That was the problem from the start - it wasn't FISA, it was that Bush ignored FISA and did what he wanted.
Jesus - how many times does this have to be said? FISA was on the books for years before Bush and used by other presidents to authorize unwarranted searches. They however, went to the FISA court after the fact and got approval. AFter the fact - get it? The executive has the power through FISA to contravene our rights and always did. The protection was the FISA court that Bush ignored.
The Appeals Court could not have held anything else- if you read the original statute you will see - it empowers the executive to conduct unwarranted searches, as long as the executive reports back to the Court and that's what Bush did not do.Short of repealing FISA, no one is going to get the constitutional result that the lying Glenn Greenwald insists we will get. No, we won't. He just hates Obama - obviously.

this is how stupid this has gotten - Keith Olbermann made a big ass deal out of John Dean's assessment that in order to be pardoned, someone has to be charged with something and admit guilt.
I could have told Keith that at any point in the last 25 years because that is not a big deal - that's the way it is and always was. John Dean didn't come up with this and Keith looks stupid on this issue because he's parroting what he's been told.
a good 3/4s of the people who signed on do not know what they are signing on to.Because this issue is not simple - the reductivists out there have tried to make it into a simple issue of our constitutional rights and it's not.
How many of you plan to sue telecoms?
Goddamn the Democrats for this - it's ours to lose and we're working on it.

where is the evidence going to come from? Who wants to make a bet with me - the telecoms are sued and the evidence is sealed because it's a matter of national security- that's what I'm betting would happen.
Patrick Fitzgerald ran into this same problem and couldn't get anywhere.
I'll say this: this damages Obama's ability to turn out the progessive vote and I'll never forgive anyone who made this into this kind of situation.
And fuck Glenn Greenwald.

I agree with all of that, but there are ways to verify this bullshit and no one is talking about that - they are all talking as if this is a fact.
And yes, this government used satellite photos to gin up the war in Iraq, but facilities on the ground are one thing - you can't tell what's going on inside. An offshore oil rig is a different animal - there's nothing else it can be - it sits out there in the sea - nothing else does.

O come on - how hard could it be to verify this rumor? We have satellites taking pictures of the whole fucking planet and if off-shore rigs had been built by someone other than us they'd fucking show up.
You can't hide an offshore oil rig. This is unbelievably stupid.
