k and then $400k-$500k in 11/04.
Revenue in 2004 was $4.5 million but only $62k in 2005. Why 2004 but not 2005?

...Perhaps something is suddenly causing Republicans to try and get on the offensive when it comes to the drumbeat of Election Reform now surging across America.
But it's a brand-spanking new, outta-nowhere, just-in-time-for-yesterday's-hearings, Talon News-like "Voting Rights" organization that has caught our eye for the moment.
As reported here earlier today, the U.S. House Administrative Committee hearings yesterday in Columbus featured testimony from St. Louis attorney, Mark F. (Thor) Hearne, II of the "non-partisan" American Center for Voting Rights (ACVR).
According to Internic records, the ACVR was established on the web just last Thursday and early investigation into this group would seem to indicate that it is little more than a front group for Republican operatives with little or no interest in actual "Voting Rights" at all.
While Hearne is listed as a witness for yesterday's hearings on the U.S. Committee for House Administration website as "National Counsel, American Center for Voting Rights", there is no mention of his affiliation or extensive work for Bush/Cheney '00, '04 and other Republicans.
Hearne, a former Reagan Administration official, is the National Election Counsel to Bush-Cheney '04 Inc. and was Missouri counsel to Bush-Cheney ?00 Inc. As well, he was General Counsel to Republican Missouri Governor Blunt.
He is pictured, at a March 5, 2005 Republican National Lawyers Association (RNLA) reception in Ohio, at the bottom of this article. The RNLA is an off-shoot of the national Republican Party.
But Hearne is not the only high-level Republican operative working for the tax-exempt "non-partisan" 501(c)3 organization...

I just called a phone number,(804) 241-5368, listed on an American Center for Voting Rights press release. A woman answered who said she was in a meeting when I asked if I had reached the AC4VR.
I told her that I just wanted to confirm that the AC4VR is still in business and hung up. Odd that the woman just said hello when she answered my call. Odd, too, that the number is a cell phone.

"The May 17, 2006, U.S. Election Assistance Commission (EAC.gov) "Status Report on the Voting Fraud-Voter Intimidation Research Project" quotes Torchinsky, from the American Center for Voting Rights Legislative Fund, on page 12 as being "the only interviewee who believes that polling place fraud is widespread and among the most significant problems in the system."
"Torchinsky was identified as "Counsel to [the] American Center for Voting Rights" when he participated in an October 4, 2006, panel discussion at the American Constitution Society for Law and Policy."
As noted above, the AC4VR paid $73k to Soltzman Vogel at 98 Alexandria Pike, Ste 53 in Warrington VA 20186, according to the 2005 990. I think "Soltzman" is a typo and it should be "Holtzman Vogel."
Jason Torchinsky's Holtzman Vogel bio:
"Jason Torchinsky recently joined Holtzman Vogel PLLC with a primary focus on campaign finance and election law. During the 2004 election cycle, Jason served as Deputy General Counsel to Bush-Cheney '04 and Deputy General Counsel to the 2005 Presidential Inaugural Committee.
Immediately before joining the firm, Jason was Counsel to the Assistant Attorney General for the Civil Rights Division at the United States Department of Justice. Jason has also served in other positions at the White House and at the United States Department of Justice. At the White House, he worked for now-Attorney General Alberto Gonzales in the Counsel's Office. You'll come up with examples of historical party machines to try to disprove me, but anyone who has been to college in the last twenty years has seen the shenanigans of young Democrats screaming at anyone who disagrees with them, while young Republicans are almost laughably model citizens. This dirty politics is taken to the young professional world of politics, where the liberal mindset is "do anything, legal or not, to win."
So I'm not surprised at all to see the Justice Department, under any Adminstration, bring voter fraud cases against liberal-leaning groups. If the Democratics in Congress want to complain about the types of organizations that are being prosecuted, they should clean up their own house first.
This whole story is just a trumped-up, posturing waste of time, and your biased reporting makes it worse. Why don't Pelosi and Reid try to solve some real problems - and why don't you report on that?

I don't know if you read the comments here but I spent a fair amount of time compiling information about the American Center For Voting Rights and the American Center for Voting Rights Fund, GOP fronts set up to disenfranchise poor and minority voters.
Chairman Bob Ney, a convicted felon, only permitted one voter rights group, the American Center For Voting Rights, to testify before his House Administration Committee about voter fraud in the 2004 election. Get that - convicted felon?
The American Center For Voting Rights is headed by all-star roster of GOP bigwigs who are hardly impartial about voting rights. Mark "Thor" Hearne, Brian Lunde, Ann Browning, Pat Rogers and so on.
If Reid and Pelosi are indeed wasting our time, what's it to you? I would think you would be delighted to have big Dems obviously waste the public's imte.
