Rep. Denny Rehberg (R-MT), fresh off his Republican primary win, filed a lawsuit Friday against the City of Billings and the Billings Fire Department for damages sustained in a 2008 fire. Rehberg is the developer of record for the 1,000-acre subdivision that is managed by his wife.

Not Guilty Plea In Rehberg Boat Crash

The Montana Republican who was driving a boat that crashed while carrying Rep. Denny Rehberg and four other passengers has pleaded not guilty to three felony charges related to the August incident.

Prosecutors allege that State Sen. Greg Barkus had a blood alcohol content twice the legal driving limit nearly two hours after the crash. All five passengers -- the two elected Republicans, as well as Barkus's wife and two Rehberg staffers -- were injured in the crash.

Rehberg has said that Barkus "didn't appear to be impaired" when driving the boat, and that he is cooperating with the investigation.

Musician: Rehberg Didn't Seem Drunk On Night Of Boat Crash

Ever since the boat accident in late August in which Rep. Denny Rehberg (R-MT) and two staffers were seriously injured, the congressman has denied that he had been drinking heavily and has maintained that the driver, who was charged with felonies last week, was not impaired either.

Now, a musician who says he saw Rehberg in Lakeside, MT, shortly before the accident, has come forward to say that Rehberg was not drunk.

Terry Brick, a member of the Toby Stone Duo, playing the night of the crash, said in a letter to the Missoulian Friday that Rehberg was not exhibiting the signs of inebriation:

MT State Senator Charged With Felonies In Allegedly Drunken Boat Crash With Rep. Rehberg

Montana State Sen. Greg Barkus, who crashed his boat in a lake with four passengers aboard, including Rep. Denny Rehberg (R-MT), was charged today with one count of criminal endangerment and two counts of negligent vehicular assault, the Flathead county attorney's office confirmed to TPMmuckraker.

The charges, which can be read in full here, allege that Barkus was drunk on the night of August 27 and that his actions on Flathead Lake endangered the life of Rehberg.

Reached at his home this afternoon by TPMmuckraker, Barkus said he had not heard of the charges, all of which are felonies. He said he had no comment on the matter.
