What Laws Govern Blackwater?

Blackwater CEO Erik Prince said his "understanding" is that his company is subject to the Uniform Code of Military Justice, the Military Extraterritorial Jurisdiction Act and the War Crimes Act. Well, asked Betty McCollum (D-MN), is the State Department, who hired Blackwater, under the UCMJ?

"I wouldn't be presumptuous to answer for the State Department," Prince replied. So it's just a "feeling" Prince has, that Blackwater is under the UCMJ, McCollum asked? "Legal opinions I respect" indicate as such, he said. But he couldn't state that for a fact? "That's correct."

By cutting and splicing somebody could make a great movie here! A short one. Like a commercial or something. It cries out to be done!

Didn't Texas recently try to execute a man who was just in a car when his friend went in and killed someone? Isn't Mr Prince more like the man at the wheel of the vehicle that has murdered inocent people.

Why not charge Mr. Prince with murder?

Accessory to murder, me thinks.

Peter, remember the "prophet" who just got convicted of being an accessory to rape?

You're on to something, you are!

Blackwater belongs to the International Peace Operations Association, which has many many USA and international members. Mostly USA and Britain.
See Wikipedia for more.

IPOA is a member of "the Peace and Security Industry"
( shades of Orwell)

The International Peace Operations Association is in, natch, Washington DC. It has a Journal.
And it has a Code of Conduct for members, and falls under the UCMJ>>>
"According to the FY2007 Defense Budget appropriation bill, the text of the UCMJ has been amended to allow for prosecution of military contractors who are deployed in a "declared war or a contingency operation."

"SEC. 552. CLARIFICATION OF APPLICATION OF UNIFORM CODE OF MILITARY JUSTICE DURING A TIME OF WAR. Paragraph (10) of section 802(a) of title 10, United States Code (article 2(a) of the Uniform Code of Military Justice), is amended by striking `war' and inserting `declared war or a contingency operation'." [4][5]

Best of all the website has a link to file a complaint about members. Hmmmmmmmm

Damn, these Congresscritters are idiots! Why doesn't somebody ask him if Blackwaster has an opinion FROM ITS COUNSEL about what laws it is subject to. You can bet your bottom dollar that they paid a lawyer somewhere, sometime to figure out EXACTLY that issue.

The answer? I'm betting: none.

From: Summary of International and U.S. Law Prohibiting Torture and Other Ill-treatment of Persons in Custody

http://hrw.org/english/docs/2004/05/24/usint8614.htm

"Military contractors working for the Department of Defense might also be prosecuted under the Military Extraterritorial Jurisdiction Act of 2000 (Public Law 106-778), known as MEJA. MEJA permits the prosecution in federal court of U.S. civilians who, while employed by or accompanying U.S. forces abroad, commit certain crimes.

Generally, the crimes covered are any federal criminal offense punishable by imprisonment for more than one year."

Law? What is that? These people are so special and I am sure they will really enjoy an 8x8 jail cell whenever we get some real leadership that respects the constitution.
